FESTIVAL OVERVIEW The Victoria International Buskers Festival is inviting interested vendors to make application for rights for our second annual event, from July 20-29 th 2012. We expect to attract over 100,000 visitors at our 2 nd annual free- to- attend festival, with a mix of tourists and area residents. We also have cruise ships in on most festival days which should add considerably to pedestrian traffic. Food Vendors: We will presenting food vendors in our International Food Village in the Provincial Capital Commission (PCC) lot - also the location of our main sponsor stage. Non- Food Vendors: We are presenting 20 non- food vendor booths on the west side of the Inner harbour slip, being Ship Point. Among these provided booths will be our festival headquarters booth as well as the People s Choice Awards booth (where festival goers go to vote on their favourite busker act the People s Choice winner receives $1000 cash). All of our participating vendors are at the very centre of all the action!

Box 8297, STN Central Victoria, B.C., V8W 3R9 To arrange an appointment, call 250-661- 5350. 2012 Festival Dates and Hours: Vendor Application Friday, July 20 th : 5pm 10pm Saturday, July 21 st - Saturday, July 28th: Noon 10pm Sunday, July 29 th : Noon - 5pm Vendor sites for the festival are broken down in the following way: 1) Cost of site 2) Electricity 3) Off Hours Physical Security 4) Applicable Tax (12% HST) By signing this document you (being the party named below) are applying for a vending site at the festival on the following terms and conditions: 1. Cost and Size: Non- Food Vendor: Per 10ft x 10ft location, our provided tents are available for either five or ten day intervals at $160.00 per day. Note the five day dates are either Jul 20-24 th or Jul 25-29 th and preference is given to ten day bookings. There is an added one time security fee of $72.50 ($145.00 for ten days) to contribute to overnight physical security for the duration of the festival. Food Vendor: Per food vendor locations in the PCC lot are $2,000.00. Food vendors are not extended reduced stay opportunities. Note: Food vendors may be subject to adhering to soft drink exclusivity by the designated festival soft drink supplier. There is an added one time security fee of $145 to contribute to overnight physical security for the duration of the festival. 2. Electricity: Power runs are $75.00 each. 3. Payment: Cheque or money order must be made out to The Victoria International Buskers Festival Society. The first payment (25% of total cost) is to be sent along with your signed contract. The second payment (75% of total cost) is due on or before Monday, June 25 th, 2012
4. Location. You may request a certain location for your vending site. However, we cannot make a commitment to accommodate all requests. We will make every effort to settle on a mutually acceptable location but are under no legal obligation to do so. All sales and promotions must be made only from the location you are assigned. No roaming of the festival site to sell products is permitted. 5. Health / City Approval. You are responsible for obtaining all approvals that you require as a vendor including a City of Victoria business license if required. Failure to comply with the Statutory Requirements as set out by the relevant authorities may result in the partial or full closure of your vending site. Please also confirm that your products and vending site set- up pass the health regulations required for the preparation and selling of your products. 6. Liability / Insurance. If your application is accepted, you agree that any liability (e.g. to persons or property) relating to the use of your vending site (or the products or services that you offer at your site) is solely yours. Further, all risk to your property due to loss, theft or damage is yours. As such, you agree to fully save harmless the Victoria International Buskers Festival and its officers, employees, agents, volunteers and subsidiaries from all the above. You must have liability insurance coverage of at least $1 million. 7. Products and Services. You must list all products and services that will be offered, displayed or in any way associated with your site on the next page. Products and services not so listed or pre- approved by us in writing prior to the Festival are prohibited. You bear the risk that we might not give such approval with respect to any particular goods and services so we ask for our approval as soon as possible. For greater certainty, the following items/services will not be permitted to be offered, displayed or in any way associated with your site: a. All drug related items: pipes, bongs, papers, etc. b. Weapons of any kind: knives, etc. c. Explosives materials: fire crackers, etc. d. Inappropriate sexually suggestive items e. Any offensive material regarding gender, race, religion, language, etc. f. Products/services that would conflict with the products/services being promoted by our major sponsors. 8. Pricing. Your prices must be reasonable and customary within the Victoria area and they shall not fluctuate in response to the prices of a competitor s similar product(s). 9. Hours. Subject to this paragraph or unless we grant a request from you to modify your hours, you must open by 12:00 pm (except for opening day) and remain open for business until 10:00pm each and every day of the Festival. You must remain open or reopen immediately following a rain delay, unless we have officially closed down the site. We reserve the right to postpone or cancel acts due to electrical or safety issues or due to wet weather. 10. Vehicles. You are responsible for your own vehicle parking; the festival does not provide parking passes. 11. Cleanup/ Equipment. For security purposes, anything of value should be removed from the site nightly. Individual vendor site cleanup is completely the responsibility of the vendor who contracted the site. Your site should be cleaned up nightly, with all recycling, compost and garbage disposed of in the festival dumpster. Vendors are not to use onsite garbage cans for use by the public. At the end of the
Festival, you must leave your rental site clean, without damage and in the same condition it was in prior to the Festival. 12. Property / Travel / Accommodations. We do not supply any equipment. You must supply your own fire retardant tent, fire extinguisher, tables and chairs, signage, extension cords, transportation and off- site accommodations. 13. Noise. You are asked to be neighborly and not disruptive to the vendors or performance stages around you. Loud music, loud generators, and loud disruptive employees will not be tolerated. Failure to comply upon request will result in termination (see Section 20). 14. Drugs / Alcohol. Any drug/alcohol use or sale is strictly prohibited and will result in immediate termination (see Section 20). 15. Security. We will contract a company to provide overnight security during the Festival. Please keep a close watch of your cash box and valuables. 16. Control / Representations. You acknowledge that we reserve the right to make whatever arrangements that we deem appropriate for security, crowd control, clean up, publicity, and any other matters affecting the overall Festival operation. We make no representations as to specific levels of attendance, nor that you will achieve any specified dollar amounts in sales. 19. Personal License / Not Assignable. If your application is accepted, you are, by the terms of this document granted a license to use the vending site that we designate. This license is personal and cannot be transferred or assigned. It must be used only by you. A vendor license tag may be issued and must be displayed at all times. 20. Breach / Termination. YOU AGREE THAT THE VICTORIA INTERNATIONAL BUSKERS FESTIVAL MAY END THIS AGREEMENT AT ANY TIME IN RESPONSE TO A BREACH OF ANY OF THE CONDITIONS LAID OUT IN THIS APPLICATION AND SUBSEQUENT CONTRACTS. ALL MONIES PAID IN RELATION TO THIS APPLICATION AND SUBSEQUENT CONTRACTS WILL BE FORFEITED (AS DAMAGES AND NOT AS A PENALTY) NOTWITHSTANDING THAT YOU ARE PROHIBITED FROM USING THE VENDING SITE ORIGINALLY CONTRACTED. 21. Acceptance. We may accept your application at any time until you contact us in writing to tell us that you wish to withdraw it. We will accept your application by returning (via email or mail, using the info below and chosen at our discretion) a copy of this application signed by us. We will contact you whether or not your application has been accepted. Once we have accepted your application, this document will be a binding agreement and we shall be entitled to cash the cheque that you provided to us pursuant to Section 3.
