1 I 3.1. EVENTS. The use of Common Areas for events within the business park is allowed on a permit basis and with the conditions stated below. The use of parking lots and walkways for events is prohibited unless the event is within the requesting owners specific lot lines and is specifically approved in advance by the Board and noticed to the general membership and its permittee s. An Event is defined as any gathering within a portion of the common that is used predominantly for the purpose of said event and is excluded (perceived or otherwise) from use by all others during that specific time period. ABSOLUTELY NO WATER ACTIVITIES OR FISHING IS ALLOWED (a) The use is on a first come first serve basis. (b) Administrative Fee (c) City permit must be obtained if required by the City. (d) A request must be submitted to the management office in writing at least 10 days in advance of any event. (e) A refundable deposit is required based on size of the event and number of attendees. Deposit amount to be determined by the Association management. Deposit is to ensure Common Area is left in clean and intact condition per prior to the event. Deposit is refunded after inspection, but no later than 15 days from the date of the event. (f) Events with music or audio that is amplified are not allowed M F 8:00am 6:00pm or S/S 8:00am 1:00pm. The noise level, however, cannot be unreasonably intrusive. Intrusive noise levels will affect permit issuance for future events. (g) For safety purposes, use of open flame grills or other devises that contain a flame is permitted only under controlled environment and to be approved at the discretion of the Association management. (h) Event insurance must be obtained, at the requesting party s expense, naming the association, vendors providing service at the event, as well as the Association management company as additionally insured for the event. See Insurance requirements detailed below EVENT INSURANCE REQUIREMENT. To be recommended by association s insurance agent.

2 3.3. FEE SCHEDULE. The use of Common Area is free of charge for owners and resident businesses. Non Owners/Occupants are charged per the following. The fee is due and payable 48 hours in advance of the event. (a) $50 Permit fee for up to 2 hours of use and maximum of 10 people. (b) For every additional group of up to 5 persons there is an additional $25 fee. (c) Additional hours are billed at same rate per hour.

3 WASTE MANAGEMENT 3.1 WASTE MANAGEMENT. Trash bins throughout the business park are for disposal of regular and recyclable trash only. 3.2 TRASH SERVICES. Trash service is provided throughout the park based on average use. Below map indicates trash bins in enclosures as of 12/6/15.

4 3.3 Excess use predicated by unusually trash intensive uses may opt from the following options: (a) Pay for Extra pickups through the Association billing/account

5 (b) Propose viable location for Private Trash Enclosure, install per Architectural Committee approval, and manage Extra waste independently REGULAR TRASH WASTE is to be disposed of in the GREEN trash bin as depicted below Combo locks on trash enclosure gate to be put back in lock mode after each use. The combo lock program was implemented to address transients taking shelter inside enclosures, to reduce illegal dumping and rummaging, and to reducing cost. The combo code is communicated to all by the Association Trash bags not to be thrown over the enclosure doors. They often miss the appropriate bin or any bin at all, creating management nightmare and added expense. WHITE RECYCLABLE ONLY bins are designated as such and are typically ALL recyclable materials are to be disposed of in the Recyclable bins. As we are an mixed use commercial park, recyclable material should comprise the great majority of our trash. Below is a list of what is considered Recyclable: (a) PAPER: Newspapers, magazines, mixed paper (printer, color, all types accepted), telephone books, directories, magazines, bulk/junk mail, envelopes, catalogs, file folders, cardboard boxes (please flatten), soft bound books, hard bound books (inside only, no cover), paper board - cereal boxes, tissue boxes, shoe boxes, egg cartons, beverage boxes, dry food boxes, paper towels (must be clean and dry), frozen dinner boxes and

6 other frozen food boxes, empty paper towel and toilet tissue rolls, shredded paper (must bag before placing in bin) and pizza boxes (no food residue). (b) PLASTIC/METAL/GLASS: Plastic beverage containers - soda, water and juice. Aluminum cans, Tin cans - soup, tuna, vegetable juice and coffee All boxes to be broken down flat. Uncrushed boxes take time away from the day porter s day, which can be devoted to other more value-enhancing efforts; they fill up the space otherwise available, and increase the chance of non-pick up by the waste management company, hence lost opportunity and additional cost No florescent bulb disposal in any bins (Regular or Recycle). Tape or band bulbs together and lean them against the back wall for proper disposal. Broken lamps can release mercury to the air and water. This includes fluorescent tubes, compact fluorescent lamps, metal halide lamps, and sodium vapor lamps As a recommendation to contribute to the success of the Recycling program, place specific recycling receptacles throughout offices. Some offices have paper recycling bins at each desk, while others place these receptacles next to the copy machines. Place bins for recycling cans and plastic containers in kitchen and break areas for easy access. 3.4 HAZARDOUS/ILLEGAL DUMPING. Disposing of any of the following items is considered a violation to the office park waste management rules, an EPA violation and a violation of the local waste disposal company s rules. All violators are subject to fines by the association as well as by any other local or government authority DO NOT DISPOSE OF THE FOLLOWING ITEMS inside any enclosure, trash or recycling bin within the business park. (a) Paint/Plaster/Construction Materials

7 (b) (c) Hazardous chemicals or materials of any kind Furniture/Office Fixtures/Bulk or Heavy items (d) Light bulbs 3.5 In order to facilitate and streamline enforcement of Waste Management, following process is adopted: Ticket are issued to Owner via and back up documentation showing definite non compliance by Owner or its tenant.

The Owner may object to the assessment within 15 days of the date of assessment, upon receipt of which by the management company,

9 the management company may temporarily suspend the assessment and put the objection on the subsequent Board Meeting agenda for the Board s consideration. The Owner will need to attend to present objection to the Board. Board may rule on the objection at its discretion.

10 PARKING 4.1 PARKING SETUP: Brookhollow is mandated with a reciprocal parking easement which permits the Owners and Permittees of any Parcel within the Project to use, on a non-exclusive basis, any parking spaces located within the Project. Association does not assume any responsibility for parked vehicles. All vehicles are parked at owners' risk. Patrolling parked cars is not within the scope of the responsibility of the off hours security patrol. Assigned parking is prohibited as a general rule, however exceptions are allowed as approved by The Board upon application to the Architectural Committee. 4.2 PARKING ALLOCATION: City parking ordinances specify the minimum number of parking spaces required for each business per approved use. The City track number of parking required versus allocated through a parking matrix updated by the Association at the direction of the City. All Owners and respective Tenants shall occupy no more than the number of parking spaces allocated per approved use by the City and are expected to occupy parking spaces most closely adjacent to their respective buildings. 4.3 USE: No Owner, or respective Tenants/Customers shall obstruct any parking space or use parking spaces in a manner which causes a nuisance to other Owners/Tenants/Customers or occupy more parking spaces than allocated. Violations are subject to enforcement policy as stated. Additionally, Association has the right to have vehicles parked in non-compliance of the rules and regulation towed at Owner s expense. Each Owner shall be jointly responsible for the violation of any of these rules by respective Tenants.
