CHAPTER M-33 An Act to provide for Assistance to Certain Municipalities in the Establishment or Improvement of Roads, Bridges and Ferry Services Short title 1 This Act may be cited as The Municipal Road Assistance Authority Act. R.S.S. 1978, c.m-33, s.1. Interpretation 2 In this Act: authority (a) authority means the Municipal Road Assistance Authority mentioned in section 3; director (b) director means the director of the authority appointed pursuant to section 4; grid road (c) grid road means a road or any portion thereof in: (i) a municipality; or (ii) a local improvement district; that is designated as a grid road under section 5; local improvement district (d) local improvement district means a local improvement district within the meaning of The Local Improvement Districts Act; minister (e) minister means the member of the Executive Council to whom for the time being is assigned the administration of this Act; municipality (f) municipality means a city, town, village or rural municipality. 1966, c.52, s.2; 1972, c.81, s.1; R.S.S. 1978, c.m- 33, s.2. Administration by authority 3 This Act shall be administered by an authority, to be known as the Municipal Road Assistance Authority, under the direction and control of the minister. 1966, c.52, s.3; R.S.S. 1978, c.m-33, s.3. Director and other staff 4(1) The Lieutenant Governor in Council shall appoint a director who shall be in charge of the conduct of the business of the authority. (2) The staff of the authority shall consist of the director and such other officers and employees as are required for the proper conduct of the business of the authority. (3) The authority may engage such consultants and employ such professional, technical and other employees as may be required for the purposes of this Act. 1966, c.52, s.4; R.S.S. 1978, c.m-33, s.4.

M-33 MUNICIPAL ROAD ASSISTANCE Designation of grid roads 5 The authority may designate any municipal road or local improvement district road as a grid road for the purposes of this Act. 1966, c.52, s.5; R.S.S. 1978, c.m-33, s.5. Powers of authority 6 The authority may: (a) assist municipalities in snow removal operations; (b) construct, reconstruct and maintain bridges, roads and grid roads in the municipality with the consent of the municipality; (c) construct, reconstruct and maintain bridges, roads and grid roads in a local improvement district with the consent of the member of the Executive Council responsible for the administration of The Local Improvement Districts Act; (d) formulate and administer a program of assistance and make grants to municipalities and local improvement districts for the construction, reconstructions and maintenance of bridges, roads and grid roads in a municipality or local improvement district as the case may be; (e) construct, reconstruct and maintain bridges and roads in an Indian reserve with the consent of the Minister of Indian Affairs and Northern Development and the council of the band on the reserve; (f) formulate and administer a program of assistance and make grants to the councils of Indian bands for the construction, reconstruction and maintenance of bridges and roads in reserves; (g) undertake research pertaining to bridge, road and grid road standards of construction, location, maintenance and use; (h) subject to The Highways Act, establish, operate, control and maintain ferry services and ferry approaches and to fix and collect tolls for the use of any such ferry service; (i) purchase or otherwise acquire land, buildings or materials for any purpose related to the exercise of a power conferred by this Act. 1966, c.52, s.6; 1971, c.35, s.2; R.S.S. 1978, c.m- 33, s.6. Powers of minister 7 The minister may enter into any contract or agreement that may be deemed necessary or advisable for the purpose of carrying out the provisions of this Act, but no deed, contract, document or writing in respect of any matter under the control or direction of the minister, the director or the authority shall be binding unless signed by the minister or by the director on behalf of the minister. Reports by director to minister 8 The director shall report to the minister at regular intervals with respect to the progress and activities of the authority and submit to the minister such reports and estimates as the minister may require. 1966, c.52, s.8; R.S.S. 1978, c.m-33, s.8.

M-33 5 Annual report to Lieutenant Governor in Council 9 The minister shall make and submit to the Lieutenant Governor in Council an annual report concerning the administration of this Act, which shall be laid before the Legislative Assembly within ten days from the commencement of the session next following the end of the year for which the report is made. 1 966, c.52, s.9; R.S.S. 1978, c.m-33, s.9. Expenditures 10 Sums required for the purposes of this Act may be paid for moneys appropriated by the Legislature for such purpose. 1966, c.52, s.10; R.S.S. 1978, c.m-33, s.10. Regulations 11 The Lieutenant Governor in Council may make regulations for the purpose of better carrying out the objects of this Act and more particularly for the regulation of amounts and conditions of payment of grants or assistance or both to municipalities, Indian bands and local improvement districts under this Act. 1966, c.52, s.11; 1971, c.35, s.3; R.S.S. 1978, c.m-33, s.11.
