GRASS CUTTING SERVICES QUOTATION 2017-2019 GRASS MOWING SEASONS (3 year agreement) Starting April 18, 2017 Ending October 31, 2019 Town of Grimsby Parks and Facilities Page 1 of 5 Completed Formal quote forms, clearly marked as to contents, may be delivered to the Grimsby Peach King Centre located at 162 Livingston Ave. no later than 2 pm on Thursday December 16, 2016 GENERAL REQUIREMENTS 1. All equipment that the successful contractor proposes to use on this work must be in good mechanical and operating condition and must be made available for inspection by the Town of Grimsby any time before and/or after it is put into service. Such inspection is not to be construed as an endorsement or approval of the mechanical or operating condition of the equipment and does not relieve the owner or operator from liability for such equipment. 2. The bidder shall provide a description of the equipment, which they intend to use in the performance of the work in the space provided on the quotation form. 3. All equipment operators must be fully trained, qualified and experienced. Regulations of the Ministry of the Environment and the Ministries of Health, Labor and Transportation must be complied with. If any operator is not performing satisfactorily or operating the equipment safely to the satisfaction of the Town of Grimsby, the Town of Grimsby shall have the right to have the equipment and the operator removed from the job site. Repeated infractions are grounds for immediate cancelation of this agreement. 4. The work to be performed by the contractor may be scheduled between the hours of 7:00 a.m. and 5:00 p.m., Monday to Friday, except when such work day falls on a Statutory Holiday. Written approval from the Parks and Facilities Manager, or his designate is required to work at any other time. 5. At all times, the employee of the contractor shall act in a civil, responsible, courteous and generally productive manner. There will be no allowances made for employees to offend or interfere or join in activities being carried on by Town staff or outside groups whilst they are being employed by the contractor, any such complaints, if received, will be referred to the contractor. The Parks and Facilities Manager reserves the right to request that said employee be taken off the works by the contractor, and not re-employed until satisfactory arrangements have been made to ensure that there is no recurrence of the offending behavior. 6. The contractor shall not leave any equipment on Town or Public property unattended at any time, unless such equipment is properly protected to the satisfaction of the Parks and Facilities Manager or his designate.

Page 2 of 5 7. All acreage listed is approximate and is only given as a general guide. Bidders are required to visit each of the sites prior to submitting a bid to determine the amount, character of the work involved and the site conditions affecting the work. The Town of Grimsby will not be responsible for errors in stated site acreage. No allowances shall subsequently be made for errors or misjudgments on the part of any bidder. 8. All work performed under this contract must be carried out in accordance with the terms and conditions of the OCCUPATIONAL HEALTH & SAFETY ACT, LATEST REVISION. Department of Labour Regulations are to be observed regarding hard hats, safety footwear, appropriate clothing (no bare tops will be allowed), ear and eye protection is mandatory. 9. The contractor shall remove all litter from grass cutting areas before the actual cutting is to be done. Litter cut up by the contractor s machinery shall be the responsibility of the contractor to pick up and remove from the site. 10. Excess grass clippings are to be picked up and disposed of. 11. Grass cutting shall include trimming of the grass and weeds around trees, bushes, buildings, waterways, ditches, fences, flowerbeds, parking curbs, under benches, under receptacles and any other objects as necessary for good maintenance and appearance of the facility(s). 12. Special attention is essential when trimming around trees and shrubs to ensure the plants are not harmed by breaking or scoring the bark. Damage to trees shall be grounds for termination of the contract at the discretion of the Parks and Facilities manager. SPECIFIC REQUIREMENTS 1. Grass to be cut on a weekly basis or as required. Height of grass prior to cutting shall not be allowed to exceed 4. Grass shall be cut to a height of 3 with a rotary turf type mower. 2. Special attention must be observed while working around people or animals to ensure their safety. Discharge shoots should always be directed away from any area s where projectiles could cause damage to property or person. 3. The Town of Grimsby reserves the right to cancel this agreement with 15 days advance notification if the requirements (general or special, as above) are not being fulfilled or if any workmanship is deemed unsatisfactory. 4. Bidders must carry a (minimum) Five million dollar insurance policy with proof of coverage for the term of the contract. 5. Use of pesticides for cosmetic purposes is banned as per Ontario Regulation 63/09 and the Pesticides Act, which was amended by Cosmetic Pesticides Ban Act, 2008. 6. Copy of Insurance proof of coverage must be included with quote. Note: The Parks and Facilities Manager or his designate may modify the height of cut in accordance with the weather and park use requirements.

Invoices for work completed will be accepted for payment following substantiation by Town supervisory staff responsible for each site. The Town of Grimsby reserves the right to hold back payments to the contractor in cases where work is not considered satisfactory, or as compensation for damage caused by the contractor to buildings, trees, flower beds or any other property.
