1 NEWPORT MARKET DAY - 24 th November 2013 Welcome to Newport Market Day 2013 at Newport Beach, Sydney. Our event runs along Barrenjoey Rd, from The Boulevard to Bert Payne Park inclusive of Robertson Rd and Bramley St Car-park. This document shows all of the section maps and the rules that govern our event to ensure its success. I m glad you are coming. 7 PRODUCT REGISTRATION The 3 Events requires your cooperation by registering the labels/brands of products you wish to stock. The 3 Events management will ensure that your products are not going to conflict with our permission guidelines, or with each other. To accompany your registration we request three (3) clear photographs (Jpeg) of the products you wish to sell. These can be uploaded with your online Application Form. STALL SPACE SIZE All general stall spaces marked on a SITE MAP will span a 3x3m space. If you elect to hire a marquee from The 3 Events, you may be supplied with a 2.4m "Fete Stall", there is no price deduction for this. Table stalls and undercover spaces are limited in supply. SAFETY Please consider your stall layout from a child s perspective, keep all heavy and sharp objects away from table edges and ensure any potential trip hazard is removed prior to trading, eg. Tablecloths do not touch the ground and stall weights are secure and easily seen. While moving your vehicle through the event site - remain under 10km/hr and drive with your HAZARD LIGHTS ON. RENTAL FEES & DISCOUNTS Please understand that your rent pays for the numerous expenses that go towards sustaining a successful market. Certain beneficiaries include community groups and charities, without their support we would not be able to offer this opportunity to you. Applications to our events are done so with full knowledge that Rent or otherwise marked as Consulting Fees or Consulting is paid in advance of the market commencing. Your space is not confirmed until payment is received in our account. (Bank Account Details are found on our 'Contact Us' page) The stall is to be occupied by the person registered on the Application Form. Stalls may not be on-sold, sub-let or transferred in any way. The stall fee entitles a stalholder trading rights from the allocated space on the market/festival day only. The 3 Events reserves the right to change and re-allocate stalls as deemed necessary and without notice. Stall fees are set at the discretion of The 3 Events management and subject to change. Stallholders will be notified of fee changes via our website and or social media channels. Discounts are available to organisations that are recognised by the Australian Government with Income Tax Exempt status. The 3 Events / 12

8 REFUNDS There are NO REFUNDS for Newport Market Day Your application and payment to this event is done with full knowledge that payment is upfront and nonrefundable. SPACE ALLOCATION The 3 Events consider a number of factors when deciding on stallholder positioning, including competition, weather, surface dryness & drainage, spatial constraints, residential interests, security & public safety, consumer behaviour & existing infrastructure. Despite this, The 3 Events is willing to consider special requests within reason for stallholder space allocation and stall customisation to stabilise their business & customer interest. The 3 Events will, upon request do our best to position stallholders next to or near other specific stallholders. We are not willing to reserve unpaid space. So, if you have a friend who wants a stall next to you make sure you are paying together. Those who pay-together, stay-together The stall fee entitles a stallholder trading rights from the allocated space on the market/festival day only. The 3 Events reserves the right to change and re-allocate stalls as deemed necessary and without notice. TIMING Please keep to the requested bump-in times as they are designed to maintain a balance between noise, traffic control & management capabilities. Also the surrounding residential community would prefer if they were not disturbed by the noise of the early morning movement And I m sure you don t want to upset them either. If you do not adhere to your time guidelines, you may not have vehicle access to your site. Early arrival may impede neighbouring stallholders from accessing their site. In this instance you may be asked to move your property to enable appropriate access to others. PARKING We cannot allow parking of stallholder vehicles on the event site for any other purpose than unloading or loading equipment. Please keep your loading and un-loading to the shortest amount of time possible & see the SITE MAP for an indication of ideal stallholder parking areas. The 3 Events / 12

9 SET UP & PACK DOWN The 3 Events requests that all stallholders have thorough knowledge of their designated location. Preferably with a printed SITE MAP and sound knowledge of the location of basic amenities such as the Toilets, ATM s and entertainment areas, so you can be as helpful as possible to the public. The biggest No-No of all is an early set-up or pack-down, this is for a variety of reasons. If you arrive at the event early, please do not expect to get immediate access to your site. Workplace Health & Safety measures prevent traffic movement outside of allotted times, so kindly respect them. INSURANCE The 3 Events requires each stallholder to include a valid Insurance Certificate Of Currency for a Minimum of AUD 10 Million Public Liability and Product Liability with your Application. Appropriate insurance, as per all Australian Federal and State Laws must be obtained prior to you unloading your vehicle on the festival/market day. Public and Product Liability Insurance is available through The 3 Events, however this must be done at the time of your application and payment must be received within seven (7) days of your Application approval for cover to be assured. PACKAGING & WASTE As a trading stallholder with The 3 Events, you agree to take your waste off the event site after you leave. It is our primary concern that the entire event site is returned to its original condition. Under no circumstances are you permitted to leave stock-boxes, cartons, plastic bags, packaging-filler, used sand or water, containers of any kind, on the event site. Waste stations will be made available at the end of stall rows and aligned with food areas. The 3 Events / 12

10 POWER & ELECTRICITY The 3 Events requires your declaration of intent to use power by any means and for any purpose during the festival/market. Simply, add a comment on your Application Form outlining the source of your Power and type of equipment/appliances you are powering on the day. Please indicate if you are supplying power to your stall via your own generator and the date of the last Tag Check by a qualified electrician. A qualified electrician MUST tag your power cables Any power generator brought on-site must be fitted with silencing equipment. The 3 Events do not supply power unless otherwise arranged and confirmed in writing. AMENITIES The 3 Events are taking the steps to make sure everyone knows the layout of the event site. We aim to provide location details of all amenities on our site maps, so please print one and keep it inside your stall so you and your staff can offer advice to any member of the public. We will be doing our best to ensure all the amenities are fully operational for you, on the event day. WEATHER The Newport Market Day will run in all weather. The Newport Artisan s Market will continue to run in Damp Weather, however THE 3 EVENTS reserve the right to cancel events due to prior Storms or dangerous conditions. 11 EQUIPMENT RENTAL The 3 Events agrees to order in good faith your approved equipment request list and to notify you within fourteen days if we have been unsuccessful. However, all Fees must have been paid and these are not refunded if we are unable to source your equipment. The 3 Events do not supply power unless otherwise arranged and confirmed in writing. The 3 Events will order appropriate rental equipment on your behalf, the items may be limited to a 3m x 3m marquee and folding tables, despite not fulfilling your order. The 3 Events will take delivery of the items on your behalf and ensure they can be collected by you at either; Your stall location or a general rental equipment area. If you decide to order rental equipment through The 3 Events, you agree to indemnify The 3 Events and take full responsibility for the equipment and will be responsible for the replacement cost of these items if they are either damaged or not returned to the appropriate location, as decided by The 3 Events site manager, or advised on the relevant site map. In the event that your rental equipment fails under either normal operational or adverse conditions you agree to take the steps necessary to rectify the situation without direct recourse through The 3 Events management. In addition you agree to take responsibility for any at fault claims made by the rental company (not, The 3 Events) and or The 3 Events. The 3 Events / 12

12 SOCIAL MEDIA & MARKETING The 3 Events aim to market the events as they deem necessary for a successful market within reason, resource, natural and unnatural constraints. The 3 Events management will enable the use of their images and marketing collateral designed for promotion of their markets and festivals, after receiving written request for permission. By applying to any of The 3 Events markets and festivals, and including any photographic or video material to accompany this application - you hereby allow The 3 Events to use, copy and distribute those images at our discretion. LAW The relationship between any event participant and The 3 Events is in accordance with all State and Commonwealth Laws, which govern all commercial, public health and safety, rental, traffic and other related concerns to any public or private event. Persons under the age of 18 cannot apply for a stall space without the written approval and on-site presence of a parent or guardian. INDEMNITY By applying for this event you are hereby indemnifying The 3 Events against any claim relating to product, public or personal and professional liability you have been involved in via any intentional, negligent, incorrect or accidental means in relation to details about, during or after any market/festival organised by The 3 Events. You hereby agree not to pursue or discuss with any other party, or event participant other than The 3 Events management team, the circumstances in relation to any part of any negotiation or conflict regarding The 3 Events management team or market/festival. VIOLATIONS OF MARKET RULES The 3 Events management reserve the right to enforce the market rules, following notification of a breach or violation by any of the following ways; 1. Rejection of future market/festival applications 2. Immediate trading suspension at markets/festivals 3. Space allocation at future markets/festivals with minimal consideration 4. Increased rental fees for future markets/festivals (upto 25%) The above Terms and Conditions cannot be copied, changed or distributed without the expressed written consent by The 3 Events management.
