INTRODUCTION One specific purpose of the Homeowners Association ("Association") is to preserve and control the architecture of the Shadowbrook community. Of the general purposes, the Association is to examine and approve plans and specifications for improvements, alterations, and additions for each unit. For these purposes, the Architecture/Landscape Committee ("Committee") has been established to maintain a harmony of all proposed improvements in relation to surrounding structures and plant life. There shall be no exterior additions or alterations to the unit without the written approval of the Architecture/Landscape Committee. Approval is required for the following: 1. Fences, pools, spas, walls, landscaping or other structures; 2. Exterior additions, changes or alterations. In addition, unit owners are reminded that land use and building permits shall be obtained from the City of Tustin ("City"). The following architecture/landscape standards are intended to complement and supplement the Declaration of Covenants, Conditions and Restrictions ("CC&R s"). 1. DESIGN REVIEW AND PLAN SUBMITTAL DESIGN REVIEW Any additions, alterations or improvements to the exterior ground and/or structures shall require the submission of plans for review and approval before construction commences. The above-mentioned changes include, but are not limited to: walls, arbors, decks, gazebos, fences, pools, spas, landscaping, room additions, etc. To assist the unit owner in obtaining approval of new construction, additions, alterations and/or designs review meetings will be conducted by the Architecture and/or Landscape Committee(s). All plans must be submitted directly to the Management Company in triplicate for distribution to the Committee(s). 2
REQUIRED PLANS Plot Plan (Drawings are required and shall be to scale): Show lot lines accurately, including length, angles, and amount of curve. Show all dimensions on work to be considered, distances between existing and proposed work, and setback of proposed work from property lines. Grading Plan Changes of finish grade must be accompanied by a grading plan prepared by a registered civil engineer, landscape architect, architect, or a licensed contractor. Show contours, flow lines, and finished grades. Positive drainage shall be maintained on each unit. Elevations Provide exterior elevations of all structures proposed, drawn to scale. Note all finish materials, colors and textures on proposed work. Note heights and details.. *** NOTE: Specifications & Notes required for all work proposed. *** 2. SITE DEVELOPMENT STANDARDS BUILDING MATERIAL STANDARDS: ALL REQUIREMENTS NOTED WITHIN THIS SECTION WHICH ARE PERTINENT TO THE DEVELOPMENT OF AN OWNER'S UNIT SHALL BE INCORPORATED INTO THE FINAL PLAN SUBMISSION IN THE FORM OF GENERAL NOTES, DETAILS OR DRAWINGS. 3
TRELLISES GAZEBOS & ARBORS Trellis and beam construction shall be so designed as to provide a minimum of fifty percent (50%) of the total trellis area to open space for the penetration of light and air to areas, which it covers. The structure must be consistent or complement the existing architectural features of the property. Side elevations of structures shall not be enclosed in any manner except in the case where a wall of the dwelling forms a natural enclosure to come or all portions of a side elevation. In general, maximum height for structures in this Section, as measured from the highest point of the structure to the lesser of the ground floor within the structure or the finish grade of the lot, per a cityapproved grading plan, may be varied to align with architectural features of the dwelling, subject to the control and approval of the Committee. EXTERIOR BUILDING WALLS Exterior walls shall be stucco or wood siding to match the material, finish and color of the existing house. Exterior finish treatment used on the building walls shall be continuous and consistent on all elevations of a residence in order to achieve a uniform and complete architectural design statement. FASCIA Fascias shall be stucco or wood to match existing house fascia detail. GARAGES There shall be a minimum of two garage spaces within each dwelling maintained for parking on a daily basis. Homeowners shall not use spaces provided for guest or street parking to park their vehicles. MAILBOXES Mailbox enclosures shall remain as originally provided by the developer and shall be subject to control by the Committee. GUTTERS & DOWNSPOUTS All gutters shall be seamless galvanized metal (no plastic material) designed as a continuous architectural feature and colored to match the surface to which attached. Copper gutters are also acceptable and encouraged. ROOFS ALL ROOFING TILES SHALL BE U.S. TILE EL CAMINO BLEND CLAY FLAT E. 4
WALLS & FENCES Acceptable Materials Masonry Wrought iron or tubular steel Wood Acceptable Color and Finishes Unacceptable Materials Wood: Stain or paint to complement house colors. Masonry: Color and materials to be harmonious with community elements. Wrought iron: Paint black or charcoal black. Continuation of dwelling exterior colors and finishes, subject to the approval of the Committee. Chain link, poultry wire or other types of woven wire; including plastic coated wire. Aluminum or sheet metal. Plastic or fiberglass materials. Reed or straw-like materials. Rope or other fibrous strand elements. Concrete block, plain or painted. PATIO STRUCTURES: SUNSHADES. TRELLISES & GAZEBOS No objects such as urns, pots, planters, etc., shall be placed on top of structures in this section. All such "adornment" shall be located under, around, or suspended within the structure. Unacceptable Materials Structures and Framework: metal structures, including metal awnings, except as noted above. SHEET METAL All exposed sheet metal to be colored to match related material or surface being flashed. 5
TRASH CONTAINERS Must be maintained within the dwelling unit's garage except from 6:00 P.M. the night before refuse pick-up and returned inside the garage before 7:00 P.M. the day of pick-up service. DRAINAGE Must be in accordance with the concept and designs shown on the tract grading and improvement plan. It shall be the responsibility of the unit owner to insure that system functions in accordance with these design standards. The Committee shall review all drainage changes prior to the work commencing. 3. LANDSCAPING, POOL & RECREATIONAL DEVELOPMENT STANDARDS LANDSCAPING Location, size and species of any landscaping which may ultimately extend above the walls and fences must be shown on a plan and submitted for approval. In order to preserve the structural integrity, aesthetic beauty and the natural view from any unit, the Committee shall have the right to require any member to remove, trim, top or prune any tree or shrub, which in the reasonable belief of the Committee impedes or detracts from the view of any unit. Lots have been engineered and graded to allow for proper drainage. It is recommended that a registered civil engineer or a licensed landscape architect be consulted before modifying or disturbing drainage patterns. No dirt shall be placed against fences, walls or adjoining structures. Raised planters shall be freestanding and properly waterproofed to prevent damage to adjacent walls, fences and buildings. POOLS, SPAS & HOTTUBS Accessory Equipment Will be screened from view of any lot and from the public purview from any public right-of-way, with acceptable fence or wall material. Shall be located or sound attenuated as per local codes in such a manner as not to disturb adjacent dwelling units/neighbors. Shall conform to governing laws and agency regulations. Heaters Gas fired heaters shall be stack-less or low profile in configuration. Solar heating systems shall be subject to Committee review and approved as to location and exposure to the view from other lots or from public rights-of-way. RECREATIONAL The Committee shall consider the preservation of the view and the maintenance of privacy to any lot when reviewing proposed outside recreational activity areas. Such review shall include, but not be limited to, noise and light intrusion. ************** SECTION 2: Neighbor Notification The intent is to advise your neighbors impacted by the proposed improvements to your lot (property). Neighbors are to sign this form and initial plans. Neighbor comments may be submitted separately to Optimum Property Management for review by the Architectural Committee. SECTION 5: General Guidelines & Check Lists Patio covers may not exceed nine feet six inches (9'6") in height and must be painted to match house. Do not design landscaping improvements which result in backfilling of soil against fences or neighbor's house. Mature height of trees shall not exceed the height of house. Vendor sign information (if applicable) of any type, including signs identifying the residence as the site of their activities or operations, may not be displayed. SECTION 6: HOMEOWNER AGREEMENT No architectural or landscape improvements shall commence until approved in writing by the ARC. All improvements approved by the ARC must be completed within one hundred twenty (120) days after approval. Failure to complete the work within the prescribed period of time will cause the approval to be rescinded and resubmission will be required. Extenuating circumstances should be brought to the attention of the ARC. Within thirty (30) days of completion of improvements, I will notify the ARC in writing of such completion in order for the ARC to make its inspection as to compliance with approved plans and specifications. The "Conditions of Approval" section of the Association's Architectural Standards shall apply to any approval.
