1 OTHER PERMIT VIOLATION (a) Except as specified in subdivision (b), all MOBILE FOOD FACILITIES shall operate in conjunction with a COMMISSARY, MOBILE SUPPORT UNIT, or other facility APPROVED by the ENFORCEMENT AGENCY. (b) This section does not apply to MOBILE FOOD FACILITIES that operate at COMMUNITY EVENTs as defined in Section and that remain in a fixed position during FOOD PREPARATION and its hours of operation, if POTABLE WATER and liquid waste disposal facilities are available to MOBILE FOOD FACILITies requiring POTABLE WATER (a) MOBILE FOOD FACILITIES shall be cleaned and serviced at least once daily during an operating day. (b) Except as specified in subdivision (c), all MOBILE FOOD FACILITIES shall report to the COMMISSARY, or other APPROVED facility on a daily basis. (c) MOBILE FOOD FACILITIES that are serviced by a MOBILE SUPPORT UNIT and that do not report to a COMMISSARY on a daily basis shall be stored in a manner that protects the MOBILE FOOD FACILITY from contamination. All FOOD shall be stored at the COMMISSARY or other APPROVED facility at the end of the operating day. (d) MOBILE SUPPORT UNITs shall report to a COMMISSARY or other APPROVED facility for cleaning, servicing, and storage at least daily. AJ s has previously identified La Trailita located at 1750 N. 10th Ave., Hanford, CA as their commissary. Inspectors have confirmed with La Trailita on multiple occasions that AJ's does not utilize their facility for food deliveries, storage, or preparation (a) A FOOD FACILITY shall be operated within 200 feet travel distance of an APPROVED and readily available toilet and handwashing facility, or as otherwise APPROVED by the ENFORCEMENT AGENCY, to ensure that restroom facilities are available to facility EMPLOYEEs whenever the MOBILE FOOD FACILITY is stopped to conduct business for more than a one-hour period. Since the mobile unit remains parked at the residence, even though in operation, there is no access to an approved restroom within 200 feet Except as otherwise provided in this part, any PERSON who violates any provision of this part or regulation adopted pursuant to this part is guilty of a misdemeanor. Each offense shall be punished by a fine of not less than twenty-five dollars ($25) or more than one thousand dollars ($1,000) or by imprisonment in the county jail for a term not exceeding six months, or by both fine and imprisonment. 2 (a) A PERMIT may be suspended or revoked by a local ENFORCEMENT OFFICER for a violation of this part. Any FOOD FACILITY or COTTAGE FOOD OPERATION for which the PERMIT has been suspended shall close and remain closed until the PERMIT has been reinstated. Any FOOD FACILITY or COTTAGE FOOD OPERATION for which the PERMIT has been revoked shall close and remain closed until a new PERMIT has been issued. (b) Whenever a local ENFORCEMENT OFFICER finds that a FOOD FACILITY or COTTAGE FOOD OPERATION is not in compliance with the requirements of this part, a written notice to comply shall be issued to the PERMIT HOLDER. If the PERMIT HOLDER fails to comply, the local ENFORCEMENT OFFICER shall issue to the PERMIT HOLDER a notice setting forth the acts or omissions with which the PERMIT HOLDER is charged, and informing him or her of a right to a hearing, if requested, to show cause why the PERMIT should not be suspended or revoked. A written request for a hearing shall be made by the PERMIT HOLDER within 15 calendar days after receipt of the notice. A failure to request a hearing within 15 calendar days after receipt of the notice shall be deemed a waiver of the right to a hearing. When circumstances warrant, the HEARING OFFICER may order a hearing at any reasonable time within this 15-day period to expedite the PERMIT suspension or revocation process. (c) The hearing shall be held within 15 calendar days of the receipt of a request for a hearing. Upon written request of the PERMIT HOLDER, the HEARING OFFICER may postpone any hearing date, if circumstances warrant the action. Results from a surveillance investigation conducted by our office has confirmed that AJ's is not conducting food operation as they have previously stated. During the March 15, 2018 inspection, the operator explained the steps followed when they receive a phone order. First they tell customers that they will return the call. Then they drive the mobile unit from the residence to park outside city limits. Once parked, they return the phone call to take the orders. They also inform customers of their location and customers pick up their food from the mobile unit. Operator stated they were no longer making any food deliveries. The investigation conducted clearly confirmed that the mobile unit does not leave the residence to prepare food orders and customers don t pick-up orders from the mobile outside city limits. Instead, the mobile unit remains parked at the residence. The food is prepared on site and then delivered to the customers. FOODS FROM UNAPPROVED SOURCES [HSC ] Page 2 of 3

3 All FOOD shall be manufactured, produced, prepared, compounded, packed, stored, transported, kept for sale, and served so as to be pure and free from adulteration and spoilage; shall have been obtained from APPROVED SOURCEs; shall be protected from dirt, VERMIN, unnecessary handling, droplet contamination, overhead leakage, or other environmental sources of contamination; shall otherwise be fully fit for human consumption; and shall conform to the applicable provisions of the Sherman Food, Drug, and Cosmetic Law (Part 5 (commencing with Section )) (a) FOOD shall be obtained from sources that comply with all applicable LAWs. (b) FOOD stored or prepared in a private home shall not be used or offered for sale in a FOOD FACILITY, unless that FOOD is prepared by a COTTAGE FOOD OPERATION that is registered or has a PERMIT pursuant to Section During the March 15, 2018 inspection, the operator also stated he would submit receipts to the Department. As of date, the operator has not provided invoice or receipts indicating where food supplies are purchased. At this point, the Department cannot confirm if the food items are purchased from an approved source. General Comments: ***At this time, AJ's food vending permit is suspended. All food operation MUST cease immediately. Failure to do so will result in further enforcement not limited to fine and/or imprisonment. 4 (678) PR February 28, PARK AVE ROUTINE INSPECTION IMPROPER CLEANING OF UTENSILS AND EQUIPMENT [HSC & ] Observed cook area with accumulated food debris when unit is not in operation. Ensure mobile unit is clean and maintained on a daily basis. FOODS & EQUIPMENT NOT PROTECTED FROM CONTAMINATION [HSC , ] Observed raw eggs stored at room temperature. Ensure all raw potential food items are stored in cold holding unit at or below 41F. IMPROPER MAINTENANCE OF HANDWASH FACILITIES [HSC ] Observed hand wash station used as storage to store equipment. Hand wash station must be kept clear and be accessible at all time. IMPROPER THAWING OF FROZEN FOODS [HSC ] OTHER PERMIT VIOLATION Observed frozen meat in the sink. Discontinue this process immediately as it is not an approved defrosting method. Approved defrosting method include: in the refrigerator, using the microwave, under continuous cool running water, and as a cooking process (a) Except as specified in subdivision (b), all mobile food facilities shall operate in conjunction with a commissary, mobile support unit, or other facility approved by the enforcement agency. (c) Mobile food facilities shall be stored at or within a commissary or other location approved by the enforcement agency in order to have protection from unsanitary conditions. (d) Mobile support units shall be operated from and stored at a designated commissary and shall be subject to permitting and plan review. Our Department has confirmed that the mobile food unit is not stored at the listed address on file (509 Park Avenue, Hanford, CA). Instead, the mobile unit is parked at 2311 N. 11th Avenue, Hanford, CA. Please update your address with our Department. IMPROPER MAINTENANCE OF FACILITY OR EQUIPMENT [HSC & ] General Comments: Observed card boards throughout the floor of the mobile unit. Discard all card boards.
