BACKGROUND The Los Angeles County Metropolitan Transportation Authority (Metro) is currently constructing the Metro Purple Line Extension (PLE) along Wilshire Boulevard through the City of Beverly Hills. Construction activities on Wilshire Boulevard have impacted the ability of the pedestrian and vehicular traffic to easily view certain businesses and commercial building entrances along this major thoroughfare. The City Council, therefore, adopted an ordinance on April 20, 2017 that allows certain businesses impacted by the Metro construction to request additional temporary signage while the business is directly impacted by construction activities. The associated guidelines for this temporary signage also allows for impacted businesses to request additional signage through a publicly held hearing with the Architectural Commission. Gale Dr. 8 S.F. 1 Illuminated Bronze 8 S.F. 1 Illuminated Bronze TOTAL SIGN AREA: 16 SF (2 SIGN) Pursuant to Beverly Hills Municipal Code (BHMC) 10-3-615, the maximum sign area for a ground floor business with street frontage is calculated at a ratio of 1 square foot for each one linear foot of street frontage along Wilshire Boulevard. Business shall be permitted one business sign for every 25 linear feet of street frontage along Wilshire Boulevard and no more than three business signs in total. Based on a street frontage of approximately 50-0, the (BHMC) allows a maximum number of two signs and approximately 50 square feet of sign area. In addition, the (BHMC) accommodations for signage 10-4-604(D)(2), a sign accommodation could be granted for this retail location (corner location) which would allow for a combined sign area of approximately 260 square feet. As proposed and pursuant to (BHMC) temporary signage requirements 10-3-615, the applicant has requested to deviate from the Code requirements to allow a total of two business identification signs along Wilshire Boulevard and one business identification sign on North Gale Drive with corresponding LED illumination. The Architectural Commission may allow for the approval for these deviations from the above standards, pursuant to the following findings: 1. The sign is in conformity with good taste and good design and contributes to the image of Beverly Hills; 2. The total amount of signage, both permanent and temporary, does not exceed double the otherwise allowable amount of signage as outlined in BHMC 10 4 604; 3. The sign(s) will not unnecessarily contribute to sign clutter in the area; and 4. The size, location, and design of the sign(s) will not result in any significant adverse impacts on surrounding residential properties. URBAN DESIGN ANALYSIS Pursuant to the aforementioned Beverly Hills Municipal Code (BHMC) 10-3-615, for properties and businesses directly impacted by Metro Westside Purple Line Extension construction activities, additional signage is allowed as set forth in the approved guidelines. The Architectural Commission may approve such temporary signage with maximum size parameters and aesthetic requirements deemed necessary so as not to cause an adverse impact to the neighboring residential community. The approved ordinance allows for this temporary signage through January 1, 2025, or until the city engineer determines the Westside Purple Line Extension subway project is complete, whichever date is earlier. Final attachment details shall be provided by the applicant for Staff review and approval and all damage and/or discoloration, etc. caused by the temporary installation of the proposed signage and associated lighting shall be repaired/restored upon removal. ZONING CODE COMPLIANCE Applications for design review are preliminarily evaluated for compliance with the zoning code. Applicants are encouraged and have the option of requesting a comprehensive review separate and apart from this application. Formal compliance review will occur when a building permit application is filed (plan check). The applicant has been advised that changes during plan check may require revisions and subsequent approval from the Architectural Commission or staff, as appropriate. ENVIRONMENTAL ASSESSMENT The subject project is exempt from the California Environmental Quality Act (CEQA Public Resources Code 21000 21178), pursuant to Section 15061(b)(3), and 15311.(a) of the State CEQA Guidelines, in that the project includes the review of signage placed on the façade of the building. It can be seen with certainty that there is no possibility that the subject activity could result in a significant effect on the environment. The project has also been reviewed and found not be a historic resource. PUBLIC OUTREACH AND NOTIFICATION Public outreach and notification was not required for this project.

(310) 858 5966 Application for Temporary Business Signage During Metro Construction Requested Sign Design and Location: Please describe the requested location for installation of the signs on the property as well as the method for sign installation (pole mounted, installed on the building, etc.) Include a picture or elevation of the property and illustrate where you would like to place the signs on the property. If you would like to provide direction to the City s Graphic Division you may also use this space to illustrate the preferred design of the signs (for example, if you would like the language to be horizontal or vertical). We will do our best to accommodate desired sign configurations and designs within the limitations of the approved template (please see attached guidelines). Staff will contact the applicant to review draft designs of requested signs once they have been developed and prior to sign production.

Temporary Businesses Signage Guidelines For businesses directly impacted by Metro construction The following guidelines shall govern the additional business signage that is allowed pursuant to Beverly Hills Municipal Code (BHMC) 10 3 615 for properties and businesses directly impacted by Metro Westside Purple Line Extension construction activities. For more information regarding eligibility for additional signage please refer to BHMC 10 3 615. Interested parties are encouraged to contact City staff at 310 285 1122 to begin the process of installing temporary business signage during construction. Signs that meet the following criteria can be approved by the Director of Community Development. Sign Area: Properties and businesses subject to the standards in BHMC 10 3 615 shall be allowed additional business identification signage that does not exceed one (1) square foot in area for each one foot (1 ) of ground floor street frontage that such business occupies within the building with a maximum sign area allowance of 75 square feet. No one sign may be larger than 25 square feet and no sign may be longer than 10 feet in any one direction. For purposes of determining sign area, the Area of Sign definition described in BHMC 10 4 104 shall be used. This definition is as follows: AREA OF SIGN: The area of one face of the sign, if the sign exposes only one face to view from any one vantage point, and shall mean the maximum width of the sign structure times its height for signs which expose more than one face to view from any vantage point. In addition, multi tenant, multi story buildings may request one additional sign no greater than 15 square feet to provide building information (such as the name or address of the building) or parking/entrance information for the building. This sign shall not be longer than 10 feet in any one direction. Number of Signs Allowed: Properties and business subject to the standards in BHMC 10 3 615 shall be permitted one business sign for every 25 linear feet of street frontage on Wilshire (or fraction thereof) and no more than three business signs total. If a property has more than four ground floor tenants then the total number of signs and sign area is measured based on the property street frontage as a whole on Wilshire Boulevard rather than as individual storefronts. In addition, multi tenant, multi story buildings may request one additional sign no greater than 15 square feet to provide building information (such as the name or address of the building) or parking/entrance information for the building.

Location of Signs: Signs shall be installed in a location that ensures visibility subject to review by the Director. When possible, signs should be installed on a wall that abuts the business at a height less than 25 feet above grade. Alternative installation locations may be considered, including at a height greater than 25 feet above grade or ground mounted pole signs, if it will improve sign visibility, subject to review by the Director of Community Development. Please consult with City Staff to determine the most appropriate location for signage. Sign Design: Signs installed pursuant to the regulations set forth in BHMC 10 3 615 and these guidelines shall be designed by the City of Beverly Hills Graphic Services Division and shall be similar to the sign design scheme as set forth in this document. The business sign may include the name of the business and/or the names of the products or services sold or offered by such businesses, directions to the business entrance or parking entrance, or other messages that could assist patrons in identifying the business, entrances, or parking locations during construction. Signage or advertising for off site businesses shall be prohibited. Applicants will work with City Staff to design the sign. Signs shall not be illuminated. Sign Material: Signs shall be fabricated from hard plastic or metal, unless the Director of Community Development determines that these materials are not suitable for a particular installation. The sign shall be installed by the property owner in a manner that will cause the least amount of physical impact to the building and in a way that ensures the sign can be easily removed. The repair of any damage caused to the building or its surface materials as a result of sign removal shall be the responsibility of the property owner. Deviation from Guidelines The Architectural Commission shall have the authority to approve deviations from the above standards. Under no circumstances will off site business signage be allowed. The cost of design, fabrication, and installation of any signage that deviates from the guidelines shall be borne by the applicant unless otherwise reimbursed by Metro. The following findings must be made by the Architectural Commission in order to approve a proposal to deviate from the standards: 1. The sign is in conformity with good taste and good design and contributes to the image of Beverly Hills; 2. The total amount of signage, both permanent and temporary, does not exceed double the otherwise allowable amount of signage as outlined in BHMC 10 4 604; 3. The sign(s) will not unnecessarily contribute to sign clutter in the area; and 4. The size, location, and design of the sign(s) will not result in any significant adverse impacts on surrounding residential properties.

RESOLUTION NO. AC XX-17 RESOLUTION OF THE ARCHITECTURAL COMMISSION OF THE CITY OF BEVERLY HILLS CONDITIONALLY APPROVING AN ARCHITECTURAL REVIEW PERMIT TO ALLOW THREE TEMPORARY BUSINESS IDENTIFICATION SIGNS FOR HOT 8 YOGA FOR THE PROPERTY LOCATED AT 8383 WILSHIRE BOULEVARD, SUITE 75 (PL1708788). as follows: The Architectural Commission of the City of Beverly Hills hereby finds, resolves and determines Section 1. Vincent Nicoletta, agent, on behalf of the property owner, Douglas Emmet 2008 LLC, and the tenant, Hot 8 Yoga, (Collectively the Applicant ), has applied for architectural approval of three temporary business identification signs for the property located at 8383 Wilshire Boulevard, Suite 75. Section 2. Beverly Hills Municipal Code Article 30, Chapter 3 of Title 10, authorizes the Architectural Commission the authority to approve, approve with conditions, or deny design-related aspects of projects located in the city s commercial and multi-family districts, subject to findings set forth in Beverly Hills Municipal Code Section 10-3-3010. Section 3. Article 6 of Chapter 4 of Title 10 ( Temporary Signage During Subway Construction ) of the Beverly Hills Municipal Code authorizes additional signs to be placed or affixed on commercially zoned property fronting Wilshire Boulevard while the Los Angeles County Metropolitan Transportation Authority constructs the Westside Purple Line Extension subway project in the city, subject to findings set forth in the Temporary Sign Guidelines for Businesses Impacted by Metro Construction. Section 4. Consistent with Beverly Hills Municipal Code Section 10-3-3010, this resolution documents the official action of the Architectural Commission with respect to the project. Section 5. The subject project has been reviewed pursuant to the provisions set forth in the California Environmental Quality Act (CEQA Public Resource Code Sections 21000, et seq.), the State CEQA Guidelines (California Code of Regulations, Title 14, Sections 15000 et seq.), and the city s local CEQA Guidelines. The subject project is exempt from the California Environmental Quality Act (CEQA Public Resources Code 21000 21178), pursuant to Section 15061(b)(3), and 15311.(a) of the State CEQA Guidelines in that the project includes the review of on premise signs. It can be seen with certainty that there is no possibility that the subject activity could result in a significant effect on the environment. The project has also been reviewed and found not be a historic resource. Section 6. The Architectural Commission conducted a duly noticed public hearing on June 21, 2017 at which time oral and documentary evidence was received concerning the application. Section 7. Based upon the evidence presented at the hearings, including the staff report(s), oral and written testimony, the Architectural Commission hereby makes the following findings: Beverly Hills. A. The sign is in conformity with good taste and good design and contributes to the image of B. Section 8. Based on the foregoing, the Architectural Commission hereby grants the request defined in this resolution subject to the following conditions: Project-Specific Conditions All project-specific conditions are subject to final review and approval by the City s Urban Designer. 1. The applicant shall provide final attachment details. 2. All damage and/or discoloration, etc. caused by the temporary installation of the proposed signage and associated lighting shall be repaired/restored upon removal. 3. In accordance with Ordinance No. 17-O-2731, the temporary signage shall be removed and the site restored by January 1, 2025, or on such date when the city engineer determines in writing that physical construction of the Westside Purple Line Extension subway project within the city is complete, whichever date is earlier. Standard Conditions 1. Revised Plan Submittal. For all projects that are approved with project-specific conditions, a revised plan set that has fully incorporated all such conditions shall be submitted to the project planner, both in hard copy format and in electronic format, prior to submitting for the building permit plan check process. 2. Architectural Approval. Project approval is for the design-related aspects of the project only. No approval is implied or granted with regard to applicable city zoning or technical codes, which may require review and approval from other city commissions or officials. 3. Compliance with Municipal Code. Prior to issuance of a building permit, the applicant shall demonstrate compliance with all applicable provisions of the city s municipal code and applicable conditions imposed by any discretionary review approval. 4. Compliance with Special Conditions. Any special conditions that require approval by the Director of Community Development, or designee, shall be submitted to the staff liaison to the commission within fourteen (14) days of approval or prior to submittal of the plan check review application, whichever is greater. 5. Project Rendering. Prior to issuance of a building permit, the applicant shall incorporate into the building permit set of plans, an updated color rendering of all building facades. The quality and detail of the rendering shall be subject to approval from the Director of Community Development, or designee, and shall include sufficient design information to evaluate project compliance during construction. 6. Approval Resolution. A copy of the signed resolution of approval shall be scanned onto the cover sheet(s) of the building permit set of plans. 7. Substantial Compliance with Approved Plans. The Director of Community Development, or designee, shall determine if changes to the approved project are in substantial compliance with the commission s action. This determination shall be subject to applicable fees and charges. A substantial modification to the approved project requires approval from the Architectural Commission. 8. Validity of Permits. The rights granted by this approval shall remain valid for three (3) years from the date of approval, unless extended pursuant to Beverly Hills Municipal Code Section 10-3-207. Section 9. The Secretary of the Architectural Commission shall certify to the passage, approval, and adoption of this resolution, and shall cause this resolution and its certification to be entered in the administrative record maintained by the Community Development Department. Section 10. Decisions of the Architectural Commission may be appealed to the City Council within fourteen (14) days of the final action by filling a written appeal and paying appropriate fees with the City of Beverly Hills City Clerk.
