Terms and conditions for booking and taking the Professional Skills Tests Please read these Terms and Conditions of Use ('Terms') carefully before booking your Professional Skills Test at https://www.skillstestbooking.com (referred to below as the 'Website'). Part A applies to all users of the website Part B applies if you register for a Professional Skills Test account Part A 1. Terms applying to all users of the Website Please read these Terms carefully before using the website. Additional terms and conditions apply if you register for a Professional Skills Test account (Part B). In these Terms, 'we', 'us' and 'learndirect' means: learndirect Limited Dearing House, 1 Young Street, Sheffield, S1 4UP which is the owner of this website and the learndirect mark, and 'you' means the user of this website. We reserve the right to withdraw all or part of the Website at any time. By using this Website you agree to be bound by these Terms, the Privacy Statement and the Copyright Statement. You acknowledge that you are responsible for making backup copies of all your data and taking appropriate precautions against viruses, hacking and other types of computer misuse. Whilst we try to ensure that the website does not contain any error, defect, malfunction or corruption, we do not accept responsibility for any damage to or loss of data on your computer system, network or server that results from the download or use of the website or any materials made available via the website (except for death or personal injury caused by our negligence). We cannot promise that access to the Website will be uninterrupted or error free. We shall not be liable to you for any of the following types of loss or damage arising out of or in connection with your use of the Website or any content and/or facilities provided via the Website:

any loss of profits, loss of earnings, loss of anticipated savings, goodwill or revenue; any loss or corruption of data; or any indirect or consequential loss. The exclusions and limitations of liability contained in this section do not apply to: any loss or damage resulting from death or personal injury caused by our negligence; loss or damages arising from our fraudulent misrepresentation; or any other losses which may not be excluded or limited by law. If either we or you fail to enforce, or delay in enforcing, any of our respective rights or remedies under these Terms, such failure or delay shall not operate as an agreement to waive that right or remedy, and shall not prevent us from exercising that right or remedy in future. These Terms are governed by and shall be construed in accordance with English law. Any dispute arising between us under or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the English courts. 2. Purpose of the website The purpose of the Website is to allow individuals to book the Professional Skills Tests, including registration. 3. Copyright The materials on this website are protected by our copyright and other intellectual property rights as described in the Copyright Statement. 4. Third Party Links We may provide links to third party websites from time to time. This may include links to sites owned by associated companies of learndirect. Any links are provided for your convenience only and are accessed at your own risk. We are not responsible in any way for the content of any third party website or for goods or services provided by the operators of such websites and, unless otherwise stated, are not responsible for and do not endorse or recommend any third party website or its availability or contents or any agreement or understanding you enter into with a third party through a third party website. Amendments to the Terms We reserve the right to amend these Terms from time to time. When we make a change we will update this page of the website. If we do so, the updated version will be effective as soon as it is uploaded on to this

website. The date of the last revision to these Terms is provided at the end of the Terms. We recommend that you visit this page each time you visit the website to ensure that you are aware of and are complying with any changes that we have made to these Terms. If you continue to use the Website you will be deemed to have accepted those changes from the point at which these changes come into effect. 6. Confidentiality It is a condition of taking any Professional Skills Test that you agree to keep the content of the test private and confidential and that you do not share any questions or other content (wholly or in substance) with any other person. In particular, (but without limitation) you shall not discuss or publish the content of any test in person or in any publication, communication or forum, including any internet forum. 7. Part B Terms applying if you register for a Professional Skills Test Account Please ensure you've understood the answers to these questions. 1. How soon can I take my test? The earliest you can take your test is one working day from when you book your test, subject to availability on the booking system. You should be able to book a test within the next ten working days. 2. Can I change the time and date of my test? You can cancel or change the time and date of your test up to three working days before your test and you will not have to pay a charge or lose your first free attempt. If you cancel or change the time and date within three working days of your test, you will have to book and pay for a new test time. If the test you are changing was your first attempt (and therefore free of charge), no further free tests in that subject area will be offered. If you paid a fee for the test you are changing, we will not refund the fee for the old test. If you book a test that is scheduled within three working days from the date you made your booking, you will not be eligible for a refund if you cancel your test. 3. Can I take a test outside the UK? Test facilities outside the UK are available in Madrid, Paris and Frankfurt. 4. Why does the information I've given during registration have to be exact? The information you give when you register for a test must be an exact match to the ID and any required evidence presented on the day of your test. It will also appear on your results letter. If your ID does not match the information given upon registration, you may not be able to take your test. Your results letter will also record when you took your test. 5. What ID do I have to bring to the test? You must provide two forms of identification at the test centre, one from each of the two groups below. In addition, applicants to Initial Teacher Training (ITT) will need to provide evidence of their application. The Evidence of Submitted Applications document provides further guidance on what this might include. It is important that the ID presented when you attend the test appointment exactly matches the details entered during the registration process. If there are any discrepancies you may not be permitted to take the test. The only exception to this is if your ID displays your middle name(s). Middle names will not be taken into account by the test centre staff and you will be allowed to test providing the first name and surname of the ID matches the name of the registered account. The ID you bring to the test must be an original document (photocopies or printouts will not be accepted). Primary ID The following can be accepted as primary ID; it must be valid and include a photograph, name and signature: Passport* EU photo card driving licence (full or provisional) European national identification card UK student card/ student union card Completed alternative ID form** * A passport can be accepted as a primary form of ID even if it does not have a signature, as long as it is determined to be valid and there is no designated place for a signature, for example, a biometric passport.

** An alternative ID form can be completed prior to taking the test if the candidate does not have suitable official ID. Forms are available to download from this page. Secondary ID The following can be accepted as secondary ID; it must be valid and include a name and signature: A debit or credit card UK armed forces ID Any ID from the primary list which has not been used already as primary ID All candidates are required to sign in at test centres. The signature will be verified against both primary and secondary ID. If you have changed any part of your name since registering for the tests, you must bring evidence of your name change, for example: marriage certificate, deed poll or other legal documents. Without one of these documents, you will not be able to take your test and your test fee will not be refunded (if applicable). A test supervisor will check your ID to make sure that: the photo is a true likeness of you; it is in date (if this applies); and the details you have given during registration are correct. If any of the details are not correct, or if the test supervisor believes that the photo on the ID does not look like you, we will not allow you to take your test and you will not get a refund (if applicable). 6. Can I take practice tests? Yes. Online practice tests are available at www.education.gov.uk/skillstests. You can take these practice tests as many times as you want. The result will not affect the result of your Professional Skills Test. 7. Can I take notes while doing my test? You can take notes only once your test has started. However, you must hand these notes over to the test supervisor before you leave the test room and we will then destroy them. If you don t hand the notes over to the test supervisor, you will automatically fail your test. The test terms and conditions will be available to you on the day of your test. You must keep to them or we will ask you to leave and you will not receive a refund (if applicable). 8. How and when will I get my test result? At the end of your test session we will give you a results letter. This will tell you if you have passed or not. It is your responsibility to make sure that you receive your results letter and that you keep this letter safe. Please don't leave the test centre until we give you your results letter. If you do, we will destroy your results letter and will not offer a refund of the test fee (if applicable). Your results will also be available with the My Account section of your registration pages no more than 48 hours after you have taken your test. Your ITT provider will also be able to access your test results.

9. If I lose my results letter, can I get a replacement? No. Your results letter is an important document. Please keep it safe as we will not replace it if you lose or damage it. 10. What if I can't finish my test because of computer problems? The majority of skills tests are completed without any technical issues but, as with any computer system, there is a risk of an error occurring. If an issue does arise with your computer, you should inform the test supervisor who will act quickly to ensure that you suffer minimal disruption to your test. This may involve restarting the test and relocating you to another machine. If for any technological reason you can't complete your test, you can do the test again without having to pay again. 11. What happens if I break the rules of the test? Violent or aggressive behaviour will not be tolerated within our test centres. If you attempt to cheat in any of the following ways, you will automatically fail your test. We will report this to the Department for Education and it may affect your application. Taking the test for another person Re-registering on the registration site in order to circumvent the 3 attempts rule Using any materials (electronic or printed) during the test, other than those provided by the test centre Writing notes before you have started the test Copying any part of the test (electronically or in text format) and removing it from the test centre Not handing over any notes you have made during the test to the test supervisor prior to leaving the test room Intimidating staff with threats or violent behaviour to either enable you to take your test or influence your test result Offering bribes to test centre staff to influence your result Using any other method to persuade test centre staff to influence your test result Speaking to other candidates during the test Looking at other candidates' screens during the test Using any electronic communications device If we think any of your behaviour is criminal, we will report it to the police and the Department for Education. The test centre also has the right to remove you from your test session and cancel your test. They may also request that you do not book a further test at their centre. If you have acted in one of the above ways, you have no right to a refund. 12. What will happen if the registration, booking and test systems are not working? Sometimes we have to interrupt access to the registration, booking and test systems for emergency maintenance or repairs, or to carry out upgrades to improve the systems. We may also interrupt access due to failures of telecommunication links and equipment which are beyond our control. In this situation you will not have a claim for breaking the contract (either against us or the test centre) or otherwise because the system was not available.

We will not be legally responsible to you for any of the following types of loss or damage arising out of, or in connection with, not taking the Professional Skills test. Any loss of profits, loss of earnings, loss of anticipated savings, goodwill or revenue Any loss or corruption of information Any indirect or resulting loss 13. How can I make a complaint? Please note that we will not normally investigate complaints more than three months after the incident occurred. Please do not come to this address in person as there will be no one here to see you. 14. Who will store my personal information? The Department for Education is responsible for any personal information you have provided when registering to take the test. We at learndirect process this information for the Standards and Testing Agency. We hold this information securely and transfer it to the Department for Education. For information on how the Department for Education uses this information and how long they keep it, please contact the Department for Education http://www.education.gov.uk/help/contactus. We will keep the registration information you have provided, plus the date of your test and your test outcome for seven years for audit purposes and to help prevent fraud. We will also keep your information for as long as we need to for the purposes we collected it for, or if this is needed by law or to enforce or defend legal claims. We will not transfer this information to anyone else, unless we have to do so by law or in connection with legal proceedings. We will combine the information from the tests to provide reports on, for example, pass rates, number of tests taken and so on. Nobody will be able to identify you personally from this information. 15. I only have one legal name, how do I register for the test? If you only have one legal name, your chosen method of ID should reflect this. In order to register for the test you must insert your one legal name twice (once in the first name field and again in the last name field). This will allow you to complete registration. If you don't do this, your test will be rejected at the test centre and you will not receive a refund of your test fee (if applicable).

16. What if I disagree with these terms and conditions? These terms are governed by English law. Any dispute arising between you and us under or in connection with these terms shall be subject to the non-exclusive jurisdiction of the English courts. These terms constitute the entire agreement between us in relation to the provision by us to you of the Services, and they replace and supersede any prior arrangements between us in relation to the Services. You acknowledge that you are not relying on any statement made by us or any of our representatives with regard to the Services other than those expressly set out in these Terms. Nothing in this Paragraph shall exclude or restrict our liability for fraud or fraudulent misrepresentation. The agreement between us which is comprised of these Terms and is not intended to be for the benefit of any third party, and shall not be exercisable by any other person under the Contracts (Rights of Third Parties) Act 1999 or otherwise. The continued use of the website following any changes to the Terms will mean that you accept such changes.

Alternative photo ID form The purpose of this form is to confirm a candidate s identity. This form should only be used if the candidate cannot provide an acceptable photo ID from the list published on the Department for Education website (www.education.gov.uk/teachskillstests). Section B - To be completed by the headteacher / deputy headteacher of the school at which the candidate is enrolled / employed / training or a senior faculty member at the candidate s training provider. Where this is not applicable, the counter signatory must have known the candidate for more than two years and confirm that the information given on this form is correct. PROFESSIONAL SKILLS TESTS: EVIDENCE OF SUBMITTED APPLICATIONS PLEASE NOTE - THIS ONLY APPLIES TO CANDIDATES WHO HAVE BOOKED ON THE SKILLS TESTS ENTRY PROGRAMME. Applicants to initial teacher training (ITT) courses are now required to pass the skills tests before starting their course. They must submit an application for ITT before they are eligible to take the tests. ITT applicants should present evidence of their application at the test centre. Failure to provide evidence may result in candidates being prevented from taking the test. The types of documents that are acceptable are: a welcome letter from a teacher training organisation such as UCAS Teacher Training or Teach First; email correspondence from a teacher training organisation, or Teach First; correspondence from a school or training provider; a copy of a completed application UCAS form; confirmation of, or invitation to interview from a teacher training organisation, training provider or school. The examples listed above are for general guidance, they are not an exhaustive list, definitive or prescriptive. Candidates are required to present one proof of application when attending test appointments. All versions of evidence are permitted whether they are an original copy, photocopy or displayed on a hand held device.
