WMA main provisions WMA determines the rights and obligations of national and local authorities, requirements towards waste treatment facilities and installations, Introduces economic and regulatory mechanisms and instruments for implementation of the legislation; rules for management of specific waste streams; rights and obligations of waste generators and waste treatment facilities determines the fines and sanctions for violations of the legal requirements. WMA main provisions Specifies the requirements for the products in the production process or end-use, which produce hazardous and ordinary waste. Indicate measures extended producer responsibility for these products in order to promote reuse, prevention, recycling and other recovery of waste. Targets for recycling of specific materials from municipal waste paper and cardboard, glass, plastics and metals the targets are for paper and cardboard, glass, plastics and metals generated by households or by other sources similar to households the targets shall be achieved gradually by 2020 in each of the waste management regions by 1st of January 2016 not less than 25 % of total quantity by 1st of January 2018 not less than 40 % of total quantity by 1st of January 2020 not less than 50 % of total quantity These quantitative targets shall be attained for each of the above mentioned four waste materials The waste recycling strategy in Sofia: from national to local level 6

Targets for reduction of biodegradable waste going to landfills Biodegradable waste means any waste that is capable of undergoing anaerobic or aerobic decomposition, such as food and garden waste, and paper and paperboard. The targets shall be achieved gradually by 2020 in each of the waste management regions not later than 31st of December 2020 biodegradable municipal waste going to landfills must be reduced to 50 % of the total amount (by weight) of biodegradable municipal waste produced in 1995 not later than 31st of December 2013 biodegradable municipal waste going to landfills must be reduced to 35 % of the total amount (by weight) of biodegradable municipal waste produced in 1995 The waste recycling strategy in Sofia: from national to local level 7

Targets for recovery of bio-waste Bio-waste means biodegradable waste types such as green waste from parks and gardens, food and kitchen waste from households, catering, cantinas and commercial centers as well as similar waste from food industry The targets shall be attained gradually by 2020 in each of the waste management regions by 31.12.2016 not less than 25 % of the municipal bio-waste generated in the region in 2014; by 31.12.2020 not less than 50 % of the municipal bio-waste generated in the region in 2014; by 31.12.2025 not less than 70 % of the municipal bio-waste generated in the region in 2014. Cooperation with the Compliance Schemes (Recovery Organizations) for specific wastes Establishment of mechanism for separate collection of specific waste streams The mayors of municipalities are obliged by WMA: to render assistance to Recovery Organization for specific waste to determine the locations for placement of the containers for separate collection and the collection points for specific waste Benefits for municipalities by the cooperation with Recovery Organizations: decrease of the municipal waste quantities for which the municipalities are responsible for collection and treatment decrease of the financial resources from municipal budgets needed for municipal waste collection and treatment The waste recycling strategy in Sofia: from national to local level 10

Financial consequences and stimulus for the municipalities In case the targets for recycling of glass, paper, metal and plastics specified in WMA are fulfilled the municipalities are discharged by 50% of the landfill tax The municipalities are discharged further by 50% of the landfill tax in case the targets for reduction of biodegradable waste going to landfill (specified in WMA) and the targets for recovery of bio-waste (specified in the Regulation on separate collection of bio-waste) are fulfilled The waste recycling strategy in Sofia: from national to local level 11

Financial consequences and stimulus for the municipalities In case the municipalities achieve both targets they are discharged from payment of landfill tax In case municipalities do not fulfill the requirements for provision of civic amenity sites by the middle of 2014 their landfill tax is increased by 15% The waste recycling strategy in Sofia: from national to local level 12

Municipal waste management legislation In accordance with WMA and the National Waste Management Plan the municipalities shall develop and adopt: Municipal Waste Management Programme Municipal Waste Management Regulation The waste recycling strategy in Sofia: from national to local level 13

Municipal Waste Management Programme It shall be elaborated in accordance with the structure, goals and the measures of the National Waste Management Plan (NWMP) It shall cover a period that coincides with the period of validity of the NWMP (2014-2020) It shall include the necessary measures for implementation of the mayors of municipalities as specified in the WMA The draft Programme shall be presented for public access and consultations The waste recycling strategy in Sofia: from national to local level 14

Implementation of the legislation targets for recycling of municipal waste According to the contracts Recovery Organizations for packaging waste are also obliged to achieve part of the targets for preparing for re-use and recycling of waste materials, including at least paper and cardboard, metal, plastic and glass from households and similar waste from other as follows: by 31st of December 2020 at least 50% of their total weight. Civic Amenity Sites contracts for 5 company /10 CAS/ collection of separately collected packaging waste, paper, plastic, metal, glass, spent batteries, WEEE, bulky waste, hazardous waste and other waste from households included in the permits of companies.
