1. Introduction, requirements 1.1 Introduction MABS National Development was established in 2004 to support and develop the Money Advice and Budgeting Services (MABS) nationally. MABS National Development has expanded over time to include the MABS National Helpline, MABS Information System, Money Management Education, Projects Development, Learning and Development, Social Policy and Communications and Casework Technical Support functions. Recent projects of note include the design, development and implementation of the Approved Intermediary Service throughout the MABS network and the Dedicated Mortgage Arrears advisory service for borrowers in late stage mortgage arrears. The Casework Technical Support function provides specialist support to MABS money advice staff on a wide range of complex casework issues including legislation and regulation, rights and entitlements, policies and procedures and new casework processes. 1.2 Purpose of Request for Tenders (RFT) MABS National Development invites tenders for a Project Manager in the area of Social Welfare casework support. MABS National Development reserves the right to engage one or more firms if and when required for particular categories of work, or for individual matters, and to re-assign to another service provider category of work or individual matters as and when it considers appropriate. 1.3 Timeframe We would expect the contract to commence in July 2017. 1.4 Freedom of Information Tenderers are asked to consider if any of the information supplied by them should not be disclosed because of its sensitivity. If this is the case, tenderers should, when providing the information, identify same and specify reasons for its sensitivity. MABS National Development will consult with tenderers about sensitive information before making a decision on any Freedom of Information request received. Please see section 2.5 in relation to the notification of scores to unsuccessful tenderers. 2

If tenderers consider that none of the information supplied by them is sensitive, they should make a statement to that effect. Such information may be released in response to a Freedom of Information request. Each application under Freedom of Information is evaluated on its individual merits. 1.5 MABS NATIONAL DEVELOPMENT CLG requirements MABS National Development is seeking a Project Manager (PM) in the area of Social Welfare Casework Support. Base location for the project is the office of MABS National Development. The PM will: 1.5.1 Casework Technical Support Respond to queries from MABS staff in the areas of Social Welfare legislation, systems, practice and procedure. Support may be sought by MABS staff by telephone and/or email. Responses must be provided by email within 24 hours of receipt of the query and recorded on a database developed for this purpose and accessible to nominated staff within MABS National Development. All documentation developed or used in the course of a query response shall be provided to MABS National Development and shall be stored centrally for the use and benefit of MABS National Development and MABS services nationwide. MABS National Development reserve the right to further develop any and all such documentation for the benefit of the organisation. MABS National Development have developed a range of policies and procedures for MABS staff. It is expected the PM will gain a knowledge and understanding of the content of these policies and procedures and, where applicable, will have regard thereto when providing advices. 1.5.2 Policy Advancement The PM will, through the provision of Casework Technical Support as outlined in paragraph 1.5.1 through their own knowledge and information available to them, be capable of identifying key policy issues of relevance to present and future clients of the MABS organisation. The PM will be responsible for developing discussion papers and submissions in response to these key policy issues in conjunction with staff of the MABS organisation, including MABS National Development. 1.5.3 Training and Development The PM will analyse the queries and responses to Casework Technical Support as outlined in paragraph 1.5.1 to establish and document the level of baseline expertise which exists currently in MABS National Development and the MABS national organisation in the respective roles which exist within the organisation. Based on the 3

current level of expertise, the PM will identify additional requirements and document same to the satisfaction of the Business Manager of MABS National Development or nominated person. The PM will develop a programme of training, support and assessment with a view to building internal capacity in both MABS and MABS National Development across all aspects of Social Welfare casework relevant to the organisation on a measurable basis. During the course of the project the PM will be required to up-skill key personnel in MABS ndl so that they have the ability to support complex casework in this area. This will be done over the course of the project through establishing a baseline level of expertise and building competence to an agreed level. The increasing capability of staff in this regard will be measured over the course of the project. 1.5.4 Resource Development Based on the provision of Casework Technical Support as outlined in paragraph 1.5.1, and Training and Development as outlined in paragraph 1.5.3, the PM will develop a series of casework resources, including but not limited to a Social Welfare Appeals Toolkit, for use by staff of the MABS organisation in the course of their work. 1.5.5 Reporting The PM will be expected to provide regular reports to various stakeholders within the MABS organisation, including but not limited to: 1) Report periodically to a Steering Group on progress in respect of work undertaken in fulfilment of this project; 2) Report to the Business Manager on a quarterly basis; 3) Provide inputs to the Business Manager for the Annual Report; 4) Other reports as may be required and communicated to the PM. 2. Tender process 2.1 Query handling Queries concerning this RFT should be emailed to tenders@mabs.ie before 02 June 2017. Details of queries and answers will be distributed to all prospective vendors, without attribution of source. 2.2 Timing of award 02 June 2017 (12 noon): Closing date and time for queries to this tender. 4

09 June 2017 (5pm): Closing date and time for receipt of tenders. 12 June 2017 (12 noon): Tender opening and evaluation. 2.3 Contract award / termination MABS National Development reserves the right not to proceed with the awarding of a tender contract. MABS National Development does not bind itself to accept the lowest or any tender. MABS National Development also reserves the right to reject in whole or in part, any or all tenders received. MABS National Development reserves the right to tender again or to terminate the contract at any stage. In the event that the contract must be revised or abandoned, provisions will be made by MABS National Development for the termination of the contractor(s) or proposed associates contract on payment of reasonable and agreed costs accrued to the date of termination. 2.4 Format of tender To assist in the evaluation process, potential contractors must structure their tenders in such a way that they match the overall structure of this section. The tenders should address, on a numbered point-by-point basis, each of the following points 1-7. General Information 1. Name, address, telephone number and email address of tendering company. Name of person within tendering business dealing with the tender process. Confirmations 2. Confirmation of acceptance by the tendering company and any third parties of the conditions described in section 3 General Conditions of Tender - below. 3. Confirmation of compliance by tendering company and any third parties with the qualification criteria detailed in Council Directive 2004/18/EC (see Appendix A). 4. Confirmation that the tendering company can meet MABS National Development requirements as set out in section 1.5. 5

Previous experience 5. Details of 3 contracts undertaken within the last 3 years demonstrating successful contract delivery and including a brief outline of why the contract was similar to the enquiry of this RFT. Method statement 6. A method statement describing a proposed approach to meeting MABS National Development s requirements as set out in section 1.5. Proposed resources 7. Details of the individual/s who will be assigned to the provision of these services. Tenderers must demonstrate that they have the level and depth of expertise to provide high quality services in relation to the requirements as set out in section 1.5 of this RFT. The following details should be provided in relation to staff assigned Relevant Qualifications and training Length of time with company and time in current position Nominated professional Experience and role with agencies/companies similar to MABS National Development and the wider MABS network Experience in the area or areas generally Availability of appropriate substitutes Interested tenderers should also provide information on their management approach, policies and procedures to ensure high quality responses and prompt issue resolution. Tenders should be emailed to tenders@mabs.ie. The deadline for the receipt of tenders is 09 June 2017. Tenders that are delivered late will not be considered. The tendering party is fully responsible for safe timely delivery of the tender. 6

2.5 Acceptance and award criteria Acceptance criteria Tenders will be examined, in the first instance, by reference to the following acceptance criteria: a) Completeness of tender documentation as specified in section 2.4 above. b) Provision of 3 examples of previous experience as requested in section 2.4 above. c) Compliance with Article 45 of Council Directive 2004/18/EC. A statement from the tendering company that none of the excluding circumstances (an extract is set out in Appendix A below), applies to them or, if appropriate, to any third party, must be submitted. Note: It is intended that only those tendering parties that meet the above qualifying criteria will be eligible for inclusion in the award process. Explanation of Award Criteria and Instructions to Tenderers The awarding of a contract or contracts will be based on the most economical advantageous response to this Request for Tender and based on the following points: Capacity to provide services of a specialised nature. Interested tenderers should confirm their staff members to be assigned to the contract with clear details of their roles and responsibilities. The following details should be provided in relation to staff assigned Relevant Qualifications and training Length of time with company and time in current position Nominated professional Experience and role with agencies/companies similar to MABS National Development and the wider MABS network Experience in the area or areas generally Availability of appropriate substitutes Interested tenderers should also provide information on their management approach, policies and procedures to ensure high quality responses and prompt issue resolution. The responsibility is on the professional service provider to provide sufficient information to enable MABS National Development to facilitate the evaluation. Relevant Experience Knowledge of legislation and practice related to the disciplines outlined in section 1.5 is essential. Interested tenderers should have relevant experience for providing professional services of high quality and achievement Social Welfare law, regulation and practice and with agencies/companies similar to MABS National Development and the MABS national network. MABS National Development reserves the right to contact reference sites listed in the submissions to this Request for Tender to obtain relevant information. The interested tenderers should facilitate this process and indicate agreement in their submission to this Request for Tender. Experience of working with vulnerable persons and groups and progressing a social policy agenda would be an advantage, but not compulsory. Method Statement A detailed statement describing a proposed approach to meeting MABS National Development s requirements as set out in section 1.5. 8

Cost and Schedule of Rates MABS National Development expects competitive prices for the service and all associated costs. The contractual terms must specify all costs and terms including support services and associated costs. The terms of any appointment will be on a daily basis and the general requirements of the request for tender will apply. All fees and charges must be quoted in Euro ( ) and details of fees and invoicing arrangements should be included. All tenderers should specify the daily fee rates applicable to each person being nominated to provide the required advisory services in cases of additional or projectbased work being required. Tenderers should also propose a blended Rate for Services All other charges should be specified in terms of the amounts / rates involved and the basis of their application. Fees and charges quoted should be exclusive of VAT; the applicable VAT rate should be quoted separately. Interested tenderers must provide a schedule of unit cost rates to include for each of the levels of service to be provided. Tenders should clearly indicate any discounts to which MABS National Development may be entitled. Additional Information Tenderers are free to furnish any additional information which they so wish in support of their tender Quality of Response MABS National Development request a good quality of response that is accessible and readily comprehensible any and relevant expertise. This should be supported and confirmed by satisfactory references. Tenderers should demonstrate that they have the knowledge, skills and technical expertise to deliver the required services as outlined in section 1.5. 2.6 Financial arrangements 2.6.1 Payment for all services covered by this invitation to tender will be on foot of appropriate invoices. Invoicing arrangements will be agreed with the successful supplier, following the award of contract. Please note that the payment of 9

invoices by MABS National Development is governed by the Prompt Payment of Accounts Act, 1997 as amended by the European Communities (Late Payment in Commercial Transactions) Regulations 2002. In addition to this legislation, the Government has approved formal arrangements to ensure that penalties will accrue if payment period by wider public sector to their business suppliers exceeds 15 days after receipt of invoice. Interest is calculated in respect of the period starting on the date after the due date and ending on the date when payment is made. MABS National Development will deduct Professional Services Withholding Tax where relevant. 2.6.2 Prices and terms quoted should hold good for at least six (6) calendar months from the final date for receipt of tenders. Similarly, terms and conditions cannot be altered during the currency of the contract. 2.6.3 MABS National Development retains the right to withhold payment where a contractor has failed to meet its contractual obligations in relation to the delivery of goods/services to an acceptable level of quality. 3. General Conditions of Tender 3.1 MABS National Development does not bind itself to accept the lowest or any tender. It reserves the right to reject in whole or in part any or all tenders received and to source the requirement from more than one supplier or contractor. 3.2 Detailed contractual arrangements are not within the scope of this Request for Tenders. However, the following condition should be noted: any conflicts of interest involving a contractor must be fully disclosed to MABS National Development, particularly where there is a conflict of interest in relation to any recommendations or proposals put forward by the tendering MABS National Development. 3.3 In the event of a group of bidders jointly submitting an acceptable offer, MABS National Development will award the contract to one contractor who acts as the agreed prime contractor. The prime contractor is responsible for the delivery of all services provided for under the terms of the contract and shall assume all the duties, responsibilities and costs associated with the position of prime contractor. 3.4 It is the intention of MABS National Development to enter into formal contractual relations with the successful tendering MABS National Development. Details of the proposed contract will be discussed with the successful tendering MABS National Development prior to signing. Your tender may form a schedule to the contract. 10

3.5 MABS National Development will not be liable in respect of any costs incurred by companies in the preparation of their tender in response to the Request for Tenders, nor for costs incurred in preparing subsequent presentations or for attendance at same. 3.6 The successful tendering company shall be responsible for the delivery of all requirements provided for within the contract on the basis of a fixed price agreement set at the beginning of the contract. Prices quoted in the tender cannot be increased during the currency of the tender. Similarly, terms and conditions cannot be altered. 3.7 Please allow for all costs in your pricing including expenses, extra visits or exceptional costs as MABS National Development will not accept extra charges above the contract price. In the event that you wish to charge MABS National Development for what you consider an exceptional item, it will only be considered if it is raised prior to the commencement of work, in which case a separate contract will be agreed. 3.8 MABS National Development requires that all information provided pursuant to this Request for Tenders will be treated in strict confidence by the tendering companies. 3.9 Information supplied by tendering companies will be treated as contractually binding. However, the MABS National Development reserves the right to seek clarification or verification of any such information. 3.10 Prices and rates quoted should be expressed in euro ( ) and exclusive of VAT. The VAT rate(s) applicable should be indicated separately. 3.11 MABS National Development reserves the right to withhold payment where a contracting company has failed to meet its contractual obligations in relation to the delivery of goods / services to an acceptable level of quality. 3.12 MABS National Development reserves the right to go to tender again or to terminate the contract at any stage on payment of reasonable and agreed costs accrued to the date of termination. 3.13 Tenders that are received late will not be considered. In this regard it is important to note that tenders must be received at the email address specified above not later than 09 June 2017. The onus is solely on the tendering company and their agents to ensure delivery by the specified time to the specified address. 3.14 Tenderers should note that the MABS National Development may, when notifying unsuccessful tenderers of the results of this procurement competition, include the scores obtained by the tenderer concerned and the scores obtained by 11

the preferred bidder in respect of each award criterion assessed by MABS National Development. 3.15 The work of the contractors shall be deemed to be carried out in Ireland and shall be governed by the laws of Ireland. 3.16 Before a contract is awarded, and where required the successful contractor (and third parties, where appropriate) will be required to promptly produce a valid Tax Clearance Certificate. The Certificate must remain valid for the duration of the contract. 3.17 Where a Tax Clearance Certificate expires within the course of the contract, MABS National Development reserves the right to seek a renewed certificate. All payments under the contract will be conditional on the contractor(s) being in possession of a valid certificate at all times. 3.18 Payment for all services covered by the Request for Tenders will be on the foot of appropriate invoices. Invoicing arrangements will be agreed with the successful tendering MABS National Development following the award of the contract. 3.19 The successful tendering MABS National Development may be required to comply with the requirements of the Data Protection Acts in relation to the processing of any personal information that may be necessary in the context of service delivery. This will require the MABS National Development to sign a form of undertaking to comply with the provisions of the Acts. 3.20 Any registerable interest involving the contractor and the Minister for Social Protection, members of the Government, members of the Oireachtas, employees of Citizens Information Board or Citizens Information Centres, or employees of MABS National Development or their relatives must be fully disclosed in the response to this Request for Tenders, or should be communicated to MABS National Development immediately upon such information becoming known to the contractor, in the event of this information only coming to their notice after the submission of a bid and prior to the award of the contract. The terms 'registerable interest' and 'relative' shall be interpreted as per section 2 of the Ethics in Public Office Act 1994. 3.21 MABS National Development will remain the sole and exclusive owner of all end products and of all intellectual property rights in the products supplied to and from MABS National Development in the course of the contract, irrespective of whether or not the contract is terminated prior to its completion. 12

3.22 The successful tendering MABS National Development must hold adequate insurance to undertake the required services on behalf of MABS National Development. MABS National Development will accept no liability for any loss or damage incurred during the performance of the contract. 13

Any economic operator may be excluded from participation in a contract where that economic operator: (a) is bankrupt or is being wound up, where his affairs are being administered by the court, where he has entered into an arrangement with creditors, where he has suspended business activities or is in any analogous situation arising from a similar procedure under national laws and regulations; (b) is the subject of proceedings for a declaration of bankruptcy, for an order for compulsory winding up or administration by the court or of an arrangement with creditors or of any other similar proceedings under national laws and regulations; (c) has been convicted by a judgment which has the force of res judicata in accordance with the legal provisions of the country of any offence concerning his professional conduct; (d) has been guilty of grave professional misconduct proven by any means which the contracting authorities can demonstrate; (e) has not fulfilled obligations relating to the payment of social security contributions in accordance with the legal provisions of the country in which he is established or with those of the country of the contracting authority; (f) has not fulfilled obligations relating to the payment of taxes in accordance with the legal provisions of the country in which he is established or with those of the country of the contracting authority; (g) is guilty of serious misrepresentation in supplying the information required under this Section or has not supplied such information. 14
