The person who represented the company could not explain the circumstances under which the item has been imported without the prior permission of this Ministry. The Committee therefore recommended that a complete should come for presentation in the next meeting. 20/10/2015 Now the applicant has re-submitted a fresh along with the following documents and has also ensured that the concerned technical representative will be there in the meeting for presentation.

The matter was discussed in the 61 st meeting of Expert Committee held on 24 th and 25 th August, Taking into consideration the recommendation of the Committee, the Competent Authority noted that the is for import of medical spare part-intraocular lenses. Contact lens solutions are very sensitive and medically used for eye treatment. In this matter care is also to be taken whether the applicant s company s declared policy is to use refurbished or used lenses and lens solution during the warranty period etc. before such imports are allowed. 19/10/2015 Now the applicant has given some clarification in their letter that these refurbished parts will be used for medical equipment (catalogue of the equipments are also enclosed) and requested to re-consider their case.

No. 5- Import of 20,000 MT of waste rubber scrap Import of 1,600 MT of used tyre scrap The matter was discussed in the 54 th meeting of the Expert Committee held on 5 th -6 th January, The committee noted that in the 50 th Expert Committee Meeting held during 6 th -8 th August, 2014, the Committee had suggested site visit by the zonal Office of CPCB before the matter could be considered further and accordingly it was conveyed to CPCB. Zonal Office, CPCB has been now submitted the site inspection report of M/s Vinora Industries, Chennai. The matter was discussed in the 61 st meeting of Expert Committee held during 24 th and 25 th August, 2015 and the Committee recommended for site inspection by CPCB. The matter was considered in the 60 th meeting of Expert Committee held on 22 nd July, The Competent Authority noted that the purpose of import is to conduct trial in cement kiln as supplementary fuel. Rubber tyre scrap is one of the inputs permissible in hazardous waste for incineration. However, this is only trial stage. The trial stage requirement of shredded tyre can be met domestically. Therefore the was rejected. Now the applicant submitted some 06/10/2015

New Delhi has obtained a NOC from MoEF &CC for import of 5000 MT of Tyre scrap for manufacturing of crumb rubber,modifier and crumb rubber modified bitumen for wada plant vide O.M No. 5-22/2010-HSMD dated The bill of entry at ICD Loni shows the importer details as M/s Tina Rubber & Infrastructure Ltd. Refinery Road, Panipat (Haryana) and the NOC details is Wada Plant of M/s Tina Rubber & Infrastructure Ltd. It shows that

26 Item Documents enclosed with the Date of M/s Tina Rubber & Infrastructure Ltd is importing material for its Panipat plant on the NOC of Wada Plant. Further the additional Commissioner of Custom has sought clarification from the Ministry whether the NOC granted vide O.M No. 5-22/2010 HSMD dated to M/S Tina Rubber & Infrastructure Ltd is valid for import and utilization for its Wada plant only or it can be utilized for other plants also as mentioned as branches in IES. M/S Tina Rubber & Infrastructure Ltd has clarified that they have six plants in India at different location. It is quite often that material is not available at one location and if available many times vessel from that port is not available. If there is

27 Item Documents enclosed with the Date of a shortage of material at one plant they transfer material from other plant and do stock transfer after the material. So they import material on NOC of one plant and transfer that material to the other plant. On analyzing the above two situations, it has been observed that such kind of import is creating confusion for Custom as importer details are different form NOC details. On the other hand it gives flexibility to M/S Tina Rubber & Infrastructure Ltd in controlling its logistic cost and material availability.

28 AGENDA 2.5: IMPORT OF OIL. The applicant had been again requested to submit the analysis report as per the characteristics given in scheduled VA of the Rules. 19/10/2015 Now the applicant has submitted the desired documents.
