2 CRFQ : M/s. Dear Sir/Madam, SUBJECT: INVITATION OF E-TENDER IN TWO PART BID FOR SUPPLY OF 1560 KL PAINT / PRIMER / THINNER FOR DPT LPG CYLINDERS TO ALL LPG PLANTS ACROSS INDIA (TENDER NO. CRFQ: DATED ) You are invited to submit your offer in two parts online bid (BQC, Techno - Commercial & Price bid) for supply of 1560 KL Paint / Primer / Thinner for DPT LPG Cylinders at various LPG Plants as per the Technical Specification enclosed herewith. The entire quantity needs to be supplied on freight prepaid door delivery basis to LPG Bottling Plants mentioned in Tender Document. Please find enclosed the following set of annexures: i BQC & Technical Specification - Annexure I ii Instructions to Tenderer - Annexure II iii Terms & Conditions of Agreement - Annexure III iv Particulars of Tender - Annexure IV v Declaration Forms - Annexure V vi E-Tender Process - Annexure VI vii Integrity Pact - Annexure VII All the annexures along with this letter form the tender document. 3. Tender documents complete in all respects should be uploaded online along with details of EMD / MSME / NSIC registration certificate. 4. EMD, if applicable, should reach the office of LPG Equipment department at the above address on & before the due date and time as mentioned above. 5. BPCL will not be responsible for non-receipt of EMD due to postal delay / loss in transit etc. 6. Kindly ensure to sign the declaration (draft given below) on your letter head and upload it along with the Technical Bid, as bids are liable to be rejected if such declaration is not uploaded.

3 DECLARATION ON LETTERHEAD We solemnly affirm as under: a) This Tender Document Set was downloaded by us from your website and is being used for submitting our technical bid. b) The downloaded file was printed and is being submitted without any alterations, deletions, additions or changes. c) We further affirm that all Terms and Conditions of the tender are acceptable to us and we hereby accept and agree to abide by all the Terms and Conditions contained in the tender document. e) We understand that in case it is found subsequently that the downloaded Tender Document Set was altered or tampered with, in any manner, then our bid is liable to be rejected or in case a purchase order is placed on us basis such tampered document, then the order is liable to be cancelled without any further reference to us. f) We have legally valid Digital Signature Certificate in the name of and valid up to dt Signature : Seal : 7. The tender document is not transferable. 8. Integrity Pact - Signature: Seal : a. Proforma of Integrity Pact shall be returned by bidder/s along with the bid documents (Credential Bid in case of 2 part bids), duly signed by the same signatory who is authorized to sign the bid documents. All the pages of the Integrity Pact shall be duly signed. Bidder s failure to return the IP duly signed along with the bid documents shall result in the bid not being considered for further evaluation. b. If the bidders has been disqualified from the tender process prior to the award of the contract in accordance with the provisions of the Integrity Pact, BPCL shall entitled to demand and recover from Bidder Price reduction amount by forfeiting the EMD/Performance Guarantee as per provisions of the Integrity Pact. c. If the contract has been terminated according to the provisions of the Integrity Pact, or if BPCL is entitled to terminate the contract according to the provisions of the Integrity pact, BPCL shall be entitled to demand and recover from contractor Price

4 reduction amount by forfeiting the Performance Guarantee amount as per provisions of the Integrity Pact. d. Bidders may raise disputes/complaints, if any, with the BPCL Officers or nominated Independent External Monitor. 5 BID QUALIFICATION CRITERIA 1. Capability Criteria Ability To Manufacture : Vendor should have facilities for manufacturing of Paint & Primer both as on bid submission date. (Document Certification by approved TPIA). 2. Capacity Criteria Proven Track Record of Past Performance : Vendor should have manufactured & supplied at least 156 KL (1,56,000 Ltrs) of Paint or Primer or both put together during any continuous 12 months period in last 7 years period reckon from the bid submission date (Documentary Evidence Tax Invoice Copies for supply of 156 KL Paint or Primer or both put together and Certification by approved TPIA). All the above documents required as per BQC point no 1 & 2 shall be duly verified & certified by approved Third Party Inspection Agencies (TPIA) - Bureau Veritas Industrial Services / SGS India Pvt Ltd / Germanischer Lloyds Industrial Services / Indian Register of Shipping / Det Norske Veritas / Lloyds Register Industrial Services / Tata Projects Ltd / Engineers India Ltd / Project & Development India Ltd / UL India Pvt Ltd / MECON Ltd / RITES Ltd. All the charges for TPIA certification for this BQC criteria will be borne by the bidders. 3. Financial Turn Over Criteria : The vendor should have a min average annual turnover of Rs 5.95 Crores during last 3 financial years. Document to be submitted Audited balance sheets and Profit & Loss account statement for last 3 consecutive financial accounting years prior to the due date of bid submission. 4. Financial Profitable Operation Criteria : The net worth of the vendor should be positive as per the last available audited financial statement. Net Worth = Equity + Reserves & Surplus Document to be submitted Audited balance sheets and Profit & Loss account statement of the bidder for the last 3 consecutive financial accounting years prior to the due date of bid submission.

7 B. Primer Specification : 1 Industrial Paint Zinc Chromate Primer Brown Colour conforming to IS: 2074: 2015 ( latest version ). Application - Painting of main LPG Cylinders body. C. Thinner Specification : 1 Thinner Transparent conforming to IS- 1745: 1978 ( latest version ) as per Grade E (Solvent 145/205). Application Diluting Paint & Cleaning purpose. Vendor are requested to submit the Tax Invoice details / TPIA certificate along with Copies of invoices for supply of 156 KL Paint or Primer or both put together as per following format : Sr No Name of Product (Paint / Primer) Invoice no Invoice dt Quantity supplied (Ltrs) Packing (Conforming to IS 2932 Point no 7) The enamel paint shall be packed in suitable metal containers (see IS 1407 and IS 2552). The packing is subject to the provisions of the law in force in the country at that time. All grades of Paint, Primer & Thinner to be supplied in 20 Liters container size. Min order quantity per PO is 3 KL. Marking (Conforming to IS 2932 Point no 7) Each container shall be marked with the following : a) Name of material and indication whether undercoating or finishing. b) Indication of the source of manufacturer. c) Lead content (Max) d) A statement Synthetic if the material contains phthalic anhydride. e) Volume of material. f) Batch number or Lot number in code or otherwise g) Month & year of manufacture h) Colour / Shade of the material and i) A cautionary note as given below : 1. Keep out of reach of children. 2. Dried film of this paint may be harmful if eaten or chewed. 3. This product may be harmful if swallowed or inhaled.

8 Further, any damage or loss of Paint / Primer / Thinner because of poor quality packing or any other reason shall be recoverable from the successful tenderer as decided by the Corporation. Testing / Quality Assurance Plan : Successful bidder if not having BIS license should carry out the testing of Paint / Primer / Thinner from BIS recognised Laboratories before dispatch of material. However Successful bidder if having BIS license, they can carry out the testing of Paint / Primer / Thinner at their own Laboratory before dispatch of material. Testing to be done batch wise and certificates to be submitted along with all invoices during supplies. In both the cases, Successful bidder should submit the test report indicating Product name / Batch No / conforming to IS code / Batch Qty / Manufacturing date along with other testing parameters mentioned in Table 2 as per IS 2932:2013 (latest version) standard for Paint & Table 1 as per IS 2074: 2015 ( latest version ) for Primer to LPG Plant. Inspection at manufacturing unit will be regarded as a check up and shall not relieve the vendor of any contractual obligations and performance guarantee. The inspection / testing charges shall be inclusive in the offer. List of BIS recognised Laboratories as on is enclosed as Tender Document. BPCL may also send samples of Paint / Primer / Thinner to reputed laboratories regularly for testing. In case of quality failure of these tested samples, action shall be taken against Successful Bidder as per following. 1. First failure: The entire lot shall be rejected and the cost will be recovered / vendor has to replace Paint / Primer / Thinner at their own risk & cost. The warning letter will be issued. 2. Second Failure: The entire lot shall be rejected and the cost will be recovered / vendor has to replace Paint / Primer / Thinner at their own risk & cost. In addition to the same, Penalty of Rs 10,000/- will be imposed on vendor & Suspension of the manufacturer. Revocation will be done based on the corrective actions. 3. Third Failure: Suspension of the manufacturer for the remaining period of the Tender / Termination of contract and further action as per tender T & C. Kindly note that in case of any quality issue or supplies of defective material or failure of samples etc, BPCL plants will not return the quantity supplied to the successful vendor. If sample sent by successful bidder is passed but sample sent by BPCL / LPG Plant fails to meet the respective IS standard, then BPCL report will be considered as final and suitable action will be initiated by BPCL as per tender T & C.

9 If BPCL / LPG Plants are sending the sample for testing then entire cost & Quantity required for testing will be borne by BPCL. Performance Guarantee: Paint / Primer / Thinner shall be guaranteed by the vendor for a period of 12 months from the date of delivery. In Case of any defects that develop within the guaranteed warrantee period the same shall be replaced free of charge. All the expense incurred for supplies including those of transportation shall be borne by the vendor. VENDORS ARE REQUESTED TO QUOTE THE RATE AS PER TECHNICAL SPECIFICATION GIVEN ABOVE.
