1 Voices Protecting the Central and Southern Appalachian Mountain Region Harold Ward, Director Division of Mining and Reclamation West Virginia Department of Environmental Protection th Street SE Charleston, WV Dear Mr. Ward, March 13, 2014 We are writing to share our water sampling results from Fields Creek during the Kanawha Eagle Coal, LLC (Patriot) coal slurry spill with the West Virginia Department of Environmental Protection and the Division of Mining and Reclamation. We ask the DEP consider these results in any enforcement actions against Patriot and in any future permitting decisions. We also ask that the DEP use these samples to inform their sampling procedures following similar coal slurry spills. A spill of coal slurry occurred at the Kanawha Eagle Prep Plant, a Patriot Coal facility, sometime during the early morning of February 11 th, Appalachian Voices became aware of the situation through news reports on the same morning. We arrived at Fields Creek, the site of the spill, in the early afternoon of the same day. We collected grab samples at two locations along Fields Creek at the crossing of MacCorkle Ave, just upstream of where Fields Creek enters the Kanawha ( , ), and just downstream of the prep plant, where the creek crosses under CR 77/1 ( , ). We collected grab samples to be analyzed for total suspended solids (TSS), a suite of total and dissolved metals, a suite of volatile organic compounds, and sulfate. Upon detecting the smell of crude MCHM, we also collected samples to be analyzed for 4- methylcyclohexane methanol. Based on statements made by Randy Huffman that polypropylene glycol or polyethylene glycol may have been used during coal processing at the facility, we also collected samples to be analyzed for diethylene glycol, ethylene glycol, and propylene glycol. We also collected field measurements, including ph and conductivity. All grab samples were either analyzed by Pace Analytical or by ALS. ALS is a WVDEP accredited lab, Pace Analytical is a NELAC accredited lab. We have attached the results of all laboratory testing. We have summarized the most significant findings below. We identified several NPDES permit violations, based on the permit limits found in a December 2013 discharge monitoring report submission. As expected from the obvious amount of suspended material visible in the stream, we identified total suspended solids (TSS) levels at as much as 10 times the amount allowable (table 1). Even after the flow in Fields Creek had been greatly reduced and the water was noticeably clearer on Tuesday

2 evening, the TSS level, at 94 mg/l, was still greater than the 70 mg/l allowed. We identified iron levels more than 3 times higher than allowed on the NPDES permit (Table 2). We also identified aluminum levels 2 to 7 times higher than allowed (Table 2). The highest aluminum level identified the second day was likely due at least in part to the EnviroFloc being used in remediation; nevertheless, the two earlier samples were likely directly due to the spilled slurry. The TSS, iron and aluminum test results indicate at least 3 individual violations of the company s NPDES permit. Under the Clean Water Act and West Virginia 47CSR 30, each violation should be subject to a fine of at least $2,500, and as much as $25,000. We urge the DEP to take these violations into consideration, in addition to violations #35, #36 and #37 already issued, when assessing penalties for this spill. During this particular spill, it was apparent through news reports and statements from the DEP that the DEP had some difficulty determining which chemicals to test for. According to statements made by Randy Huffman in an article in The Charleston Gazette on February 11 th, the DEP originally

3 believed that MCHM was used at the facility, and later learned that either polypropylene glycol or polyethylene glycol was used instead. Additionally, a comment was made that the smell of crude MCHM was likely from a truck transporting the material away from the facility on that day. Several issues exist with these statements. First and foremost, the DEP and DMR should ensure that they are able to obtain accurate information about operations at all mining facilities in a timely fashion, if not before spills even occur. Additionally, though Patriot claimed to have stopped using crude MCHM, the change was reported to have happened recently; therefore, it would be reasonable for the DEP to acknowledge that MCHM may still be present in the processing waste. To attribute the distinctive smell of MCHM to a tanker truck seems unlikely, and extremely coincidental that the move would have occurred on the same day as the spill. While MCHM may not be the most harmful chemical spilled that day, it is obviously an issue West Virginian citizens are very interested in currently. We did identify 4- methylcyclohexane methanol in Fields Creek on the day of the spill (Table 3). This directly contradicts the DEP s reports that no 4- methylcyclohexane methanol was found, and calls into questions the DEP s response to such spills. We identified arsenic at a level greater than the EPA and West Virginia drinking water standards. Though Fields Creek is not directly upstream of any drinking water intakes, the creek does run directly through a residential neighborhood, where residents come in contact with the water in other way fishing, wading and using the water for domestic purposes. Beryllium and iron were also found at a level above West Virginia s drinking water standards. Lead was found at level greater that the EPA primary drinking water standard, as well as the EPA fresh water chronic standard. Chromium and iron were found at a level exceeding West Virginia s chronic warm water fishery and wetland aquatic life standard. Selenium was found at levels exceeding the West Virginia and EPA fresh water chronic standard.

Unfortunately, no amount of money can undo the damage done to Fields Creek, but we believe that strong enforcement of existing laws by the DEP and DMR will go a long way in preventing future spills. We recommend the following to better the agency s response to black water events in the future: 1. Test for all parameters included on discharge permits at the responsible facility 2. Test for any additional chemicals that may be present, which may pose a threat to aquatic or human life 3. Take the necessary steps to ensure that the DEP can obtain accurate and timely information about spilled substances 4. Be forthcoming to the public with any and all available information regarding chemicals spilled, amount spilled, locations impacted, possible impacts, etc. 5. Require facilities that create and dispose of coal slurry to monitor for all parameters and chemicals that exist in the coal slurry by including all parameters in the Article 3 permit monitoring requirements and discharge monitoring reports 6. Require testing of all coal slurry chemicals and parameters during discharges of discolored water

5 The violations issued by DEP thus far for Kanawha Eagle Coal facility address the cleanup of this coal slurry spill, and make some effort at preventing further spills at that facility. We believe the above steps, along with sufficiently large fines, will go further in preventing such spills across the industry as a whole.
