NEW EU TRADE MARK LEGISLATION Changes entering into force on 1 October, 2017 Disclaimer: This brochure provides only a broad overview of the main changes entering into force on 1 October, 2017. As of the date of writing (April 2017), part of the information is based on legislative proposals (the new EUTMIR and EUTMDR) that are still undergoing the established approval process and will only be published in September 2017. We strongly advise users to regularly check the information resources available through EUIPO s website for the relevant updates.

NEW EU TRADE MARK LEGISLATION Changes entering into force on 1 October, 2017 On 23 March 2016, Regulation (EU) No 2015/2424 of the European Parliament and the Council amending the Community Trade Mark Regulation (EUTMR) entered into force. Among other things, the EUTMR changed the name of the Office we are now the European Union Intellectual Property Office (EUIPO). The Community Trade Mark (CTM) became the European Union Trade Mark (EUTM) and all CTMs automatically became EUTMs as of 23 March 2016. On 1 October 2017, further changes arising from the EUTMR will apply along with new secondary legislation in the form of a European Union Trade Mark Delegated Regulation (EUTMDR) and a European Trade Mark Implementing Regulation (EUTMIR).

The EUTMR introduces EU Certification marks and one of the cornerstones of the reforms abolishes the graphical representation requirement. The EUTMDR largely covers procedural rules in relation to oppositions, cancellations and appeals as well as details concerning the organisation of the Boards of Appeal. The EUTMIR covers matters such as representation requirements for EUTMs, details relating to the new EU Certification mark, translations and other technical issues.

NEW EU TRADE MARK LEGISLATION Changes entering into force on 1 October, 2017 The EUIPO Guidelines will be fully updated to reflect all changes applying from 1 October. Up to and after the entry into force of the second wave of changes, the EUIPO Academy is hosting a series of webinars, dedicated to different aspects of the changes, live or recorded which can be accessed through the EUIPO Learning Platform and the EUIPO YouTube channel. From 1 October 2017, the graphical representation requirement is removed. This means that on and after that date, signs can be represented in any appropriate form using generally available technology, as long as the representation is clear, precise, selfcontained, easily accessible, intelligible, durable and objective. The new EUTMIR, entering into force on the same date, sets out a list of types of mark some of which are new (e.g. multimedia marks) and some of which were previously covered by broader categories (e.g. pattern marks were covered by figurative marks). The new EUTMIR also lays down the specific rules and requirements, including some technical requirements, for the representation of certain types of trade marks in accordance with the specific nature and attributes of the mark.

From 1 October 2017, a new type of trade mark at EU level comes into being the EU certification mark. Certification marks already exist in some national systems to indicate that goods and services comply with the certification requirements of a certifying institution or organisation. They act as a sign of supervised quality. An EU certification mark will cost EUR 1 800, and EUR 1 500 if applied for via e-filing. EU certification marks must be accompanied by regulations governing their use which have to be submitted within two month of the day of filing. The minimum content of these regulations are set out in the new EUTMIR.

NEW EU TRADE MARK LEGISLATION Changes entering into force on 1 October, 2017 The changes entering into force on 1 October also include: Provisions for online substantiation of oppositions and cancellations in certain cases from online sources recognised by the Office Acquired distinctiveness as a subsidiary claim, allowing the applicant, in practice, to exhaust the right of appeal on inherent distinctiveness before being required to prove acquired distinctiveness Codification of EUIPO s practice (as explained in its Guidelines) on belated evidence of substantiation and proof of use A significant simplification of translation requirements

Assignment of EUTM as a remedy in certain circumstances Formal requirements on the structure and format of written evidence in all proceedings (presenting evidence in annexes) Hand deliveries and post box deposits will no longer be accepted at the Office The EUTMIR and EUTMDR both contain transitional provisions that comprehensively set out when the new procedural rules take effect.
