6 Compliance Verification Program The safety performance of NPPs is determined by CNSC staff using the results of activities planned through the compliance verification program. Compliance activities include surveillance and monitoring by full-time onsite inspectors, announced and unannounced inspections and desktop reviews. All compliance activities are fully documented and record the objective evidence that is the basis of the compliance results. 142 inspections conducted, led by 23 site inspectors. Over 1,400 findings derived from compliance activities. Risk-informed and performance-based approach 6

19 Darlington Legal Challenges Darlington New Nuclear Project New nuclear power plant project deferred OPG collecting information to assist design activities In May 2014, Federal court decided on the judicial review of environmental assessment (EA) and site licence Decision is under appeal Darlington Refurbishment EA under judicial review Heard by Federal Court on May 6, 2014 Written presentations submitted during the summer CNSC decision on EA remains valid until Court says otherwise 19
