1 SKY STAR SEARCH TERMS & CONDITIONS THIS IS A LEGAL DOCUMENT WHICH AFFECTS YOUR RIGHTS PLEASE READ IT CAREFULLY BEFORE YOU SUBMIT YOUR ENTRY These Terms and Cnditins frm part f the SKY Star Search (the Cmpetitin r the Prmtin). Please read these Terms and Cnditins. By submitting the Entry Materials, each entrant cnfirms that they have read and agree t be bund by these Terms & Cnditins. The Cmpetitin is run by SKY Channel Pty Ltd (SKY r the Prmter). QUALIFICATION CRITERIA Entrants must be 18 years r lder, and currently in sund physical and mental health. Entrants must currently live in Australia and have a lawful right t wrk in Australia and therwise perfrm the duties and respnsibilities cntemplated by these Terms and Cnditins. Emplyees, fficers, directrs and agents f Tabcrp Hldings Limited and/r any f its respective related bdies crprate and their immediate family (spuse, mther, father, sister, brther, daughter r sn, regardless f where they live) f such emplyees, fficers, directrs and agents are nt eligible t participate in the Cmpetitin. SKY reserves the right t disqualify any Entrant wh des nt cmply with the General Cnditins, r breaches any f these Terms & Cnditins. THE ENTRY PROCESS Entries pen n 9 June 2013 and clse at 5pm 9 August 2013 (the Entry Perid). Entrants must submit: Fill ut the Applicatin Frm (including the prvisin f assciated phts); and Send in a ne minute vide auditin tape demnstrating why they think they are the persn mst suited t be the SKY Star (Auditin Vide). (Entry Materials) The Auditin Vide must be an riginal piece f wrk f the Entrant. It must be interactive and in either DVD, VHS, DV Cam r Mini DV Frmat. The Auditin Vide shuld be interactive and feature nly the Entrant. There shuld be n RACE CALLS r INTERVIEWS. The Entry Materials can be submitted by: Pst, addressed as SKY STAR SEARCH, 79 FRENCHS FOREST ROAD, FRENCHS FOREST, NSW, 2086; r If under a 5MB file size, Auditin Vides can be sent t skystarsearch@tabcrp.cm.au Subject line shuld be SKY Star Search Cmpetitin (Entrant s Name) and the Entrant shuld ensure they als submit the Applicatin Frm alng with the Auditin Vide (althugh the Applicatin Frm may be sent by r pst separate t the Auditin Vide). The Auditin Vide may nt be place, submitted r prvided t any ther public media.

2 Only ne entry may be submitted per persn and Entries must be submitted by the clsing date f the Entry Perid. SKY is nt respnsible fr any late, lst r misdirected Entry Materials. Entrants must advise the Prmter at the time f entering, and at any time during the Cmpetitin f the fllwing: befre the cnclusin f the Entry Perid f any criminal cnvictins f any kind brught against the Entrant in the last ten (10) years and will ntify the Prmter immediately if there are any criminal charges brught against the Entrant after the Entrant submits their Entry Materials. Entrants must disclse t the Prmter any issues that relate t them that may generate negative publicity and impact n the success f this Cmpetitin and/r reflect unfavurably n the business r prducts f, and licences held by the Prmter r its Related Bdies Crprate (which include Tabcrp Hldings Limited and TAB Limited). The Prmter may, in their sle discretin, disqualify an entrant fr failure t disclse any issues that relate t them that may generate negative publicity and impact n the success f the Cmpetitin, and/r reflect unfavurably n the business r prducts f, r licences held by SKY r any f its related bdies crprate. The Auditin Vide must nt cntain any material that is ffensive (taking int accunt reasnable standards f gd taste), defamatry r therwise in breach f the law. Once submitted, the Entry Materials will nt be returned and will becme the prperty f SKY. The entrant agrees that SKY will be entitled t use, and bradcast any aspect f the Auditin Vide and the Entry Materials (including the phts) at any stage withut any further reference, payment r ther cmpensatin t the Entrant. The Prmter reserve the right t refuse t allw an entrant t take part in any r all aspects f the Cmpetitin, if the Prmter determines, in their abslute discretin, that an entrant is nt in the mental r physical cnditin necessary t be able t safely participate in the Cmpetitin. It is a cnditin f accepting the Cmpetitin that the entrant may be required t sign a legal release in a frm determined by the Prmter in its abslute discretin. Entrants acknwledge that any transprt that is required in rder t participate in the Cmpetitin, including any transprt t and frm the Prmters studis, accmmdatin (if required) and all ancillary csts assciated with attending the Prmters studis are the respnsibility f each Entrant. SELCECTION PROCESS The Prmter may at any time during the Cmpetitin Perid, in their abslute discretin, cnduct telephne interviews and further digital vide (DVD) interviews in rder t determine the Final 6 r Sky Star. Stage 1: Selectin f the Final 6 Entry Materials that have been cmpleted in accrdance with these Terms & Cnditins will be reviewed and judged by representatives f SKY frm SKY s prductin team. Judging will take place at the SKY ffices between 13 August 2013 and 15 August Each entry will be individually judged based n creativity, riginality, presentatin and suitability fr the Cmpetitin (the Set Criteria). Six (6) entrants will be shrtlisted frm all the entries received based n the Set Criteria (the Final 6). The Final 6 will be ntified n 16 August 2013 by telephne and in writing using the cntact details prvided in the Applicatin Frm.

3 In rder t prgress t the Final 6, a Final 6 member must sign a Release and Waiver in the frm set ut n the website. Stage 2: Selectin f the SKY Star The details f the Final 6, tgether with their respective Auditin DVDs will be displayed n the Sky Star Search website ( (the Cmpetitin Website) frm 10am Sunday 18 August 2013 t midnight n 28 August 2013 (the Vting Perid); The Final 6 will als be annunced n SKY s Racing Retr prgramme n Sunday 18 August Frm 18 August 2013 and until 31 August 2013, SKY will air the Auditin Vides f the Final 6 at times and prgrammes at its discretin. During the Vting Perid, any member f the public can visit the Cmpetitin Website and vte n wh they think shuld be adjudged the winner (the Vting Cmpetitin). The results f the Vting Cmpetitin will accunt fr up t 10% f weighting during the final judging prcess. Each f the Final 6 may be required, and if they are required, must agree t attend (at their wn cst) and participate in internal and external publicity activities and media (including televisin, radi and print) interview(s) as required by SKY at any time during the Cmpetitin Perid. In selecting the Cmpetitin Winner, representatives f SKY will assess each f the Final 6 s perfrmance thrughut the Vting Perid (including their perfrmance in any 1-n-1 interviews r ther publicity r media requirements), the Entry Materials submitted by each f the Final 6 and will take int accunt the results f the Vting Cmpetitin. The winner will be selected as the persn whm the SKY panel f judges deems t meet, r have the ptential t meet the standards required f a SKY presenter. The decisin will be made by the SKY judging panel and will be deemed t be final. All decisins made by SKY in relatin t the result are final and binding, and n crrespndence will be entered int. The Sky Star Winner will be ntified n 30 August 2013 by telephne and in writing using the cntact details prvided in their Applicatin Frm and will be required t appear n the Racing Retr prgramme n 1 September THE PRIZES Majr Prize SKY Star The candidate identified as the SKY Star will win the fllwing: a $1,000 tab.cm.au betting vucher; tw (2) weeks f unpaid media training at SKY Racing and/r SKY Sprts Radi (lcatin will be at the discretin f SKY); and in it s abslute discretin, SKY may ffer an emplyment cntract n terms f a written agreement t be entered int between the Sky Star and the Prmter. Hwever, the Sky Star understands and acknwledges that the Prmter are under n bligatin t ffer the Sky Star any emplyment cntract. The Majr Prize is nt transferable, cannt be redeemed fr cash and must be taken as ffered. Minr Prizes Final 6 With the exceptin f the Majr Prize Winner, all members f the Final 6 will receive a five hundred dllar ($500) tab.cm.au betting vucher. The Minr Prizes are nt transferable, cannt be redeemed fr cash and must be taken as ffered.

4 Any GST which may be payable as a cnsequence f the Prizes are the sle respnsibility f the Majr Prize r Minr Prize winners. The Prmter accepts n respnsibility fr any tax implicatins that may arise frm the Cmpetitin. Independent financial advice shuld be sught. OTHER GERNERAL CONDITIONS 1. Exclusin f Liability 1.1 T the extent permitted by law, the Prmter is nt liable fr any lss, including, but nt limited t, direct, cnsequential (including ecnmic) r indirect lss r any lss f prfits, by reasn f any act r missin, deliberate r negligent, by the Prmter r their servants r agents, in cnnectin with this Cmpetitin. 1.2 Nthing in these Terms and Cnditins affect, nr is intended t affect, any rights that an Entrant might have that are nt able t be excluded under applicable Australian cnsumer prtectin laws. 2. Use f Persnal Infrmatin / Marketing 2.1 The Prmter cmplies with the Natinal Privacy Principles cntained in the Privacy Act 1988 (Cth). 2.2 Any infrmatin an Entrant prvides will be used by the Prmter fr the purpse f cnducting this Prmtin. 2.3 The Prmter may disclse Entrants' persnal infrmatin t its cntractrs and agents t assist in cnducting this Prmtin r cmmunicating with Eligible Participants. 2.4 By entering the Prmtin, Entrants cnsent t their persnal infrmatin being cllected, used and disclsed by the Prmter, its agents, affiliates, related business cmpanies, ther cmpanies assciated with this Prmtin, and business partners fr any prmtinal activities, including the Entrants persnal participatin in reasnable prmtinal activities as requested by the Prmter, and any marketing and publicity purpses withut any further reference, payment r ther cmpensatin t the Entrant. 2.5 Entrants cnsent includes authrising the Prmter, its agents, affiliates, related business cmpanies, ther cmpanies assciated with this Prmtin and business partners t send the Participant future electrnic messages including but nt limited t, SMS, MMS, and regarding any prmtinal, marketing and publicity activities. 2.6 All Entrants cnsent t the publicatin f their name and suburb f residence (hwever their full address will nt be published) and agree t participate in Prmtin activities as requested by the Prmter. 2.7 Fr mre infrmatin, refer t the Prmter s Privacy Plicy lcated n the Prmter s website 3. Miscellaneus 3.1 The Prmter, its emplyees, fficers, agents, and its subsidiaries are nt respnsible fr and shall nt be liable fr:

5 (a) (b) (c) any cnditin caused by events beynd the cntrl f the Prmter that may cause the Prmtin t be disrupted r crrupted; any injuries, lsses (including, withut limitatin, lss f prfits), r damages f any kind caused by the Prize r resulting frm acceptance, pssessin, use, r misuse f the Prize, r frm participatin in the Prmtin r dwnlading material frm r any ther website perated by the Prmter; r any printing r typgraphical errrs in any materials assciated with the Prmtin. 3.2 The Prmter reserves the right, in its sle discretin, t: (a) (b) (c) (d) cancel r suspend the Prmtin, shuld the security, fairness, integrity, r prper peratin f the Prmtin be cmprmised in any way by way f any virus r bugs in the IT system used fr this Prmtin; unauthrized human interventin; r ther causes beynd the reasnable cntrl f the Prmter; disqualify any Entrant wh engages in ffensive, illegal r bjectinable cnduct in respect f this Prmtin r therwise brings the Prmtin and/r the Prmter int disrepute; disqualify any Entrant wh tampers with the entry prcess, r wh submits an entry that is nt in accrdance with these Terms and Cnditins; cancel, terminate, mdify r suspend the Prmtin in accrdance with any written directins given by any relevant gvernment r regulatry authrity t d s; 3.3 In the case f the interventin f any utside agent r event which naturally changes the result r prevents r hinders its determinatin, including but nt limited t vandalism, pwer failures, tempests, natural disasters, acts f Gd, civil unrest r strikes, the Prmter may in its abslute discretin cancel the Prmtin r part f the Prmtin and recmmence it frm the start n the same cnditins subject t Australian law. 3.4 By entering this Prmtin, Entrants acknwledge that it is a cnditin f accepting a Prize that they may be required t sign a legal release in a frm determined by the Prmter and agreed t by the Entrant, acting reasnably. 3.5 T the extent that a situatin r issue arises fr which these Terms and Cnditins make n prvisin r in relatin t which the relevant Terms and Cnditins are unclear, the Prmter will make a decisin regarding such situatin. The Entrant will have the right t request an internal review f the Prmter s decisin. Subject t any regulatr directin t the cntrary, the decisin f the internal review will be final and binding. 3.6 In the event that the Entrant is identified as a minr, self-excluded patrn, invluntarily excluded patrn r any ther persn wh is in breach f these Terms and Cnditins (the Refused Winner), the Prmter reserves the right t refuse t allw the Winner t take part in, r receive, any r all aspects f the Prize r the Cmpetitin, and the Prmter will ntify any relevant regulatr accrdingly where required by law t d s. 3.7 Decisins f the Prmter are final. N crrespndence will be entered int. 3.8 These Terms and Cnditins are gverned by and must be cnstrued in accrdance with the laws f NSW. The Prmter and each Entrant submits t the jurisdictin f the curts f NSW and the Cmmnwealth f Australia in respect f all matters arising ut f the Terms and Cnditins.
