3 Terms and Conditions of Use DB SCHENKERpart load DB SCHENKERpart load is a product of Schenker Europe GmbH. The German Freight Forwarders' Standard Terms and Conditions (ADSp) shall apply and, where these are not valid for logistics services, the latest version of the General terms and conditions of logistics services providers shall apply. Furthermore, the terms and conditions presented below shall be valid and take precedence over the ADSp and General terms and conditions of logistics services providers. 1. General scope of service/application Geographical area of validity (Europe) For international, cross-border transports Consignments weighing more than 2,500 kg (gross weight) or larger than 2.5 loading metres or 12.5 m 3, and weighing less than 19,400 kg (gross weight ) or smaller than 11 loading metres or 55 m 3 Door-to-door service (free to ramp/made available on the premises for removal) Service partly provided by the international DB Schenker network The DB Schenker Scheduler can be used as a guide to the transit time for consignments ( Trucks crewed by one driver as standard Standard vehicle type: Euro Trailer with tarpaulin (13.6 m) Maximum capacity of vehicle: 33 pallets (basic dimensions: L x H x W 120x80x240 cm) and 24 t. Standing time of up to 30 minutes included as standard; longer standing times are charged as follows: EUR 25 for every 30 minutes, charged by the half-hour; a flat rate of EUR 350 is charged for standing times of between 6 and 12 hours. One lashing strap per reserved loading metre Changes from the general scope of services subject to request Country-specific requirements and regulations relating to vehicles and personnel are complied with Unless explicitly agreed otherwise, DB Schenker reserves the right to reloading or coloading of consignments Standard transit times (from Monday to Friday) begin at the date and time of loading The transit times are not guaranteed and do not entitle the customer to a refund. The customer will be informed if changes are expected to the reserved transit time. 3

4 2. Options offered in connection with the product by prior individual agreemen t Customs clearance Acceptance of hazardous materials Transport insurance 3. General prerequisites The following general prerequisites must be fulfilled to enable provision of the service offered: Bookings must be made by 3:00 pm no later than two business days (Mon. - Fri.) prior to the planned loading Transit times are subject to individual agreement Secure packaging for transport Loading and unloading must be possible during opening hours and shall not be limited by time windows Opening hours must be between 6:00 am and 6:00 pm Mondays to Fridays Vehicle loaded and unloaded from behind via a ramp Equipment for loading/unloading (e.g. forklift, electric pallet trucks, etc.) provided by the shipper or recipient Loading and unloading is the responsibility of the shipper or recipient Clear identification of the option(s) desired on the medium used for transmitting the transport details (shipping order, remote data transmission, registration for collection, etc.) Delivery notes must be attached to the goods and are not transported separately Operational handling of the transport is the responsibility of DB Schenker Consignments of goods to the value of more than EUR 100,000 require advance notification to be received by us at least 72 hours prior to the planned loading time 4. Delivery terms The following delivery terms are permissible: EXW, CPT, DAT, DAP and DDP. Notification by the customer that the order is to be fulfilled in accordance with the Incoterms shall not affect the contractual relationship between the customer and Schenker. 4

5 5. Dimensions and weights Volume and minimum weights shall be individually agreed. This applies to the following weights and dimensions: Consignments with a gross weight of between 2,500 and 19,400 kg and a maximum dimension of 11 loading metres or 55 m 3. Packages shall not exceed 6 m in length and 2.40 m in width and height. 6. Exclusions Exclusions pursuant to the German Freight Forwarders' Standard Terms and Conditions (ADSp) and the General terms and conditions of logistics services providers Removal goods Temperature-controlled goods Live animals, loose plants, highly perishable goods Tobacco and alcohol Objects, weapons and munitions subject to the German War Weapons Control Act (Kriegswaffenkontrollgesetz) Radioactive goods Shipments that have to be unloaded from the side or using a crane Packages weighing more than 30 kg and which cannot be accessed or lifted by industrial trucks Cash-on-delivery consignments Neutrality orders Orders with dispatch notes Carriage of hazardous materials Defined exclusion areas (DB Schenker Scheduler at Seaport shipments Increases in transit time that occur due to circumstances that DB Schenker was unable to prevent, despite exercising the utmost care Provision and exchange of pallets or other load carriers Services may be restricted in the following cases: Loading/unloading on islands or in enclaves City centres with restricted access Road conditions unsuitable for a 40-tonne truck Delays crossing borders Incomplete consignment details Abnormal ferry or train availability Abnormal weather conditions during transport Force majeure 5
