Environmental regulations The main national environmental regulations in force in Bulgaria are: LAW ON THE MARITIME SPACES, INLAND WATERWAYS AND PORTS OF THE REPUBLIC OF BULGARIA ENVIRONMENTAL PROTECTION ACT BIOLOGICAL DIVERSITY ACT WASTE MANAGEMENT ACT WATER ACT CLEAN AIR ACT PROTECTION FROM ENVIRONMENTAL NOISE ACT ORDINANCE 15/28.09.2004 for ship-generated wastes and cargo residues discharging and reception ORDINANCE 9/ 29.07.2005 for the requirements for operational fitness of ports.

LAW ON THE MARITIME SPACES, INLAND WATERWAYS AND PORTS OF THE REPUBLIC OF BULGARIA The present Act establishes the legal regime of the Republic of Bulgaria s sea spaces, inland waterways and ports.

ENVIRONMENTAL PROTECTION ACT This Act regulates the social relations with regard to: protection of the environment for the present and future generations and protection of human health; conservation of biological diversity in conformity with the natural biogeographic characteristics of Bulgaria; the conservation and use of environmental media; the control and management of factors damaging the environment; the exercise of control over the state of the environment and over the sources of pollution; the prevention and limitation of pollution; the establishment and management of the National Environmental Monitoring System; environmental strategies, programmes and plans; collection of, and access to, environmental information; the economic organization of environmental protection activities; the rights and the obligations of the State, the municipalities, the juristic and natural persons in respect of environmental protection.

THE BIOLOGICAL DIVERSITY ACT regulates the relations between the State, the municipalities, and the companies and people in respect of the conservation and sustainable use of biological diversity in the Republic of Bulgaria. Conservation of natural habitat types representative of the Republic of Bulgaria and of Europe and habitats of endangered, rare and endemic plant and animal species within a National Ecological Network; Conservation of the protected plant and animal species of the flora and fauna of the Republic of Bulgaria, as well as of those as are subject to use and trade; Conservation of the genetic resources and the diversity of plant and animal species outside the natural surroundings thereof; Regulation of the introduction of non-native and the reintroduction of native plant and animal species into the wild; Regulation of trade in specimens of endangered species of wild flora and fauna; Conservation of centuries-old and remarkable trees.

WASTE MANAGEMENT ACT This Act shall govern the environmentally sound management of waste as a totality of rights, obligations, decisions, actions and operations related to the formation and treatment of waste, as well as the forms of control over any such activities.

WATER ACT This Act regulates the ownership and management of waters within the territory of the Republic of Bulgaria as a national indivisible natural resource and the ownership of the water systems and facilities.

CLEAN AIR ACT The goal of this law is to protect the people's and their generation's health, the animals and the plants, their communities and places of habitation, the natural and cultural heritage from harmful effects, as well as to ward off dangers and damages to society, resulting from changes in the quality of the atmospheric air, due to various activities. This law regulates: the specification of indicators and standards of the quality of the atmospheric air; the limitation of emissions; the rights and obligations of the state and municipal authorities, corporate bodies and physical persons, with regards to the control and the maintenance of the atmospheric air quality.

PROTECTION FROM ENVIRONMENTAL NOISE ACT This Act shall regulate: The assessment, management and control of environmental noise emitted by road, railway, air and water traffic, as well as by industrial installations and facilities

ORDINANCE 15/28.09.2004 for ship-generated wastes and cargo residues discharging and reception This ordinance establishes the order and conditions for ship-generated wastes and cargo residues discharging and reception from every ship, including fishing ships and sport, and entertainment ships allowed to transport up to 12 persons, visiting or operating at Bulgarian black-sea ports, irrespective of the state flag.

National Program for Development of Public Transport Ports 2006 2015

A number of basic measures for the priorities implementation are set as: Measure 1 Elaboration of plans for waste management of the public transport ports of national importance Varna and Burgas and providing such plans also for the rest of the ports. Measure 2 Introducing of tariff for the covering of 100% of the expenses for the maintenance of the refuse management system from the ships in the public transport ports of national importance Varna and Burgas and providing of the introducing of such systems also in the rest of the ports. Measure 3 Creating of electronic data base for the ships refuse, covering all the ports.

Measure 4 Improving of the normative basis related to the refuse management from the ships. Measure 5 Building of installations for solid refuse treatment /incinerators/ - one for each of the ports Varna and Burgas /probably in Varna-West and Burgas-West/ Measure 7 Introducing of management and control system for the preserving of the environment (EN BDS 14 000) in the public transport ports

The implementation of measures 1, 2, 3 and 4 is concluded as a result of a project, financed by the Dutch Government for the assisting of the application in full size of the requirements of the Directive 2000/59/EU. And a waste management plan on the basis of Directive 2000/59/EU, Waste management act, MARPOL 73/78 is created also.

According to the Law on Sea Spaces, Inland Waterways and Ports of the Republic of Bulgaria (LSSIWPRB) Bulgarian Ports Infrastructure Company has signed contracts with port operators for the performing of services in the refuse management, resulting from the shipping activity.

Improvement of management of ship-generated wastes and cargo residues in Bulgarian ports in accordance with Directive 2000/59/EC executed on July 2007 by Teobodin B. V. EVD on behalf of the Netherlands Ministry of Foreign Affairs and the Netherlands Ministry of Housing, Spatial planning and the Environment.
