Legal Obligations Offence to supply food or drink which is: Injurious to health Not of the nature, substance or quality demanded Falsely described or presented If offence due to act or default of someone else: Defence that business took all reasonable precautions and exercised all due diligence Be aware there are legal requirements for: Traceability..withdrawal \ recall.notifying the Competent Authority if unsafe food placed on the market.

7 Risks and Government approaches Increase in detection of food fraud globally more focus on consumers wider interests in relation to food New UK and EU Food Fraud (Crime) Unit new reporting mechanism alongside current RASSF system for food safety incidents Food represents security and comfort (perhaps the target) and can creating fear and uncertainty Access to food easier, detection less likely, penalties lower? Actually, cases of malicious tampering still rare and dealt with differently (jointly by FSA and Police) Fraud \ tampering incidents demonstrate the potential for contaminating, altering and widely distributing food or drink

10 Some Practical Steps Threat Analysis Critical Control Point - TACCP Systematic management of risk through the evaluation of threats, identification of vulnerabilities, and implementation of controls to materials and products, purchasing, processes, premises, distribution networks and business systems by a trusted team with the authority to implement changes to procedures Source - PAS 96:2014
11 Practical Audit - BRC version 7 Considers food safety threats and facilities, processes and checks needed to ensure a safe, quality product also now requires: A documented vulnerability assessment shall be carried out of all raw materials to assess the potential risk of adulteration or substitution. This shall take into account: Historical evidence of substitution or adulteration Economic factors Ease of access to raw materials through the supply chain Sophistication of routine testing to identify adulterants Nature of the raw material
12 ..So! Do you know your supply chain and reasonable vulnerabilities? Have you access to intelligence on reasonable risks to your operation and supply chain, do you act on it? Have you considered any reasonable surveillance eg on site audit, monitoring and testing? Do you have good traceability and records? Do you have an incident response plan and are management and staff aware of what to do? Have you established trade associations, LA, Primary Authority links (ie access to FSA emerging risks assessment) Do you know, how \ who to report concerns or incidents to ie the LA, FSA (or police) they will be handled professionally and discretely!
