2 Construction Logistics and Cyclist Safety - CLOCS - Terms of Reference 1. PURPOSE April 2014 The purpose of this document is to set out the Terms of Reference for the governance of the Construction Logistics and Cyclist Safety CLOCS programme and its outputs. It covers roles and responsibilities within CLOCS including the working groups and management of the implementation, review and changes to the common Standard for Construction Logistics: Managing Work Related Road Risk (the WRRR Standard ) 2. BACKGROUND Between 2008 and 2012, 53 per cent of cyclist fatalities in London involved a heavy goods vehicle. A disproportionate number were construction vehicles. In 2012 Transport for London commissioned an independent review of the construction sector s transport activities with the aim of understanding the causes of collisions and how they may be prevented. The resulting Construction Logistics and Cyclist Safety' (CLOCS) report was published in February 2013 by Transport Research Laboratory. The report found that blind spots on construction vehicles could be larger than general haulage vehicles, that road safety was not considered in same way as health and safety on-site and that there was little understanding of the impact of construction activity on road safety. It also found that there was no common standard for the industry to work to in order to manage work related road safety. In response, the construction logistics industry has demonstrated its commitment to change and identified actions under three work streams to improve road safety. CLOCS brings the construction logistics industry together to take forward actions through a programme of work aiming to revolutionise the management of work related road risk and embed a road safety culture across the industry. CLOCS is steered by industry working groups.

3 3. ROLES 3.1 Sponsor Transport for London (TfL) is the Sponsor and funding body for the CLOCS programme for 2014/ /16. TfL provides resource, support and direction for the programme in order to ensure it achieves its objectives. TfL is responsible for final decisions in relation to the programme and its priorities. The ultimate goal is for an industry-owned model to be agreed and adopted for CLOCS post 2015/ Secretariat TfL and Aecom (on behalf of TfL) act as the secretariat and are responsible for the planning of meetings, sending invitations, issuing documents and all other activities that contribute to the effective operation of the working groups and other meetings. TfL and Aecom (on behalf of TfL) are responsible for overall CLOCS programme and project management. 3.3 CLOCS Working Groups Membership comprises representatives from a range of organisations across the construction logistics industry, trade associations and regulatory and enforcement bodies which are in a position to influence change to meet the objectives of the CLOCS programme The working groups: Provide the forum through which the construction logistics industry comes together to discuss issues relating to the management of work related road risk and how the industry can make improvements to road safety. Work to ensure that the outputs from each of the three CLOCS workstreams are appropriate for the construction logistics industry in order to achieve positive change and realise the CLOCS programme objectives. The groups represent the interests of those who will use the programme outputs and work to ensure that user needs are specified correctly.

4 Are responsible for the content, implementation, review and changes to the Standard for construction logistics: Managing work related road risk (the WRRR Standard) Role of members: Attend all meetings or send a representative if unavailable Contribute in a constructive way to working group discussions and provide advice and guidance on the direction of the CLOCS programme and development of CLOCS outputs Bring emerging issues to the group, and share information, knowledge, best practice, lessons learned and innovation Review relevant outputs from the CLOCS programme, such as research and guidance, and provide feedback and comments Participate in any sub-group meetings as agreed Keep their relevant organisations informed on the progress and output from the group Support the work of the CLOCS programme and positively position the CLOCS programme objectives, particularly to external parties Ensure consistent messages are communicated with regards to CLOCS and help support the implementation of recommendations made Influence industry to the extent that it may implement the objectives of CLOCS on its own accord Membership of the working groups is limited due to practicalities of enabling effective discussion and hosting large meetings. Other interested parties can become involved by registering their interest and receiving updates on the programme. They may approach or work with the most appropriate member organisations to put their views forward - for example, through contacting the secretariat, other client or operator organisations, represented trade associations, institutions or campaign groups.

5 Frequency of meetings The main CLOCS working groups will aim to meet approximately every 2 months. Sub groups may meet more regularly depending on the requirements to deliver the relevant outputs. 3.4 CLOCS Champions Organisations and / or individual construction projects actively implementing the requirements within the Standard for construction logistics: Managing work related road risk. CLOCS Champions may include: Client organisations and/ or projects implementing the WRRR Standard within its contracts. Where the "Client" is a partnership or membership organisation it shall also promote further uptake of the scheme amongst its members Fleet operators committed to adhering to the requirements within the standard across their operations. Organisations which by the nature of their business or purpose may not be able to actively implement the CLOCS standard, but which have committed to supporting the WRRR Standard and its purpose. CLOCS Champions are party to the Memorandum of Understanding with the CLOCS Sponsor - see Appendix. Organisations may be both CLOCS Champions and CLOCS working group members. 3.5 CLOCS Associates / Contacts Organisations which express an interest in the CLOCS programme, but who are not currently on a working group or acting as Champions of the WRRR Standard. These organisations: Receive information and updates on the progress of the CLOCS programme. Are given the opportunity to, and may actively participate in, sub-group meetings, consultation or other wider activity relating to development of CLOCS outputs where necessary.

6 Support the work of the CLOCS programme and are positive in their messaging and positioning of the CLOCS programme objectives, particularly to external parties. 4. REVIEW The Terms of Reference and Memorandum of Understanding will be reviewed no on an annual basis, unless requested and agreed by the CLOCS Working Group, for example due to the nature of changes to the programme.

8 Memorandum of Understanding Memorandum of understanding between the Construction Logistics and Cyclist Safety (CLOCS) Sponsor and organisations implementing the requirements of the Standard for construction logistics: Managing work related road risk (WRRR) CLOCS Champions Purpose The purpose of this memorandum of understanding (MoU) is to build engagement with and commitment to the CLOCS Standard for construction logistics: Managing Work Related Road Risk (WRRR) ( the WRRR Standard ). CLOCS aims to achieve a visionary change in the way the construction industry manages work related road risk. The CLOCS programme represents a united response to road safety across the industry and greater social responsibility that will save lives. Collectively these parties will uphold the requirements of the WRRR Standard. Parties to the agreement The CLOCS Sponsor is responsible for final decisions in relation to the programme and for agreeing priorities. It provides resource, support and direction for the programme in order to ensure it achieves its objectives The CLOCS Champion is responsible for actively implementing and ensuring compliance to the requirements within the Standard for construction logistics: Managing work related road risk Joint undertakings The CLOCS Sponsor and CLOCS Champions agree to work together to: Provide information to support the monitoring and evaluation of the implementation of the WRRR Standard and supplementary guidance. This may include submission of information, participation in meetings and other contributions to works in progress Inform the future development of the WRRR Standard and supplementary guidance through the CLOCS working groups. Develop messages to promote the objectives and aims of CLOCS across the industry at meetings, conferences, press and other internal and external media

9 Share new and existing research that supports and underpins the CLOCS WRRR Standard, or informs further development, including additions or where a change of direction is required The CLOCS Sponsor: Will provide to CLOCS Champions information on the progress of the CLOCS programme, and future trends and/or policy developments likely to impact on the business performance of the partners in the context of the CLOCS programme Will provide a forum (the CLOCS Working Group) to discuss the WRRR Standard, issues with the WRRR Standard and future development of the WRRR Standard Will consult with other members of the CLOCS Working Group before implementing changes to the WRRR Standard this may include direct dialogue with partners or with their respective trade associations Will make sure future policy developments add value to MoU signatories as long as access to the WRRR Standard is open to all, then the requirement to implement the WRRR Standard should be as far-reaching as possible, so that those organisations that have made the necessary commitments and investments see some benefit from it. The CLOCS Champion: Will inform the CLOCS secretariat and CLOCS Working Group that they are implementing the Standard and its requirements, and the scope of its implementation (i.e. within London, nationally or on a project by project basis) Will provide information to support the monitoring and evaluation of the implementation of the WRRR Standard and supplementary guidance. May submit their logo in support of the Standard for Construction Logistics: Managing work related road risk to be featured on the CLOCS website and within the WRRR Standard document. Be entitled to use CLOCS branding in promoting the use of the WRRR Standard, for example on site posters and hoardings, in line with the brand guidelines. Will promote and enforce the WRRR Standard across their supply chain, within sector groups, trade associations and other suitable communications channels. Will make the CLOCS working group aware of comments on and issues with the WRRR Standard and to share information about other initiatives that might complement or contradict the WRRR Standard.
