US FDA MEDICAL DEVICE REGULATORY DEFINITION Medical devices range from simple tongue depressors and bedpans to complex programmable pacemakers with microchip technology and laser surgical devices. Medical devices include in vitro diagnostic products, such as general purpose lab equipment, reagents, and test kits, which may include monoclonal antibody technology. Certain electronic radiation emitting products with medical application and claims meet the definition of medical device. - Examples include diagnostic ultrasound products, x-ray machines and medical lasers.

US FDA MEDICAL DEVICE REGULATORY DEFINITION If a product is labeled, promoted or used in a manner that meets the following definition in section 201(h) of the Federal Food Drug & Cosmetic (FD&C) Act it will be regulated by the Food and Drug Administration (FDA) as a medical device and is subject to premarketing and postmarketing regulatory controls. A device is: "an instrument, apparatus, implement, machine, contrivance, implant, in vitro reagent, or other similar or related article, including a component part, or accessory which is: - recognized in the official National Formulary, or the United States Pharmacopoeia, or any supplement to them, - intended for use in the diagnosis of disease or other conditions, or in the cure, mitigation, treatment, or prevention of disease, in man or other animals, or - intended to affect the structure or any function of the body of man or other animals, and which does not achieve its primary intended purposes through chemical action within or on the body of man or other animals and which is not dependent upon being metabolized for the achievement of any of its primary intended purposes."

DEVICE CLASSIFICATION SIMILAR BUT NOT GLOBAL In one country a product might be regulated as drug in another country regulated as a device (example LVP Balanced Intra-Ocular Saline Solution (BSS) Drug in the US, CE Marked medical device in Europe In some countries a product is prescription and in other Over The Counter (OTC)

Things To Know about FDA and Device Trials - OUS Studies MAY be acceptable to Support a 510(k) or PMA BUT; Use the Pre-IDE Process BEFORE Initiating the OUS Trial Choose a Country whose Demographics and Clinical Practices are comparable to the US (Canada / EU most readily accepted) - Pre-IDE Process Non-Binding on FDA Helps Understanding of FDA Expectations Is NOT generally a Pre-Submission Meeting but.. Establishes Company s willingness to Work with FDA Don t Ignore what FDA tells you! - Don t Assume a US Trial is Non-Significant Risk without confirmation from FDA Reliance solely on IRB can bring unpleasant surprises - More 510(k) Devices are likely to require significant Clinical Data

Do Design Controls apply to my product and if so, how will I meet these requirements? Where the finished product will be manufactured?

GLOBAL REGULATORY LANDSCAPE - HARMONIZATION GHTF Global Harmonization Task Force a combination of industry and regulators worked together to harmonize the regulation of medical devices Disbanded International Medical Device Regulators Forum - The International Medical Device Regulators Forum (IMDRF) was conceived in February 2011 as a forum to discuss future directions in medical device regulatory harmonization. - It is a voluntary group of medical device regulators from around the world who have come together to build on the strong foundational work of the Global Harmonization Task Force on Medical Devices (GHTF), and to accelerate international medical device regulatory harmonization and convergence.

STANDALONE MEDICAL DEVICE SOFTWARE HARMONIZATION (SAMD) Develop documents that support innovation and timely access to safe and effective Software as a Medical Device (SaMD) globally Identify commonalities and develop approaches for appropriate regulatory controls Promote prospective convergence in areas of advanced and innovative technologies in this topic area.

NCAR EXCHANGE PROGRAM Facilitates the exchange of relevant post market safety information on medical devices with global distribution. Trigger rapid adoption of field safety corrective actions in all concerned geographies to avoid death or serious deterioration of health.

ROADMAP FOR IMPLEMENTATION OF UDI SYSTEM Define the path to implementing a globally harmonized approach to a uniform device identification system, and builds on the earlier work of GHTF.

MEDICAL DEVICE SINGLE AUDIT PROGRAM (MDSAP) The Working Group will develop a standard set of requirements for auditing organizations performing regulatory audits of medical device manufacturers quality management systems. The document will be applicable to competent authority auditing groups/inspectorates, as well as third party organizations that conduct such audits. This is an initial critical step in establishing a single audit program. This action will complement the current ISO13485 revision process under which IMDRF seeks modifications to achieve a harmonized standard amongst its members.

IMDRF RECOGNIZED STANDARDS The task is to create a list of International Standards used for medical device regulatory purposes that are recognized by IMDRF. Currently in gathering information phase. Will be critical and very helpful for global device development once realized and adopted.

REGULATED PRODUCT SUBMISSION This work will take advantage of a project underway internationally that will result in a messaging standard that supports the electronic transmission of regulatory submissions. This work will define a common Table of Contents for medical device regulatory submissions as a first step in defining a common data set.

EU MEDICAL DEVICE REGULATORY OVERHAUL Historical Legislation - Rules relating to the safety and performance of medical devices were harmonized in the EU in the 1990s. The core legal framework consists of 3 directives: - Directive 90/385/EEC regarding active implantable medical devices, - Directive 93/42/EEC regarding medical devices and - Directive 98/79/EC regarding in vitro diagnostic medical devices - These 3 main directives have been supplemented over time by several modifying and implementing directives, including the last technical revision brought about by Directive 2007/47/EC The European Parliament and of the Council on medical devices and a Proposal for a Regulation of the European Parliament and of the Council on in vitro diagnostic medical devices which will, once adopted by the European Parliament and by the Council, replace the existing three medical devices directives. - Target for adoption: 2014 - The new rules would then gradually come into effect from 2015 to 2019
