(2) B rates shall apply to all hours outside of A rate hours. (3) There are no additional charges associated with CPB cancelling previously booked personnel or equipment of the Hirer. (4) The rates are inclusive of all costs, overheads, profit, insurance, all allowances, training, levies, inductions, PPE, on-costs, and travel. (5) The rates set out in the table above shall be locked in from Contract execution date through to the completion of the Project. Page 2 of 9

3 MOOREBANK INTERMODAL DEVELOPMENT (MITD) (1) Background SIMTA s Moorebank Intermodal Terminal Development involves the construction and operation of the necessary infrastructure to support a container freight road volume of 250,000 twenty-foot equivalent units. CPB Hirers scope of work specifically applies to Stage 1 RALP No. 1 which consists of a 2.8 kilometre rail line, along with its required infrastructure, to connect the Import-Export Terminal and Interstate Terminals to the Southern Sydney Freight Line, and capable of accommodating trains up to 1,800m in length. The SIMTA site is located in the Liverpool local government area. It is 27 kilometres south west of the Sydney Central Business District, 26 kilometres west of Port Botany, 16 kilometres south of the Parramatta CBD, 0.6 kilometres from the M5 South West Motorway, five kilometres east of the M5 South West Motorway / Westlink M7 Motorway Interchange and connecting to the main north south rail line via the Southern Sydney Freight Line. (2) Site Location An indicative map of the Project is provided in the figure below. The Site is located at Moorebank in New South Wales. Maximum axle loading of any delivery vehicle is 9.5t. Maximum size of delivery vehicle is standard semi. Page 3 of 9

4 SCOPE OF WORKS 1.1 General (1) The scope of work generally involves all work necessary to complete the work under the Contract in accordance with the Contract, including (as relevant to or as required for the performance of such work: complying with the technical documents; except to the extent (if any) expressly stated otherwise in the Contract: (i) and providing all necessary vehicles, plant, equipment, materials, goods, items, tools, Site facilities and services for personnel, safety and protective clothing, consumables and other things; complying with all relevant Australian Standards and legislative requirements. (2) Site Access All access to the Site will be co-ordinated through CPB and no Hirer are to attempt to gain access to the site without prior written approval from the Project Manager or their nominated representative. The Hirer is deemed to have satisfied itself as to access, site conditions and working restrictions otherwise a site visit will be facilitated. Stages of construction of the site may change during the construction of the Works. 1.2 Specific Requirements (1) The work under the Plant Hire Contract comprises: (d) (e) (f) The Hirer is to provide experienced, trained and qualified operators to carry out the works. The Hirer will make available plant equipment at a volume and frequency as reasonably requested by CPB Contactors. All plant are to be fitted with the specified requirements in the Mobile Plant Safety Matrix and in accordance to the relevant Australian Standards. Please refer to the attachment - Mobile plant safety matrix. The Hirer is to ensure that all plant are properly maintained and serviced to the requirement and are in good condition to perform the work. The Hirer shall ensure that all plant undergo routine and scheduled maintenance and servicing and are in good condition to perform the work. All plant and machinery must have log books and maintenance records within the plant and produce on site if requested by CPB. Plant is to be fuelled by the Hirer and include all lubes, replacement cables and insurance, routine maintenance and operators. Page 4 of 9

5 (2) Work included (d) (e) (f) (g) (h) (i) (j) The work under the Plant Hire Contract includes the provision of all labour, plant, equipment, tools, supervision, overheads, administration, taxes, wages, accommodation, transport, allowances, consumables, and any other incidental cost whatsoever necessary for the works in accordance with the contract documents. The Hirer shall allow for working under and around high voltage cables including but not limited to utilising excavators with height and slew restrictors and suitably qualified operators and spotters (crane & plant electrical safety competency formerly 5099 exemption) or any other requirement to comply with Legislation when working in the vicinity of High voltage overhead power lines. The Hirer shall keep the works clean and tidy and ensure that rubbish is regularly removed from the site. On completion of the works, the Hirer must remove all surplus materials, rubbish and temporary works of every kind and must leave the site of the works, existing structures and areas adjacent in as good a state of repair as when the works commenced. The Hirer also understands should they fail to clean up their works areas they may be charged for these areas to be cleaned on their behalf. The Hirer shall ensure that before any plant arrives on site it must be inspected and approved by CPB. This will apply to the re-entry of plant & machinery if re-mobilisation is required, except for servicing and maintenance purposes. The Hirer shall complete a declaration of serviceability if any plant is removed from site for more than a 24hr period or if it is modified or involved in any type of incident. The Hirer shall provide CPB with a plant risk assessment for each item (or type) of plant or equipment provided and a safe work method statement for each type of plant. The Hirer shall ensure that all moving plant are fitted with non-tonal reversing beepers ( quacker ), a reversing camera and dual orange flashing light in accordance with the relevant Australian Standards. The Hirer shall ensure that all moving plant (with the exception of light vehicles) are fitted roll-over protection and falling object protection. Plant and equipment without these may only be used on site with CPB approval and only after CPB conduct a risk assessment. The Hirer shall ensure that all refuelling and maintenance of plant is performed in CPB designated area only. The Hirer shall ensure that two-way radios are installed or supplied (hand held accepted) in all of the Hirer s plant /vehicles operating within the rail corridor. The Hirer shall ensure that all plant/vehicles adhere to the requirements of the National Standard NOHSC (3) Work not included The following work and items are not included: Traffic control on Site; Page 5 of 9

6 Survey set out; Rail protection officers. (4) Inductions The Hirer shall ensure that each personnel, including supervisors and managers, prior to commencing work on Site attends a CPB Site induction carried out by CPB. All personnel attending the CPB Site induction must have a valid WorkCover OH&S General Induction card and a valid Rail Industry Worker card. The rates include for all Hirer s personnel to attend a project induction prior to commencement on Site. On being inducted, the Hirer s personnel will be issued a CPB ONSITE Card that is to be used by all personnel each time they work. At the start of the shift the Hirer s personnel must sign on to the available ONSITE machines and display the printed receipt on their person for that shift. The Hirer s personnel must sign off at the available ONSITE machines to confirm their departure from Site. The use of the system is not negotiable and is part of the CPB commitment to health and safety and in particular the management of fatigue. (5) Drugs and Alcohol Testing CPB will undertake random drug and alcohol testing and any of the Hirer s personnel that return a non-negative reading for either will be removed from Site and the authorities notified where appropriate. If any of the Hirer s personnel return a nonnegative reading to random drug and alcohol testing, they will not be permitted to return to Site until the result of the urine confirmation test is available (which can take approximately 3 business days), unless a positive reading to the non-negative test is established, in which case, the worker will not be allowed to return to Site. The initial costs associated with random drug and alcohol testing will be borne by CPB. However, if any of Hirer s personnel are required to undertake a urine confirmation test, the Hirer is responsible for such costs associated with the urine confirmation testing. If the confirmation test result is deemed negative by the laboratory the worker will be paid by the Hirer for any reasonable time missed and allowed to resume work immediately. No claims in this regard will be accepted by CPB. (6) Personal Protective Equipment (PPE) The Hirer must ensure that each person authorised to enter the Site: (d) (e) wears an orange safe-working vest with retro reflective strips approved by RailCorp and in accordance with Australian Standard AS 4906; wears protective lace up footwear which provides ankle support and impact resistance (elastic sided boots are not acceptable unless written exemption is issued by CPB); wears a safety helmet, gloves and eye protective equipment at all times whilst on Site; wears hearing protection as appropriate and required; wears long pants, a long sleeved shirt at all times whilst on Site; and Page 6 of 9

7 (f) (7) Safety does not wear any red or green clothing or non-collared shirts such as tee shirts and singlets when working in the rail corridor. The Hirer must: (d) (e) (f) (g) (h) (i) (j) Before starting work, all personnel must attend and sign the Pre-Start meeting which deals with the tasks of that specific crew. This will also include a daily risk assessment of the work area with the Hirers foreman/supervisor and completion and sign off on the SHEWMS document. Toolbox meetings will be held at least once per week, and where deemed necessary by CPB for communicating Safety and Health critical information may be supplemented by a second meeting. The Hirer is to comply with CPB procedures for work permits; these include but are not limited to Work Permit, Permit to Excavate, Hot Works Permit, Confined Space Permit, Power Outage Permit and Over-head Power Permits etc). The Hirer is responsible for liaison with the relevant CPB personnel for having this permit issued prior to performing work in any new area. The Hirer agrees that no work is to commence until all affected site personnel have been consulted, reviewed and signed onto the SHEWMS, Pre-Start. All work permits are to be signed by all affected site personnel (Permit to Excavate, Hot Works Permit, etc.). The Hirer shall provide one (1) worker to be involved with the Project Site Safety Committee if requested by CPB. The Hirer must ensure that all quick hitches for excavators are automatic with positive hydraulic locks or manual (fully pinned only). Semi-automatic quick hitches to excavators are not allowed on this Project. The Hirer will comply with the CPB Safety Essentials. The Hirer is to ensure all plant and equipment is fitted with appropriate fire suppression equipment such as fire blankets, fire extinguishers, etc. Any item of plant which has the potential to enter the danger zone or impact on the safe working distances for Overhead wires, while being used on site must be equipped with operational height and slew restrictors. All plant is to meet the mandatory plant requirements as per the plant on boarding procedure. Ensure all site personnel prior to start of any shift on any day, attend CPB s pre-start brief and rail protection officer brief as applicable; The Hirer is deemed to have allowed for all costs associated with complying with the project safety requirements in carrying out the work under the Contract. (8) Site Working Hours The Site working hours are: Monday to Friday Saturday 7am to 6pm 8am to 1pm (subject to agreement by CPB, Saturdays are not planned working days and Hirer is not to program work as such) Page 7 of 9

8 Weekend possession 24hr working (subject to RailCorp and EPA approval) The Hirer must NOT undertake any work including but not limited to, delivery/pick up/drop off or maintenance of Plant, delivery of materials, outside of the Site working hours without the written permission of CPB. No queuing and/or idling in public areas outside of the work Site outside of the Site working hours. (9) Site boundary At no time shall the Hirer enter areas beyond the Site boundary. There will be specially designated environmentally sensitive areas and areas set aside for erosion and sediment controls, within the site boundary, that will have specific limitations regarding access; the Hirer must observe all limitations regarding said areas and where not specifically and explicitly required to enter said areas will treat them as being beyond the site boundary and as such off limits. 1.3 Technical Documents The following documents shall be used for the work under the Works Contract: Document No. Version Date Description Mobile Plant Matrix Rev 1.1 Mobile Plant Safety Specifications for CPB Hirers Mobile Plant Safety Spec Matrix Excel Performance Specification A 06/05/15 Performance Specification - Moorebank Intermodal Terminal Development Rail Access Works No.1 2. SERVICES AND FACILITIES 2.1 Parking Limited parking will be available on site. Parking will only be permitted in designated CPB parking areas or other locations as agreed prior to site mobilisation. All additional parking and transport costs outside of those provided by CPB will be at the Hirer s cost.
