12 OBLIGATORY MAINTENANCE THE LEGAL PRINCIPLES The operation and maintenance of automatic door and gate systems are subject to the following legal requirements: Swiss Code of Obligations (OR) Article 58 The owner of a building or other premises shall be liable for loss and damage resulting from defective equipment or facilities, including all or any failure to provide proper maintenance for such equipment or facilities. The owner shall have a right to recourse regarding those responsible to him in this respect. Swiss labour law (Arbeitsgesetz) Article 61 The employer undertakes to implement, on behalf of his employees, all those health and safety measures that experience has shown to be necessary, and to ensure that such measures meet current technical standards in a manner appropriate to the operating conditions in force. Compliance: Observance of the corresponding standards imposed by FCOS (Swiss Federal Coordination Commission for Occupational Safety) guideline 6512, the VKF (Swiss Association of Cantonal Fire Insurers) fire-prevention norms (article 18) and SIA 343 (SN545343) shall constitute compliance in this respect. SIA 343 / 2010 Article The requirements regarding automatic doors are established in the standard EN EN Regular inspection The manufacturer shall indicate, in the product information concerned, the obligation to carry out regular inspections, on at least an annual basis, of the automatic door system, subject to the specifications of the manufacturer of the drive system. Inspection must be carried out by a properly-qualified person in accordance with the corresponding checklist, with a written record kept in the form of an inspection logbook. The operator must hold the completed checklist on file for at least one year. The manufacturer must inform the operator of this obligation to hold information on file. VKF (Swiss Association of Cantonal Fire Insurers) Article 18 The owners and users of buildings, premises and facilities are responsible for ensuring that the systems and devices provided for structural, technical and pre-emptive fire-prevention purposes, including the corresponding in-house technical systems, are maintained to the correct standards and are ready for use at all times. 12
