4 Example training topics The following are examples of the most popular courses that we are regularly asked to run in house for organisations across a variety of sectors both public and private. We are able to design courses on any employment law topic and for whatever duration the organisation requires. Our materials can be adapted to suit all levels of expertise. These face-to-face training events are generally for up to 25 people, and can be adapted to either full or half day modules to suit. These are designed to raise awareness and knowledge levels in relation to key business issues and possible solutions. These are also aligned with our High Performance + consultancy services. Our training clients include 10 FTSE 250 businesses, 6 UK Top 20 Universities and 4 UK retail banks. Training for Employee Representatives Ensures representatives: 1. understand their role and responsibilities in being an employee representative; 2. develop understanding and confidence when dealing with their representative body; and 3. understand the typical practical and legal issues in which they may be asked to be involved. We also deliver training for employee and management representatives on their roles in a TUPE, redundancy or change situation. Transfer of Undertakings (TUPE): Part One Develops understanding of: 1. when TUPE may apply to a business transaction; Workplace change Reorganisations & Redundancies: the Practicalities Develops understanding of the key legal aspects of business reorganisation and redundancy programmes including: 1. the issues that arise on a work pattern change; and 2. when a redundancy arises; individual and collective consultation; pooling; selection; suitable alternative employment. Changing Terms & Conditions of Employment Explains what is required to vary an employee s terms and conditions and how to achieve variations in a legally compliant manner. Working Successfully with Trade Unions Explains the legal framework for engagement, consultation and negotiation when working with trade unions. 2. the due diligence required to protect the employer inheriting the employees; 3. which employees an employer may inherit; and 4. what risks and liabilities an employer inherits. Transfer of Undertakings (TUPE): Part Two Develops understanding of: 1. the information and consultation process that applies to a TUPE transfer; 2. protection from dismissal; 3. protection of terms and conditions of employment; and 4. pragmatic solutions to the legal issues. Dispute resolution Diversity & inclusion Managing Grievances Effectively Develops participants existing knowledge of the legal aspects of handling grievance complaints and hearings, particularly in more complex/difficult cases, and enables participants to deal with and where possible avoid grievances that might arise. Fair Disciplinary & Grievance Investigations & Decisions Builds participants knowledge and confidence on how to: 1. carry out legally fair disciplinary and grievance investigations; and 2. make legally robust decisions, particularly where allegations of discrimination are involved. Improving Under Performance Effectively Explains the legal framework relating to the management of under performance and how the business implements this in practice, including the sanctions available and which levels of management should be involved at different stages, and enables participants to make progress when faced with absence from work or a grievance when managing performance. The course can be combined with forum theatre delivered by professional actors to give participants the opportunity to practise techniques for raising performance issues, particularly at an early stage. Dealing with Absence Effectively Enables participants to deal with absence from work including liaison with occupational health, progression to a successful return to work or to dismissal and consideration of temporary resourcing when appropriate. Managing the Risks of Terminating Employment Enables participants to assess the financial, organisational and reputational risks of different strategies for ending employment including holding a meeting in a person s absence and the strategic use of settlement agreements. Employment Tribunals Preparing to Defend a Case Develops participants understanding and confidence when dealing with tribunal claims with particular emphasis on quantifying the risk, negotiating settlements and preparing for hearings. Diversity & Inclusion at Work Develops participants knowledge and confidence when assessing the relevance of discrimination law to everyday management decisions, and enables participants to respond appropriately to issues of bullying and harassment in the workplace. Avoiding Harassment & Bullying Raises awareness of what behaviours in the workplace could be unlawful harassment or bullying, and enables participants to take a proactive approach towards preventing this unwanted behaviour at work. We can deliver this course with a focus on a particular issue if desired, for example, with an LGBT focus. Advance Diversity Training: Handling Challenging Conversations Well Improves participants confidence and ability to have challenging conversations about issues such as inappropriate banter at work, requests for agile working and health related issues. This course involves professional actors using forum theatre to illustrate the issues and how to resolve them. Making Reasonable Adjustments for Disability Develops understanding of: 1. the extent of what may be a disability; 2. the limits of the duty to make reasonable adjustments; and 3. how to manage the risk of uncertainty about whether a person has a disability. If stress or mental health is a particular issue, a variation of this course can focus on recognising disability due to mental health conditions and what adjustments may be required for those conditions. Managing Flexible and Agile Working Effectively Explains ways that flexible working patterns can benefit both organisations and employees, and enables participants to challenge managers who wish to refuse requests for flexible or agile working about whether this is justified legally. 6 Employee mobility Global Mobility: International Assignments In this session we brainstorm a number of topical issues relating to international assignment of employees, from before, during and ending the assignment; so that participants can deal with the key legal issues which typically arise. Translated what is a very complex topic into something that was easy to apply and understand. Other Employment Law Topics Immigration and Preventing Illegal Working Updates participants on the latest developments relating to an employer s obligation to prevent illegal working and to enable them to deal with problems and pitfalls that commonly arise. An additional module on sponsorship obligations is also available. Social Media at Work Explains the legal framework relating to the use of social media at work, with particular focus on the use of social media outside o work such that it impacts on reputation or workplace relationships; and the extent of the right to a private life. Essential Employment Law for Managers/ Senior Managers Develops managers understanding of key areas of employment law, helping them understand the main risk areas and developing their confidence in dealing with day-to-day employment law issues. We also deliver strategic one-to-one coaching for senior managers or training for board level on this topic. Excellent presentation style very engaging and informative. 10 Appendix I: Sample Course Outline Essential Employment Law for Managers Aim Building upon Managers existing experience and expertise, to 1) develop their confidence in handling people management issues and 2) be mindful of potential risk areas and 3) determine a course of action that is in the best interests of the business Objectives By the end of this one day course, participants will be able to: identify a) their role and responsibilities in relation to handling matters such as employee discipline, performance and absence and b) the support and advice available from HR and at what stage this is best sought; state the importance of note taking in relation to any discussions or meetings relating to these matters; analyse the best (and legally fair) approach to misconduct, poor performance and absence by reference to a checklist of factors setting out the relevant issues that a manager should consider before deciding on appropriate action; and explain the responsibility of mangers to prevent harassment in the work place and identify practical steps that can be taken, within teams, to achieve this.
