b) Resolution of appropriation to transfer $110,000 from the CIP Undesignated Fund Balance Account # 25300-401 to the Parks Account # 51200-401-601-51204 for the design and development of restroom improvements at various Park sites. These funds were received from the State Proposition 12 Grant award in 2002. SUMMARY On April 10, 2007 Council adopted a resolution authorizing staff to move forward with advertising and soliciting Proposals for Improvements at Various Park Sites, Specification #3215. In the subsequent weeks Staff conducted a Mandatory Pre-Proposal Meeting and responded to questions from prospective Proposers. Two contractors submitted responsive Qualifications and Pricing Proposals on May 30, 2007, and both were interviewed on June 7, 2007. TLD Construction Inc. scored the highest points on the City's interview scoring system and submitted the lowest Pricing Proposal 'as well. As a result, TLD Construction Inc. has been selected to complete the projects associated with Improvements at Various Park Sites, Specification #3215. Staffhas investigated the status oftld Construction Inc. license which is a General Contractor's license in good standing. Subject to Council's approval, the contract should be awarded to TLD Construction Inc. Upon approval of insurance documents, construction will begin toward the end ofjuly 2007 and finish in January of 2008 for grant funded projects, and April of 2008 for non-grant funded projects. A project schedule is attached as Exhibit 1. FISCAL IMPACT The proposed $110,000 Appropriation offunds will supplement the funds required to complete the design and construction ofrestrooms at various Park sites. From: CIP Undesignated Fund Balance Account # 25300 401 To: Parks Account # 51200-401-601-51204 Two Pricing Proposals were submitted to City Clerk's Office on Wednesday May 30, 2007: TLD Construction Inc. Cost Proposal $1,743,600 ICON WEST Inc. Cost Proposal $1,853,846 The total estimated project cost for the proposed improvements at all Park sites is $1,913,420 inclusive ofdesign, construction, soft cost, project management fees and contingencies. Funding for all project sites is available in the following accounts: 51200-401-601-51438 $800,419 51200-401-601-51204 (Prop. 12 grant funding) $863,001 51200-401-601-51497 - ADA Facility Modifications 05106 & 06107 $250,000 Total Available Budget.. $1,913,420 2

TLD Construction Inc. Cost Proposal. $1,743,600 Contingencies and project management costs $169,820 Total Project Cost $1,913,420 The planned improvement funding at New York, Glorietta and Pelanconi Parks is provided by State Proposition 12 Grant funds with construction completion deadlines ofmarch 2008. Construction at these three sites will be priority work and are scheduled for completion in January of 2008. Improvements at Dunsmore and Glenoaks Parks are funded by Parks CIP accounts (as noted above), and construction is estimated to be completed by April 2008 (Please see Exhibit 1.) BACKGROUND In an effort to comply with the City wide ADA/Title 24 accessibility improvement program, as well as life/safety and Public Health laws and regulations, staff has determined that the existing structures at New York Park (restrooms), Dunsmore Park (restrooms and community building), Glorietta Park (restrooms), Glenoaks Park (restrooms), and Pelanconi Park (restrooms) require various degrees of upgrade and renovation due to severe disrepair at the structure and deferred maintenance of these buildings. The scope of work at all noted Park sites focuses mainly on ADA/Title 24 improvements such as installation and construction of restroom fixtures, accessories and door hardware, resolving site related access compliance issues, as well as repair of various degrees of water damage/dry rot and termite damage at the existing structures. This includes repairs to the roof structures, roofing replacement, and general renovation ofthe restroom buildings and/or Community Buildings. Schematic Design (SD) level documents and outline technical specifications were prepared according to City standards by the Department and schematic design floor plans have been preliminarily reviewed by Public Works Building & Safety, Fire/Life Safety Section and the Environmental Safety Section. Project Description: All proposed improvements at noted Park sites include similar scopes of work: New York Park, Pelanconi Park, Glorietta Park restroom buildings and restrooms at the Glenoaks Community Building: ADA/Title 24 compliance modifications including installation and construction ofada compliant restroom fixtures, partitions and accessories, minor site accessibility work, improvements in plumbing systems, general repair ofwater damaged wood framing members, interior and exterior paint and lighting fixture replacement with high efficiency/vandal resistant fixtures. The scope of work at Dunsmore Park Community Building includes ADAITitle 24 compliance modifications and minor interior space reconfiguration of the existing Community Building in order to create compliant restrooms, installation of a compliant ramp to resolve site accessibility issues at Dunsmore Park, repairofheavy water damage/dry rot throughout the building, installation of new roofing, new HVAC system, improvements in plumbing systems, interior and exterior paint, replacement ofexisting lighting fixtures with high efficiency/vandal resistant fixtures, and general renovation ofthe building. Design-Build Approach: The design-builder team, consisting ofthe contractor and the architect, will work together to further develop the schematic design documents included in Specification No. 3215, and produce construction documents, such as: architectural plans, elevations and sections, structural, mechanical/electrical/plumbing plans, calculations and schedules, and other construction documents as necessary to complete the planned Improvements at Various Park Sites. 3

FOR THE DESIGN AND CONSTRUCTION OF IMPROVEMENTS AT VARIOUS PARKS (SPECIFICATION NO. 3215) WHEREAS, in an effort to implement the City-wide accessibility improvement program, to comply with the Americans with Disabilities Act ("ADA") and California's Title 24, and to conform to current life, safety, and public health laws and regulations, the Parks, Recreation and Community Services Department ("Parks Department") determined that the existing structures at New York Park (restrooms), Dunsmore Park (restrooms and community building), Glorietta Park (restrooms), Glenoaks Park (restrooms), and Pelanconi Park (restrooms) require various degrees of improvement, renovation, and upgrade; and WHEREAS, the scope ofwork at all noted Park sites focuses on not only ADA/Title 24 improvements- such as installing ADA compliant restroom fixtures, accessories and door hardware; andimprovingaccess to the sites- butalso repairingwaterdamage, dry rotandtermite damage at the existing structures; replacing the buildings' roofand framing members; and general renovation ofthe restroom buildings and community buildings; and WHEREAS, on April 10, 2007, the Council adopted Resolution No. 07-65, approving Specification No. 3215, "Request for Qualifications and Proposals for the Design and Construction of Improvements at Various Parks"("RFQP"), and authorizing the City Clerk to advertise for proposals for the professional design services, labor, materials, and equipment described in the Specification; and WHEREAS, on April 23, 2007, the Parks Department issued the RFQP, and the deadline for submitting a proposal was May 30,2007; and WHEREAS, on May 30, 2007, Parks received 2 responsive Qualifications and Pricing Proposals, from the following firms: 1. TLD Construction, Inc., Glendale, CA; 2. ICON WEST, Inc., Los Angeles, CA; and WHEREAS, the Parks Department engaged in a detailed process of evaluating the Proposals; and both firms were interviewed on June 7, 2007; and WHEREAS, TLD Construction, Inc. scored the highest points on the Park Department's interview scoring system and the firm submitted the lowest Pricing Proposal as well; and WHEREAS, the Parks Department has investigated the status oftld Construction Inc.'s license, which is a general contractor's license in good standing; and 5 E 1

WHEREAS, to meet the needs ofthe community, it would be in the best interests ofthe citizens to engage in a design/build process to reduce the time to complete the needed ADA/Title 24 facility improvements, renovations, and upgrades and to reduce the costs thereof; and WHEREAS, the projectrequires specific expertise in engineeringand design, andthe project is intended to be a full turnkey project from design to ultimate use; and WHEREAS, it would appear, therefore, that given the professional teclmical expertise needed to properly design, engineer and construct the improvements, renovations, and upgrades at the various Park facilities it wouldbe in the best interests ofthecity-upon recommendation ofthe Director ofparks, Recreation and Community Services- that the project be awarded as a unitary design and build to TLD Construction, Inc.; NOW, THEREFORE, BE IT RESOLVED by the Council ofthe City ofglendale: SECTION 1. That pursuant to Charter Article VI 9 and State law, the Council hereby: A. Accepts and approves TLD Construction, Inc.'s Proposal for the total sum of$i,743,600; B. Authorizes the City Manager or his designee to execute an agreementsubject to the CityAttorney's approval- with TLD Construction, Inc. for the design and construction (Design/Build) ofimprovements at various parks, as set forth in Specification No. 3215; and C. Approves a reserve for contingencies and project management costs in the amount of$169,820. SECTION 2. The Council hereby rejects all other Proposals. Adopted this day of, 2007.
