We are in a strong position to offer a competitive bid on EuropeAid/130009/C/SUP/RS, but I wanted to make sure I am understanding the Tender Offer correctly that United States companies are not eligible to bid? We also have an office in Switzerland - is our Swiss affiliation also ineligible to bid? Legal persons from either the United States or Switzerland are not eligible to bid. Participation in tendering is open to all legal persons participating either individually or in a grouping (consortium) or tenderers which are established in a the Member State of the European Union or in a country or territory of the regions covered and/or authorised by the specific instruments applicable to the IPA programme under which the contract is financed. 2. 3. 4. According to Instruction to Tenderers point 4.1, goods must originate in a Member State of the EC or a country covered by the IPA programme. According to Technical Specification, most of clothing and footwear for operations in all weather conditions must be made by USA Company 5.11 Tactical. Their products are made in countries, which are note Member States of EC or a country covered by the IPA programme. Also the requirements for these items are made only for one company / manufacturer and limit competition. So, we would like to get clarification if: - Products made in other countries (non member of EC or IPA programme) will be accepted? - Similar products to 5.11 Tactical will be accepted? If yes, please be so kind to present detail technical specification for these items. What kind of interface (for data transferring) is at the border stations - for vehicles - for railway for the contractor available, and can be this interface also used for transferring the data s to the Customs Headquarter in Belgrade? What is the distance (in m) between the RPM s and operator room/interface at the border stations for - vehicles - trains All works, supplies and services must originate in one or more of the countries mentioned in Article 3.1 of the Instructions to Tenderers. As indicated in the Tender dossier, Technical Specifications Annex II and III, page 13, clothing and footwear are to be of 5.11 or 9.11 standard, i.e. or of equivalent standard and quality to 5.11 or 9.11 Tactical. All border stations are connected to the Customs Headquarters in Belgrade via an intranet network which will be used for transfer of data in the case of RPMs. A simple ethernet switch will allow connection to the network. The distance between the RPMs and network/interface router will be anywhere up to 100 meters. 08SER01/06/41 2/12

5. 6. 7. What is the distance (in m) between the telecom room (where the interface is) to the operator room in the Customs HQ (Belgrade)? Is it possible that the Contractor will get access to use the existing infrastructure of the network (via patch cables) in the Customs HQ (Belgrade) for this data transfer? Is a power supply of 240 V/AC at any foreseen place, where the RPM should be installed (vehicles and Railway rail) very close available? It is a telecom network that connects border crossings with the operator room at Customs HQ in Belgrade. The distance between the RPMs and network/interface router will be anywhere up to 100 meters Yes. Yes. Exact location at below border crossings will be determined by technical experts on the part of the supplier/contractor. 8. Are the places for the RPM s already chosen or is this choice belonging to the Contractor? In case that the place for the RPM is chosen, than on which Railway rail (incoming Railways or single rail or double rail) should be the RPM installed in - Subotica - Ristovac/Presevo - Dimitrovgrad - Sid Exact location will be determined by technical experts on the part of the supplier/contractor. 10. Lot Should be the RPM for the railway in front of the station (how far?) or just before the station installed? Exact location will be determined by technical experts on the part of the supplier/contractor. We would like to participate in this tender for and therefore we kindly ask you for the permission for visiting the sites of the following borders: Freight Vehicle Traffic 1-Batrovci 2-Presevo 3- Kelebija Not applicable. Site visits are not envisaged. 11. Railway Traffic 1-Subotica 2-Ristovac-Presevo 3-Dimitrovgrad Our planned dates will be from 4-9 October 2010 for visiting the borders with our technical staff. Please let us know what kind of information you will need from us for the permission (names of visitors, passports of visitors and car registration) and if the date will be accepted. 08SER01/06/41 4/12

In case it is not, could you inform me if there is interest from Serbia Government to measure electromagnetic coming from as example, Mobile phone base station. The equipment appears to be specified around one particular manufacturer; please confirm if alternatives can be offered. This tender does not include non ionizing radiation, but only detection of radiation coming from gamma and neutron sources. As indicated in the Tender dossier, Technical Specifications Annex II and III, page 13, clothing and footwear are to be of 5.11 or 9.11 standard, i.e. or of equivalent standard and quality to 5.11 or 9.11 Tactical. Specifications for Radiation Portal Monitors are indicated on page 10 of the above Annex II and III. Please address the concern of the bidder(s) i.e. you should explain how the published technical specifications are not restrictive and do indeed afford equal access to all potentially interested economic operators. If the equipment is "specified around one particular manufacturer" you'll need to modify the specifications. All supplies must originate in a Member State of the EC or a country covered by the IPA programme. 14. Nearly all of the products you have specified are not produced or manufactured within the EC or qualifying countries, with most high performance clothing being produced in the far east and the USA. Please confirm that derogation will be made to allow alternative origin supplies to be offered. As indicated in the Tender dossier, Technical Specifications Annex II and III, page 13, clothing and footwear are to be of 5.11 or 9.11 standard, i.e. or of equivalent standard and quality to 5.11 or 9.11 Tactical. 16 17 Questions regarding technical requirements for radiation portal monitors production and installation: Are there any special requirements for supervising system for data storage and analysis (industrial, IP protected or usual equipment for data storage, processing and visualization of alarm associated information, video records)? Questions regarding technical requirements for radiation portal monitors production and installation: Which organization should develop and prepare Project documentation for RPM installation at monitoring points and which organization should carry out civil works necessary for RPM installation? Is it supplier task? No special requirements. Usual equipment for data storage, processing and visualization of alarm associated information including video records will suffice. Documentation for RPM installation as well as works on installation itself will both be tasks of the supplier. 18 19 Questions regarding technical requirements for radiation portal monitors production and installation: Is it possible to obtain schematic drawing of RPM location at each alarm point with maximal distance indication between RPM and supervising system? This distance influences on the price. Is there source of electrical power at place of supervising system or in other place? Should electrical cables be laid between RPM and supervising system (from source of electrical power to RPM) by supplier? Questions regarding technical requirements for radiation portal monitors production and installation: Could you explain more comprehensive requirements for protection bollards? Is it protection of RPM pillar from instant collision with vehicle or these bollards are intended for decreasing of vehicle velocity to acceptable values for correct radiation measurements with RPM or something else? All border stations are connected to the supervising system (Customs Headquarters in Belgrade) via an intranet network which will be used for transfer of data in the case of RPMs. A simple ethernet switch will allow connection to the network. The distance between the RPMs location and network/interface router will be anywhere up to 100 meters. Electrical cables are to be provided by the suppliers. The function of the protection bollards will primarily be to protect the RPM from damage/collision with vehicle. Separate mechanism to control vehicle speed should also be provided. 08SER01/06/41 7/12

Apart from the existing power/telephone/optical cables at border crossings, additional ones will be needed for the installation of RPMs, the costs of which should be included in the overall price. 22 Will be fulfilled the following work at the borders (both rail and road) by the end user before delivery: - Cable run under the railways and under the road - Concrete base according to our instructions for assembly - Cable from the RPM s to the border station (PC) All workmanship/construction required for the installation and proper functioning of RPMs (such as concrete base, cables etc) will be delivered by the supplier and the overall price should include such installation costs. 08SER01/06/41 8/12

23 The following question is regarding the spare parts: where will be stored these spare parts? (Tender instructions: to be able to warrant the demanded 24/7 service, the spare parts must be cleared through customs and be provided in your country). Is there any possibility to store it in the HQ Belgrade on behalf of the end user or should be the storage in a bounded warehouse at a forwarding agent on behalf of the supplier? The Customs Headquarters has a suitable storage area where spare parts can be kept on stock. 24 I need a clarification about item 1.5 of LOT 2: Tactical bag Patrol bag (black or navy blue). Please what do you mean for it? Can you give an example? The tactical patrol bag should be of similar size and functionality as image on below link: http://tacnationinc.com/store/images/pvcrb728-m.jpg Please provide a description of the item e.g. size, material, features etc. 25 Should be any central unit (supervising system for data storage and analysis) extern installed (not at the borders)? In case of yes, where should be this central unit for the RPM s installed? The central unit will be located at the Customs HQ in Belgrade. All border stations are connected to the Customs HQ via an intranet network which will be used for transfer of data in the case of RPMs. At the border crossing points, a simple ethernet switch will allow connection to this network. The distance from RPMs to the network/interface router will be anywhere up to 100 meters. 08SER01/06/41 9/12

26 In Instructions to tenderers document, implementation period required is "420 days delivery plus provisional acceptance period plus defects and liability period". Please could you precise the meaning of "defects and liability period"? In addition to the standard 24 month warranty the supplier will provide a proposal for an after-sales service of three (3) years (the tenderer will include a proposal for an aftersales service during and after the warranty period). Such services will include any intervention and make available the necessary spare parts and consumables through a commercial channel with the manufacturer, for a period of three (3) years after the provisional acceptance; The Contractor must also guarantee the availability of all necessary spare parts for a period of at least five (5) years after Final Acceptance. The defects and liability period runs from provisional to final acceptance. See Article 34 of the General Conditions. 27 Annex II+III, 0.5.2.3, can you precise what you mean with "including vehicle speed control"? Is it an equipment (for instance speed bumps..) needed to slow down the freight vehicles or is it a functionality of the system (like the triggering of a speed alarm) in case of too high speed of the vehicles? Speed bumps (or sleeping policemen ) are acceptable as means of vehicle speed control. Additional speed alarm in the system itself is not specifically requested. 28 Who is in charge of providing the gamma and neutron radioactive sources needed for the tests of the RPMs during the provisional acceptance? Is CAS able to provide the required sources? The provision of the gamma and neutron radioactive sources for conducting tests will be the responsibility of the Serbian Customs Administration in liaison with the Agency for Ionizing Radiation Protection and Nuclear Safety of Serbia (SRPNA). 08SER01/06/41 10/12

29 30 Does the UPS also power supply camera and supervising system or only the Portal Monitor? Annex II+III, 0.5.2.3, for strength and esthetic reasons (see attached picture), could the protection bollards be part of the civil engineering work at the charge of the beneficiary like it was for previous projects? (photo attached) Power supply (uninterruptible for at least 4 hours) will be needed to operate the following: 1. RPMs 2. The alarm 3. The camera 4. The supervising system for data storage All of the above also need to be interconnected. Protection bollards are to be at the cost of the supplier as well as all related engineering/installation works. 31 We have following question to the form sheet of Annex IV: Budget breakdown (Model financial offer): - Should be offered the proposal for the 3 year warranty (lump sum) in the budget breakdown form (page 1) included under the column C Other Services or - Should be offered this proposal additional on a side letter/annex?
