3 The terms and conditions applicable to and incorporated into an individual Order are determined based upon the Vought customer prime contract and the Program in support of which the Order is issued. Each Order will designate, within the body of the Order, the Program it supports and the applicable Block for that Program (Fiscal Year (FY), Block of Shipsets, or other descriptive designation), if any. Based on the Program and Block designation in the Order, and as further defined by the following criteria, the set of terms applicable to the Order are as set forth in the listing below: If the Seller is a foreign company (Non-U.S. Company), the applicable terms shall be those designated below as for international source of supply. If the Seller is a U.S. Company, the applicable terms shall be those designated as for domestic source of supply. When a determination has been made by Buyer that the items being purchased are Commercial Items within the meaning set forth in the Federal Acquisition Regulations (FAR) 2.101, the terms specified for the designated Program identified as for commercial items and components shall apply. NOTE: In the event that no Program is designated on an Order issued pursuant to the LTA, the Government Fixed Price Supply (No Designated Program set of terms shall be applicable to the Order.
