1. Vacation (Annual Leave) 1.1 Policy All employees are eligible for vacation (annual leave). Employees start to accrue vacation at the beginning of employment. Requests for time off in increments of less than four hours (doctor appointments, car repairs, etc.) are not part of the vacation programme and will be approved at your manager s discretion. 1.2 Procedure All employees should complete and submit a Holiday Leave Approval Request at least two weeks in advance to obtain approval from their supervisor. Vacation may be taken at any time during the calendar year. OCS reserves the right to deny requests for vacation. You may be required to schedule vacation significantly based on operational needs. 1.3 Vacation Entitlement Employees are entitled to 30 natural days of vacation per calendar year. Vacation leave starts the day requested and approved by the supervisor and are accounted from that day on and until the day before you are back to work. Public holidays are not accounted as holidays when they fall on the previous day of when the day is requested. No payments will be made in lieu of taking paid annual leave, except for accrued, unused paid annual leave at the time of termination. Vacation must always be taken in the same calendar year in which it is earned. OCS does not allow employees to carry forward unused vacation time into the next calendar year. If this time is not used within the same calendar year, it may not be reclaimed. The Director of Human Resources may authorize vacation days to be carried into the next calendar year. Department Heads or Directors may authorize an employee to use vacation time not yet earned. Vacation time used in this circumstance must be arranged with, and approved by your Department Head as far in advance as possible to accommodate business needs. If you are dismissed or resign, OBS will deduct from your final pay check any vacation time you have taken but not yet earned. If you are dismissed or resign after six months of eligible employment, OBS will pay you the amount of vacation time you have earned but not used as of the termination date. 3
2. Public Holidays OCS observes the holidays set in the labour calendar issued by the Comunidad de Madrid and the local holidays of the city of Madrid, both Torrelaguna and Barajas offices. OCS operates in a 24/7/365 services if you are required by your manager to work on a holiday, time off in replacement will be given to you. 3. Paid Time Off Employees, upon notifying the company and providing evidence upon request, will be entitled to paid time off for the following reasons and periods: 1. Maternity leave, including adoption: sixteen (16) weeks, two (2) additional weeks if the child is born with any disability. In those cases, where the birth is premature or the neonate needs to stay for several days at the hospital, the maternity leave will be extended for same number of days with a maximum of thirteen (13) additional weeks. 2. Paternity leave, including adoption: Twenty-eight (28) calendar days. Two (2) more days for each additional child born or adopted. Paternity leave can be taken immediately after the birth or adoption, simultaneously with the maternity leave or immediately after maternity leave ends. 3. Birth, adoption permit: two (2) days for the birth or the adoption of a child. 4. Fifteen (15) calendar days in case of marriage. 5. Two (2) working days for serious illness or decease of relatives up to the second degree. When for this reason, the employee should travel more than 200 kilometers each way, the duration of the paid time off will be four (4) days. 6. Four (4) working days in case of the decease of spouse, parents or children. 7. One (1) working day for relocation of main residence. 8. The minimum required time to comply with public nature personal duties, such as jury duty. 4
4. Work Schedules Reliable attendance on your part is essential to the success of our operation. As an employee of OCS, you are expected to report to work as scheduled. Regular attendance is an important factor in your performance, development and evaluation as it is a part of your personnel record. Accordingly, with the II Convenio colectivo de la industria de la producción audiovisual (Técnicos), OCS employees will be working 35 hours per week of effective work average in annual calculation. The total number of working hours per employee is approximately of 1605 on a yearly basis. The distribution of these hours is established through the Labour Calendar. In accordance with article 22 of the Collective Agreement, both parties agree that the employee will receive an availability bonus, as a wage supplement, which remunerates the employee s acceptance of the maximum legal day provided for in article 34.1 of the Workers' Statute, as well as to join their work or stay in it outside that day, when the needs of the service require. Both parties agree that with the receipt of this amount are paid both the fact of availability without the right to any other additional perception. In addition to what is regulated in the previous article, the specific characteristics of the works to be performed during audio-visual productions oblige to provide these shifts with a framework sufficiently flexible to enable it to be properly developed Night shift: Accordingly, with Article 36.1 of the Workers' Statute, night shift is done between ten at night and six in the morning. The company will reimburse a taxi fare if your shift starts before 6AM or finishes after 10 PM. Employees are entitled to 30 natural days of vacation per calendar year. Vacation leave starts the day requested and approved by the supervisor and are accounted from that day on and until the day before you are back to work. Public holidays are not accounted as vacation leave when it falls on the previous day of the start of your vacation. However, if there are public holidays within your vacation leave, they will be considered as part of your vacation and no time off will be offered in lieu. You are not allowed to break your vacation so ask to separate these public holidays. No payments will be made in lieu of taking paid annual leave, except for accrued, unused paid annual leave at the time of termination. 5
OCS operates in a 24/7/365 service. If you are required by your manager to work on a holiday outside your normal shifts, time off in replacement will be given to you. We are oriented as a project-based business, and thus, department and personal work schedules will vary. Your schedule will be assigned by your supervisor at least with two weeks in advance who will also specify appropriate times for breaks (although service needs may require exceptional changes in this arrangement). Fifteen minutes break during a six-hour working period are part of the working time. Any breaks longer than 30 minutes are to be rostered and unpaid. Your supervisor has the right to modify your work schedule as business needs demand. 6
