BACKGROUND Amendments to the Garbage, Recyclables and Yard Waste Collection Bylaw, and the associated enforcement Bylaws, are made to strive for increased diversion in the City of Abbotsford. Proposed items in this amendment (Appendix A) address Industrial, Commercial and Institutional (ICI) recycling, and the collection of a fee for properties that do not provide compliant recycling programs. DISCUSSION In spring 2012, the City consulted with the ICI sector regarding the proposed mandatory recycling requirement. Results of this consultation can be found in Report No. ENG Based on these consultation sessions and feedback from the Abbotsford Chamber of Commerce, proposed Bylaw amendments are drafted for three readings at the next Regular Council meeting. The majority of ICI respondents are in support of making recycling mandatory under the Bylaw. It was agreed that all businesses need to make an effort to become more sustainable. Mandatory recycling would level the playing field for all businesses, and would increase diversion in the City of Abbotsford. If the Bylaw amendment is approved by Council, in order to help businesses transition to the new recycling program, the City and Abbotsford Mission Recycling Depot (AMRD) staff will be available to perform site visits and make suggestions to assist businesses in implementing the new program. Additionally, signage and recycling guides were developed and are also available.

2 Report No. ENG Page 2 of 2 The proposed bylaw amendment is in Appendix A. Section 10(a) contains information on the multi-unit residential complex required recycling program, and has only been reworded and re-arranged from the current Bylaw. Section 1 O(b) contains the additional information on the ICI required recycling program. FINANCIAL PLAN IMPLICATION Municipal ticket and enforcement fees for ICI recycling are consistent with multi-family recycling program fees, as appear in the current Bylaw shown in Appendix A. Discounted and late penalties are consistent with other City of Abbotsford Bylaws. AMRD costs may increase due to increased tonnage from the ICI sector, which would impact the solid waste reserve and/or the residential solid waste utility fee. As noted in Report No. ENG , the residential sector is currently subsidizing the ICI sector with the actual amount of the subsidy dependent on commodity values, tonnages and types received. The tonnage and source of recyclables received at AMRD will be monitored annually to ensure the cost to the residential sector has not been unreasonably impacted. STRATEGIC DIRECTIONS Increasing recycling in the ICI sector supports several of the City's strategic directions and priority objectives including: conserving important natural areas; improving the health of our surface water, groundwater, and air shed; and reducing corporate and community greenhouse gas emissions. COMMUNICATION PLAN A communication plan for the consultation phase was completed as reported in Report No. ENG If the proposed amendments are approved, further communication will consist of a letter sent to all ICI properties advising of the effective date of the amendment and reiterating the requirements of the program, as well as placing a notice on City Page and on the City webpage. Supporting information will also be maintained on the City website. 3 ENG Appendix A GARBAGE, RECYCLABLES AND YARD WASTE COLLECTION BYLAW, 2010, AMENDMENT BYLAW NO.3 Bylaw No The Council of the City of Abbotsford, in open meeting assembled, ENACTS AS FOLLOWS: 1. CITATION Bylaw No may be cited as "Garbage, Recyclables and Yard Waste Collection Bylaw, 2010, Amendment Bylaw No.3". 2. AMENDMENTS Bylaw No , cited as "Garbage, Recyclables and Yard Waste Collection Bylaw, 2010", as amended, is further amended by: (a) deleting and replacing Section 10 (a) as follows: "10. REQUIRED RECYCLING PROGRAMS (a) Multi-Unit Residential Complex (i) (ii) (iii) Every owner of a Multi-Unit Residential Complex must implement a program for the regular collection of Commercial Container Recyclables from the residents of that property. Every owner of a Multi-Unit Residential Complex must arrange for delivery and deposit to a Recycling Depot by a person who is appropriately licensed to provide recycling services. Every owner of a Multi-Unit Residential Complex must adhere to the following requirements: A. a storage area for all Commercial Container Recyclables must be located alongside the regular containers used for garbage collection by the provider of that service, except where the commercial container recyclables can be collected in a location that is more convenient for the residents; B. every storage area for Commercial Container Recyclables must be of a sufficient size to accommodate at least 125 litres of Recyclables per dwelling unit, per week (approximately 0.45 m x 0.45 m x 0.6 m per unit); and

(b) Industrial, Commercial or Institutional Property (i) Every Owner or Occupier of a Commercial Container Recyclables Property, as the case may be, who provides for the regular collection of Garbage from the property, must implement a program for the regular collection of Commercial Container Recyclables generated on the property. (ii) Every Owner or Occupier of a Commercial Container Recyclables Property, as the case may be, who provides for the regular collection of Garbage from the property, must arrange for delivery and deposit to a Recycling Depot. (iii) Every owner or Occupier of a Commercial Container Recyclables Property, as the case may be, who provides for the regular collection of Garbage from the property, must adhere to the following requirements: A. a storage area for all collection containers for Commercial Container Recyclables must be provided on the property and located alongside the regular containers used for garbage collection by the provider of that service, except where the Commercial Container Recyclables can be collected in a location that is more convenient for the property users; B. the collection containers for Commercial Container Recyclables must be of a sufficient volume and number to handle all Commercial Container Recyclables generated on the property; and C. the collection of Commercial Container Recyclables and their delivery to a Recycling Depot must be carried out at least once every two weeks, or as needed."; and
