Taub, Acting Chairman; Nanci E. Langley, Vice Chairman; Mark Acton; and Tony Hammond Rate Adjustment Due to Extraordinary or Exceptional Circumstances ORDER ON REMOVAL OF THE EXIGENT SURCHARGE AND RELATED CHANGES TO THE MAIL CLASSIFICATION SCHEDULE (Issued March 29, 2016) I. INTRODUCTION On February 25, 2016, the Postal Service filed notice of its intention to remove the exigent surcharge from existing market dominant rates effective Sunday, April 10, The Notice includes, as A, revisions to the Mail Classification Schedule (MCS), which the Postal Service represents were approved by the Commission in Docket No. R and reflect removal of the exigent surcharge. Notice at 4. The Notice also presents other data and information, including the Postal Service s reasons for selecting April 10, 2016 as the surcharge removal date. Id. at (Notice). 1 Notice of the United States Postal Service of Removal of the Exigent Surcharge, February 25,

2 - 2 - The Commission invited public comment, no later than March 16, 2016, on the consistency of the prices and product descriptions attached to the Notice with those in the attachment to Order No. 2472, 2 and other relevant issues. 3 Having considered the Notice, the accompanying set of rates and product descriptions in A to the Notice, relevant Commission orders in this docket and Docket No. R2015-4, and the comments received in response to Order No. 3103, the Commission approves the Postal Service's planned removal of the exigent surcharge on April 10, 2016, and the revisions to the MCS set out in the to this Order. 4 II. BACKGROUND Procedural status. Approval of the Postal Service's rates and product descriptions reflecting removal of the exigent surcharge is the culmination of several Commission orders spanning nearly 6 years and several Commission dockets. 5 In brief, in, the Postal Service requested and the Commission approved an exigent rate increase to offset the loss associated with the Great Recession of The Commission approved the increase in the form of a temporary surcharge that would be removed once the loss associated with the Great 2 See Docket No. R2015-4, Order on Revised Price Adjustments for Standard Mail, Periodicals, and Package Services Products and Related Mail Classification Changes, May 7, 2015 (Order No. 2472). 3 Notice and Order on Removal of Exigent Surcharge, February 26, 2016, at 2-3 (Order No. 3103). In a previous order, the Commission noted that interested persons who had concerns about the date of the surcharge removal could petition the Commission to alter the surcharge removal date. See Order on Exigent Surcharge Removal, January 12, 2015, at 7 (Order No. 2319). The Commission did not receive any petitions on this topic. 4 The rates and product descriptions in the to this Order reproduce the rates and product descriptions in A of the Notice. 5 See, e.g., Docket No. R2010-4, Order No. 547, Order Denying Request for Exigent Rate Adjustments, September 30, 2010; Docket No. R2010-4R, Order No. 864, Order Resolving Issues on Remand, September 20, 2011; Order Granting Exigent Price Increase, December 24, 2013 (Order No. 1926); Order No. 2319; R, Order No. 2623, Order Resolving Issues on Remand, July 29, Docket No. R2010-4R, Renewed Exigent Request of the United States Postal Service in Response to Commission Order No. 1059, September 26, 2013 ; Order No at 193.

3 - 3 - Recession was recovered. Order No at 1-3, 193. The Commission also required related reporting requirements tracking recovery of the loss and the submission of a plan for removing the exigent surcharge. 7 While the exigent surcharge was in effect, the Postal Service filed and the Commission approved a request for inflation-based rate adjustments for market dominant domestic and international products and services, along with numerous mail classification changes and temporary mailing promotions. 8 The Postal Service attached two sets of rates to its notice of rate adjustment in Docket No. R (with and without the surcharge), reflecting the expectation that full recovery of the Commission determined exigent loss would occur at some point following Commission action in Docket No. R III. COMMENTS The Public Representative filed comments in response to Order No No other comments were received. The Public Representative's comparison of the sets of rates in the Notice, A and in the to Order No leads him to conclude that in almost every instance, the proposed rates were properly derived. PR Comments at 1-2. He states that he did not directly verify the rates associated with 7 Id. See also Order No Docket No. R2015-4, United States Postal Service Notice of Market-Dominant Price Adjustment, January 15, 2015 (Docket No. R Notice). See also Docket No. R2015-4, Order No. 2365, Order on Price Adjustments for First-Class Mail Products and Related Mail Classification Changes, February 24, 2015; Docket No. R2015-4, Order No. 2388, Order on Price Adjustments for Special Services Products and Related Mail Classification Changes, March 10, 2015; Docket No. R2015-4, Order No. 2426, Order Amending Orders No and 2388, April 7, 2015; Docket No. R2015-4, Order No. 2461, Order on First-Class Mail Promotions and Related Mail Classification Changes, April 30, 2015; Order No See Docket No. R Notice. The Postal Service revised its proposed MCS changes several times. See, e.g., Docket No. R2015-4, Notice of Revisions to United States Postal Service Notice of Market-Dominant Price Adjustment, A Errata, February 4, 2015; Docket No. R2015-4, Notice of Revisions to United States Postal Service Notice of Market-Dominant Price Adjustment, A and D Errata, February 6, Public Representative Comments Concerning Removal of the Exigent Surcharge, March 16, 2016 (PR Comments).

4 - 4 - several rate structure changes related to the Flats Sequencing System (FSS), Carrier Route, and 5-Digit categories, but concludes that the surcharges appear to be "properly removed." Id. at 2. He further states that the removal of the surcharges applied to the postcards category of First-Class Mail, Outbound Single-Piece First-Class Mail International could not be confirmed and urges the Commission to independently review the proposed rates for this service. Id. Apart from this, he concludes that the Commission should allow the rates to take effect as planned. Id. IV. COMMISSION ANALYSIS The Commission has reviewed the rates approved in Docket No. R and the rates provided in A to the Notice, and finds that the rates contained in A to the Notice properly remove the exigent surcharge and are consistent with the rates approved in Docket No. R As part of that review, the Commission has confirmed, with respect to the Public Representative's concern about Outbound Single-Piece First-Class Mail International postcard rates, that the prices in A of the Notice reflect those approved by the Commission in Docket No. R This means that the surcharge has been accurately removed from the Outbound Single- Piece First-Class Mail International postcard rates. The Commission has also reviewed and confirmed that the exigent surcharge has been properly removed from the FSS, Carrier Route, and 5-Digit categories of Periodicals and Standard Mail. The exigent surcharge has also been properly removed from the FSS, Carrier Route, and Basic categories of Package Services. Consequently, the Commission approves the Postal Service's planned removal of the exigent surcharge, effective April 10, 2016, and the related revisions to the MCS identified in A to the Notice and reproduced in the to this Order.
