1 Revision to IBM , 2007 IBM System x and System Storage Technology Access Program Announcement Letter Number January 15, 2008 Overview The offer The Technology Access Program (TAP) offers selected PartnerWorld members the ability to purchase System x servers, BladeCenter products, IntelliStation workstations, selected System Storage products, and options at discounts off the IBM list price minus bid index price allowance for internal use, demonstration or development purposes. Qualifying/Eligible products section. Start and/or end dates Invoice(s) for purchased product must be dated on or after January 1, Resellers must submit rebate forms within 45 days of purchase in order to receive a rebate payment. Who is eligible? Additional information/conditions Products acquired under the terms of this offering are intended for Business Partner internal use or demonstration/development use. IBM reserves the right to modify or withdraw this offering at any time. This offering is subject to the terms and conditions of any applicable Agreements. No separate options orders will be eligible for rebates. Systems and options are not eligible for price protection. System units and options will only be shipped to the Business Partner LOCID address that has been used to place the order. System units and options may not be returned to IBM or the distribution channel. System units and options purchased under this offering must be used for internal purposes for no less than 90 days from program approval date. The system unit may not be sold to an end user during this time. If and when the system is sold to an end user, the Business Partner is responsible for complying with all laws and regulations governing the sale of such used equipment. Offer is subject to availability of products. Only currently marketed IBM system units and options are eligible for this program. Only approved IBM PartnerWorld members may participate in this program. IBM further reserves the right to reject the transaction or disqualify the IBM PartnerWorld members should there be noncompliance with the terms and conditions of the program or the terms and conditions of any agreement between IBM and its Business Partner. 3 Ordering choices will vary depending on whether you are authorized to resell System x hardware products and have a LOCID or a PartnerWorld Member ID. If you are an IBM Business Partner - Reseller, Solution Provider, or Systems Integrator you may participate in the Technology Access Program by purchasing through an approved IBM authorized IBM Distributor. You must have a valid IBM Business Partner LOCID to make your purchase. If you ARE NOT an IBM Business Partner - Reseller, Solution Provider, Systems Integrator or Distributor but are a member of one of the IBM PartnerWorld program tracks (such as an ISV or Software reseller, and do not have a LOCID) you may participate in the Technology Access Program by purchasing through an IBM Business Partner - Reseller. You will be required to fax a claim form and your invoice for proof of purchase to in order to receive the appropriate rebate. The rebate will be based on the IBM published bid index price at the time of receipt of the claim form at program headquarters. If you are an IBM Distributor with a LOCID, you may participate in the Technology Access Program by purchasing through your normal IBM route. You will be required to fax a claim form and your invoice for proof of purchase to in order to receive the appropriate rebate. Ordering Process If you ARE NOT an IBM Business Partner as described above (such as an ISV or Software reseller, and do not have a LOCID or a Distributor with a LOCID), you may use the appropriate forms included in this announcement. Once you complete the form, fax it to along with your purchase invoice. IBM will issue a rebate check to the qualifying ISV, Software reseller without a LOCID or Distributor with a LOCID within 6-8 weeks of receipt and approval of the Technology Access Request form.
