Dumhart, Community Development Director Consideration of Conditional Use Permit (CUP) 366 to Allow a General Warehouse and Distribution Land Use with Ancillary Office Space (Prompt Apparel/Prompt Warehousing Inc.) at rd Street, La Palma RECOMMENDED ACTION: It is recommended that the Planning Commission take the following action: a) Open Public Hearing b) Receive Staff Report c) Receive Public Input d) Close Public Hearing e) Planning Commission Comments and Questions f) Adopt a Resolution Approving Conditional Use Permit (CUP) 366 to allow a general warehouse and distribution land use with ancillary office space (Prompt Apparel/Prompt Warehousing Inc.) to occupy approximately 170,692 square feet of an existing industrial building located at rd Street, La Palma, CA (APNs /31/32). SUMMARY: The applicant, Prompt Apparel/Prompt Warehousing Inc., proposes to operate a warehouse and distribution facility which would occupy 170,692 square feet of area within the vacant portion of the existing 294,535 square foot building located at rd Street (Attachment 2). The building is split and an existing tenant, Kellogg Snacks at rd Street, operates out of the other 123,843 square foot portion of the building. Pursuant to the La Palma General Plan this building has an Industrial Land Use designation. Pursuant to the TABLE II-5: Allowable Uses for Non-residential Zoning Districts in the City s Zoning Code, General Warehouse and Wholesaling and Distribution Center land uses requires a Conditional Use Permit in the Industrial Zone. 2 La Palma City Code (LPCC) Section establishes the Planning Commission as the authority for reviewing and making decisions for Conditional Use Permit (CUP) applications. The purpose for reviewing conditional use permit applications, is to allow the establishment of land uses that have been deemed to have special impact, uniqueness, or effect on the properties or neighborhood surrounding the subject site. The CUP application process allows for the review of the location and potential impacts on the surrounding properties and community in order to ensure that the proposed use maintains the integrity of that zone district. BACKGROUND: In 1996 the La Palma City Council adopted Ordinance No that amended the City s Zoning Code to require a Conditional Use Permit (CUP) within the Industrial Zone for general warehouse and wholesaling and distribution centers. The intent of the CUP requirement was to review projects for potential traffic, access, noise and other problems that could result from the warehouse and/or distribution purposes of properties within the Industrial Zone. The 170,692 space at rd Street was previously occupied as Allstate Floral & Crafts, Inc. which operated under Conditional Use Permit 312. The application is a request by Prompt Apparel/Prompt Warehousing Inc. to operate another warehouse and distribution facility out of the same space. The primary use of this project would involve warehousing large orders of goods from chains such as Burlington Coat Factory, Sears, and Ross. Prompt Apparel/Prompt Warehousing Inc. provides its customers a secure and efficient way of receiving their goods from overseas, stores their goods safely, repackage, relabel and then ship the goods in large and small quantities to the retailer s locations thorough the nation. ANALYSIS: Adjacent Uses: North: City of Cerritos South: Industrial Properties East: Industrial Properties West: Coyote Creek Flood Control Channel Prompt 170,692 SQ FT rd Street Floor Plan: The vast majority of rd Street is an open warehouse floor but there is existing office space. At the north end of the building that fronts 183 rd Street there are two floors of office space that are approximately 7,500 square feet each. The total office space is 15,000 Page 2 of 8

3 square feet. There are no plans to expand this office space under the CUP. The warehouse floor area where the goods will be stored, repackaged and relabeled for shipping to retailers will be improved with high-piled storage racks to maximize the space. Parking: The subject property contains a total of 352 parking spaces. City Code requires an industrial building of 294,535 square foot to have 297 parking spaces. The building is code compliant with respect to the number of parking spaces in that is has a parking surplus of 55 spaces. As mentioned above the building is divided with Kellogg Snacks on the west side and Prompt Apparel/Prompt Warehousing Inc., proposing to occupy the east side. Each tenant has their own access driveway and parking lot that are independent from each other. Prompt Apparel/Prompt Warehousing Inc. s parking lot has a total of 96 parking spaces. Prompt Apparel/Prompt Warehousing Inc. has indicted that during their peak business season their business will have a maximum staff of thirty employees working on the floor area of the warehouse, and four employees working in the office. The 96 parking spaces available to Prompt Apparel/Prompt Warehousing Inc. in their parking lot is more than adequate to address the 34 employees during the peak business season and any visitors to the business. Additionally, during the peak business season Prompt Apparel/Prompt Warehousing Inc. has stated that a maximum of thirty trucks per day will arrive. The warehouse building has two separate 5-double truck loading door bays that can accommodate all truck traffic. Truck routes through the City have been designated on two arterial highways: Orangethorpe Avenue and Valley View Street. Prompt Apparel/Prompt Warehousing Inc. is off of 183 rd Street which is accessed via Valley View Street. The General Plan limits trucks to these two arterials when traveling through the City as they access the freeway or adjacent cities, to maintain acceptable levels of service throughout the City, as well as limit the damage and wear to the street surface and infrastructure. General Operations: Prompt Apparel/Prompt Warehousing Inc. will operate one work shift per day out of this location. During peak business season that shift would be 34 people, 30 on the warehouse floor and 4 in the Prompt Apparel/Prompt Warehousing Inc. offices. General Plan Consistency: The City of La Palma wishes to protect and preserve the quality of the residential areas of the City, as well as the quality of life throughout the City, through effective land use and planning. Prompt Apparel/Prompt Warehousing Inc. s proposed warehouse and distribution land use with ancillary office is consistent with the following goals and policies of the General Plan. POLICY LU 2.4: Promote businesses that serve the community well. Prompt Apparel/Prompt Warehousing Inc. is a family owned company that began in Brooklyn, New York and serves mainly family owned companies such as Sears and Ross. Those retailers offer goods at many local retailers that service the community. Additionally, Prompt Apparel/Prompt Warehousing Inc. is anticipated to, at peak season, employee 34 people at their La Palma location which is an increase from the 8 employees that the previous tenant, Allstate Floral & Crafts, Inc. employed. GOAL LU 4: Continue to encourage and facilitate a mix and diversity of land uses that meet the economic, environmental, educational, and social needs of the City while remaining sensitive to La Palma s small town character. 4 Prompt Apparel/Prompt Warehousing Inc. s proposed warehouse and distribution land use with ancillary office adds to the diversity of land uses within the City and ensures that what few industrial buildings the City has remain fully leased and conditioned to ensure sensitivity to La Palma s small town character. POLICY LU 4.5: Promote new land uses that contribute to economic development so long as they do not impinge upon residential neighborhoods and our quality of life. Prompt Apparel/Prompt Warehousing Inc. CUP request will not impinge upon residential neighborhoods or La Palma s quality of life given its location in the Industrial Zone. Businesses on 183 rd Street accesses from Valley View Street which is identified in the La Palma General Plan as a major arterial and a truck route and can accommodate the product deliveries. CONDITIONS OF APPROVAL: Seventeen (17) Conditions of Approval are contained as Exhibit A to approving Resolution included as Attachment 1 to this report. Conditions of Approval are broken down into two categories and they are General Conditions (1-8) and Business Operational Conditions (9-17). The following analysis discusses highlights some of the specific Conditions in each category that that are intended to protect the public health, safety, and general welfare. General Conditions No s 1 through 8: Condition 3 has been added to ensure Planning Commission can revoke or modify the Conditional Use Permit at any time. Condition No. 3 reads as follows: Condition of Approval 3: In compliance with La Palma Zoning Code Article IV, Division 5 (Revocation and Modification), this Conditional Use Permit may be revoked or modified at any time by a vote of the Planning Commission, if any one of the following findings of fact can be made: a. The use for which the approval was granted has been exercised so as to be detrimental to the public health or safety, and/or to constitute a nuisance. b. The approval of Conditional Use Permit 366 was obtained by fraud. c. The use for which such approval is granted is not being exercised within the time specified. d. The use for which approval was granted has ceased to exist or has been suspended for at least one year. e. The permit as granted is being or recently has been exercised contrary to the terms and conditions of approval or in violation of a statute, ordinance, law, or regulation. Condition No. 7 has been added because the City of La Palma is the water provider for all industrial properties within the City of La Palma. It is important that City water personnel have access to water meters, valves, and other infrastructure 24 hours a day 7 days a week to perform repairs, maintenance, reads, diagnostics, etc. Condition No. 7 reaffirms that the building at Page 4 of 8

5 rd Street will be available to City of La Palma water services staff even when both tenants have lockable gates to their respective portions of the property. Condition No. 7 reads as follows: Condition of Approval 7: City of La Palma water personnel shall have unrestricted access to water infrastructure at the subject property rd Street, La Palma, CA (APNs /31/32), pursuant to water pipe line easements granted to the City that were recorded on April 6, 1973, and December 18, 1974, against the subject property. Access to all gates shall be provided to the City s Water Supervisor or designee in the form of physical key, input code, or any other method so as to ensure unrestricted access 24 hours a day/seven days a week. Business Operational Conditions No s 9 through 17: Condition No. 10 has been added to address any parking issues that could arise in the future should Prompt Apparel/Prompt Warehousing Inc. experience employment beyond their anticipated peak of 34 employees. Given the 96 parking spaces available to Prompt Apparel/Prompt Warehousing Inc. there would not be any foreseeable impacts until employments exceeds 80 persons. If that should occur then Prompt Apparel/Prompt Warehousing Inc. would be tasked with proposing a parking management plan to the City for review. Typically a parking management plan would incorporate van pools and ride sharing and/or other multi-modal transportation methods to and from the business. Condition No. 10 reads as follows: Condition of Approval No. 10: If at any time the total number of employees working on the floor and/or in the office exceed 80 persons then the current tenant of rd Street shall be responsible for proposing a parking management plan to the Director of Community Development for review and approval. Condition No. 11 has been added to ensure that all business operations occur within the 170,692 square feet of the building and not outside in the parking lot beyond the loading dock areas. Outdoor noise, cluster, debris, trash and storage can detract from the quality of the area and are code violations. It is important to maintain properties and Condition No. 11 reads as follows: Condition of Approval No. 11: All activities shall be conducted inside the existing enclosed industrial building located at rd Street. No pallets shall be stored in the parking, loading, or landscaping areas. No products, shipping materials, or equipment may be stored in the parking, loading, or landscaping areas for longer than 20 minutes. All product and material storage shall occur within the building. Exterior storage is specifically prohibited. Conditions 15 through 17 are applied to address comments received by the Orange County Fire Authority to ensure compliance with fire criteria and read as follows: Condition of Approval 15: The applicant shall obtain approval for any high pile storage from Orange County Fire Authority and the Building and Safety Division of the Community Development Department prior to occupancy. Condition of Approval 16 Prior to the issuance of a Building Permit, the Applicant shall submit architectural plans for the review and approval of the Fire Chief if required per the "Orange County Fire Authority Plan Submittal Criteria Form." Please contact the OCFA at (714) for a copy of the Site/Architectural Notes to be placed on the plans prior to submittal. Page 5 of 8

6 Condition of Approval 17: All structures, access, and equipment shall be in compliance with the Orange County Fire Authority regulations and verification of compliance must be submitted to the Building & Safety Division. ENVIRONMENTAL REVIEW: This project has been reviewed in accordance with the California Environmental Quality Act (CEQA). The proposed project is Categorically Exempt from the provisions of CEQA pursuant to Section 15301, Class 1 Existing Facilities, given that the project consists of minor interior improvements to an industrial building suite involving no expansion in the overall floor area of the building. NOTIFICATION: Pursuant to City Code Chapter 44 Administrative Procedures, notice of this Public Hearing was posted at City Hall, the Public Library, and Community Center. Pursuant to Government Code Sections and , a Public Hearing Notice was published at least 10 days before the Hearing in the March 4, 2015, edition of the News Enterprise. Notices were also mailed to all owners of real property located within 300 feet of the subject property as obtained from the latest Orange County Assessment Rolls. FINDINGS FOR CUP: Findings for Approval of Conditional Use Permit: This Project requires approval of a Conditional Use Permit pursuant to Section Allowable Uses of the La Palma Municipal Code, in which Section Findings for a Conditional Use Permit in the La Palma Municipal Code includes all the necessary findings. Based on the available information, the following findings can be made: 1. Finding: The proposed use is conditionally allowed within the subject zoning district, would not impair the integrity and character of the district, and complies with all applicable provisions of this Development Code. Facts in Support of Finding: A general warehouse and distribution land use with ancillary office space (Prompt Apparel/Prompt Warehousing Inc.) is conditionally allowed within the subject-industrial zoning district. The business operations of one shift a day, with maximum of 34 employees and 30 truck deliveries, as conditioned, would not impair the integrity and character of the district, and comply with all applicable provisions of this Development Code. Truck trips to the businesses on 183 rd Street occur from Valley View Street which is identified by the La Palma General Plan as one of the two truck routes in the City. 2. Finding: The proposed uses are consistent with the goals, policies, general land uses, and programs of the General Plan, and any applicable Specific Plan and comply with all City, State, and federal laws and regulations. Facts in Support of Finding: The Industrial category accommodates low-impact, jobsintensive industrial uses that involve manufacturing, assembly, distribution, research and development, telecommunications, science laboratories, and utility buildings/facilities. 7 may include ancillary office and commercial or wholesale sales activities directly associated with the business. Prompt Apparel/Prompt Warehousing Inc. s CUP request to operate a general warehouse and distribution land use with ancillary office space is fully consistent with the underlying Industrial land use of the property as identified in the La Palma General Plan. 3. Finding: The approval of the Conditional Use Permit for the proposed use complies with the requirements of the California Environmental Quality Act (CEQA). Facts in Support of Finding: The proposed project complies with CEQA in that it is Categorically Exempt from the provisions of CEQA pursuant to Section 15301, Class 1 Existing Facilities. It is exempt given that the project consists of minor interior improvements to an existing industrial building suite involving no expansion in the overall floor area of the building. 4. Finding: The site is suitable for the type and intensity of uses that are proposed. Facts in Support of Finding: The building was built from the ground up in 1980 as a 294,535 square foot industrial building to house businesses with operations like Prompt Apparel/Prompt Warehousing Inc. The 170,692 square foot portion that Prompt Apparel/Prompt Warehousing Inc. will occupy has 15,000 square feet of office space which is more than adequate to accommodate their anticipated 34 employees during peak periods. The two 5-double truck door loading bays are sufficient for the truck trips to and from the building. 5. Finding: The proposed uses will have no adverse effect on abutting or adjacent properties and is compatible with those properties. Facts in Support of Finding: There is no connectivity between Prompt Apparel/Prompt Warehousing Inc. s portion of the building and parking lot and Kellogg Snacks portion of the building and parking lot. Because of the division of the property into two unique parking, office and warehouse areas there will be no adverse effects of Prompt Apparel/Prompt Warehousing Inc. upon Kellogg Snacks. Additionally, the site is separated from industrial buildings to the south on Fresca Drive by rail spurs and Fullerton Creek which act as natural buffers between the industrial uses. 6. Finding: The proposed use will not be adverse to the public health, safety, or general welfare. Facts in Support of Finding: As conditioned, all business activities will occur within the building. Conflict of Interest (500 Feet): None. FISCAL IMPACT: None. Page 7 of 8

8 ALTERNATIVES: The Planning Commission has the following alternatives: 1. Adopt the Resolution approving Conditional Use Permit Adopt a Resolution approving Conditional Use Permit 366 subject to modifications. 3. Continue the item and refer to staff for additional information. 4. Deny Conditional Use Permit 366 and make findings for denial. CONCLUSION: Staff has reviewed the Prompt Apparel/Prompt Warehousing Inc. proposal as submitted and has determined that their proposed general warehouse and distribution land use with ancillary office space in 170,692 square feet of an existing industrial building located at rd Street, La Palma, CA 90623, would comply with all applicable provisions of the La Palma Zoning Code. The subject property was previously occupied by a warehouse and distribution land use with ancillary office that operated under CUP. The proposed warehouse and distribution land use with ancillary office is not anticipated to generate traffic or parking above what the site can accommodate. Therefore, the proposed CUP request will not result in any significant impacts on surrounding properties. With the inclusion of the attached Conditions of Approval, the proposed use would be compatible with the surrounding industrial land uses within the immediate vicinity of 183rds Street. Staff is recommending approval of the CUP request by Prompt Apparel/Prompt Warehousing Inc. to operate their proposed warehouse and distribution land use with ancillary office from rd Street, as conditioned. 9 RESOLUTION NO. PC A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LA PALMA, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT 366 TO PERMIT PROMPT WAREHOUSE, INC. TO BE OPERATED AT RD STREET (APN ; 31; AND 32). WHEREAS, an application has been made by Prompt Warehouse, Inc. (hereinafter, the Applicant ), for a Conditional Use Permit to operate a warehouse and distribution use located at rd Street (hereinafter, the Project ) in the General Industrial (GI) Zone; and, WHEREAS, Pursuant to Table II-5 of the La Palma City Code, Allowable Uses and Planning Permit Requirements for Nonresidential Zoning Districts, a Conditional Use Permit is required for the proposed warehouse and distribution use in the General Industrial (GI) Zoning District; and, WHEREAS, the City of La Palma wishes to protect and preserve the quality of the commercial, industrial and mixed use business areas of the City, as well as the quality of life throughout the City, through effective land use and planning; and, WHEREAS, Conditions of Approval have been prepared attached hereto as Exhibit A and incorporated herein by this reference, to be applied to Conditional Use Permit to ensure harmony with the surrounding land uses; and, WHEREAS, the project is Categorically Exempt from the provisions of CEQA pursuant to Section 15301, Class 1 Existing Facilities, given that the project consists of minor interior alterations to an existing commercial building involving no expansion in the overall floor area of the building; and, WHEREAS, notice of the Public Hearing concerning the proposed Project was duly published in a local newspaper at least ten (10) days prior to the hearing; posted at City Hall, Central Park, La Palma Library and on site at the Project; and, WHEREAS, on March 17, 2015, the Planning Commission of the City of La Palma conducted a duly noticed Public Hearing on Conditional Use Permit 366 and considered testimony and evidence presented by the Applicant, City staff, and other interested parties, at the Public Hearing held with respect thereto. NOW, THEREFORE, the City of La Palma Planning Commission hereby resolves as follows: SECTION 1. The City of La Palma Planning Commission hereby makes the following findings for the Conditional Use Permit 366 in accordance with Section Findings of the La Palma Municipal Code for the project. 1. The proposed use is conditionally allowed within the subject-zoning district, would not impair the integrity and character of the district, and complies with all applicable provisions of this Development Code. The proposed use is consistent with the goals, policies, general land uses, and programs of the General Plan, and any applicable Specific Plan and is in compliance with all City, State, and Federal laws and regulations. 3. The site is suitable for the type and intensity of use or development that is proposed. 5. The proposed project will have no adverse effect on abutting or adjacent properties and is compatible with those properties. 6. The proposed use will not be adverse to the public health, safety, or general welfare. SECTION 2. Based on the foregoing, the City of La Palma Planning Commission hereby approves Conditional Use Permit 366, subject to the Conditions of Approval, which are attached hereto as Exhibit A to this Resolution and incorporated herein by this reference. SECTION 3. This project approval shall become effective following the expiration of a fifteen (15) day appeal period without filing of an appeal application. The appeal period shall expire April 1, 2015, at 5:30 p.m. The expiration of this approval is subject to Section of the La Palma City Code. 12 EXHIBIT A CONDITIONS OF APPROVAL FOR CONDITIONAL USE PERMIT CUP 366 Prompt Warehouse, Inc., Inc rd Street, La Palma, CA GENERAL: 1. This permit shall be for the benefit of the Applicant (Prompt Warehouse, Inc.) in whose name the permit was issued, for the specific approved location ( rd Street). Written notice must be provided to the City if the Applicants cease operation of the Warehouse and Distribution Use. The Conditional Use Permit issued by the Planning Commission for the Warehouse and Distribution Use is transferable if the new owner(s) agrees to these Conditions of Approval. 2. The Applicants shall obtain a City Business License and maintain a valid Business License at all times. 3. In compliance with La Palma Zoning Code Article IV, Division 5 (Revocation and Modification), this Conditional Use Permit may be revoked or modified at any time by a vote of the Planning Commission, if any one of the following findings of fact can be made: a. The use for which the approval was granted has been exercised so as to be detrimental to the public health or safety, and/or to constitute a nuisance. b. The approval of Conditional Use Permit 366 was obtained by fraud. c. The use for which such approval is granted is not being exercised within the time specified. d. The use for which approval was granted has ceased to exist or has been suspended for at least one year. e. The permit as granted is being or recently has been exercised contrary to the terms and conditions of approval or in violation of a statute, ordinance, law, or regulation. 4. Prompt Warehouse, Inc. shall defend, indemnify, and hold harmless the City, its agents, officers, and employees from any claim, action, or proceeding against the City, its agents, officers, or employees to attack, set aside, void, or annul the approval granted by this Conditional Use Permit, which action is brought within the appropriate statute of limitations. Prompt Warehouse, Inc. shall further defend, indemnify, and hold harmless the City, its agents, officers, and employees from any and all claims, actions, or proceedings against the City, its agents, officers, or employees arising out of or resulting from negligence of the Prompt Warehouse, Inc. or Prompt Warehouse, Inc. s agents, employees or contracts. 5. An agreement to the Conditions of Approval shall be executed by the Prompt Warehouse, Inc. within fifteen (15) days of the City of La Palma Planning Commission s approval of this Conditional Use Permit. The City of La Palma shall be designated as the point of sale for sales and use tax purposes for any sales or transactions that originate or occur at the subject site, in accordance with applicable State Laws. 7. City of La Palma water personnel shall have unrestricted access to water infrastructure at on the subject property rd Street, La Palma, CA (APNs /31/32), pursuant to water pipe line easements granted to the City that were recorded on April 6, 1973 and December 18, 1974, against the subject property. Access to all gates shall be provided to the City s Water Supervisor or designee in the form of physical key, input code, or any other method so as to ensure unrestricted access 24 hours a day/seven days a week. 8. If at the time of application for building permit there is a project job account balance due to the City for recovery of planning review and entitlement fees, building permits will not be issued until the balance is paid in full. BUSINESS OPERATIONS: 9. The use shall be operated in full conformance with the description and requirements of the Conditional Use Permit on file with the City of La Palma. Any variations from, or changes in, the approved use must first be reviewed and approved by the Planning Commission as a Conditional Use Permit Amendment prior to commencement of the change. 10. If at any time the total number of employees working on the floor and/or in the office exceed 80 persons then the current tenant of rd Street shall be responsible for proposing a parking management plan to the Director of Community Development for review and approval. 11. All activities shall be conducted inside the existing enclosed industrial building located at rd Street. No pallets shall be stored in the parking, loading, or landscaping areas. No products, shipping materials, or equipment may be stored in the parking, loading, or landscaping areas for longer than 20 minutes. All product and material storage shall occur within the building.
