HOLD HARMLESS CLAUSE: The Bidder(s) to whom award is made is responsible for any and all injury to the public and to individuals; for all loss or damage arising from any unforeseen obstructions or difficulties, either natural or artificial, which may be encountered in the removal of the property; for the damage to property resulting directly or indirectly from the removal; for damage from any action of the elements prior to completion of the removal while on MTA property; for damage from any act or omission (including, but not limited to practice, error, or mistake) on the part of the Bidder, and the Bidder shall defend, indemnify, and hold the MTA free and harmless from and against any and all losses, liabilities, expenses, claims, costs, suits, and damages therefore. 16.
