2018 TERMS & CONDITIONS Company: Trader s Forum Effective: January 1, 2018 1. The rates quoted are proposed levels. If they are not accepted in writing within 7 days or used within 60 days of the above date, this proposal shall be considered to be withdrawn. 2. This proposal is based on specific yearly volume of $100,000.00 as indicated by yourself. Any significant variations in volumes may result in a review of this proposal. 3. Rates are in effect only after establishment of credit with VTL Transport Inc. 4. All rates proposed remain subject to the rules and regulations of the tariffs in which they are filed. 5. Unless the shipment is valued and a premium is paid to VTL Transport Inc., any loss or damage whatsoever, shall be restricted to the lesser of: a. The value of the lost or damaged goods at the place and time of the shipment, or b. An amount, in lieu of the value of the goods, not to exceed $2.00 per pound computed on the total weight of the shipment. c. A signed Proof of Delivery without complaint will be regarded as proof that cargo was delivered in good condition. d. VTL Transport Inc. is not liable for loss, damage or delay to any goods carried under the Bill of Lading unless notice thereof setting out particulars of the origin, destination and date of shipment of the goods and the estimated amount claimed in respect of such loss, damage or delay is given in writing to the originating carrier or the delivering carrier within sixty (60) days after the delivery of the goods or in the case of failure to make the delivery within nine (9) months from the date of the shipment. e. The final statement of the claim must be filed within nine (9) months from the date of shipment together with a copy of the paid freight bill. 6. VTL Transport Inc. accepts no liability for damages or fines incurred by the customer for any reason whatsoever including late shipments, missed appointments etc. 7. VTL Transport Inc. accepts no liability for any consequence of an interruption of service caused by acts of God, strikes, lockout, labour disputes or weather related delays. 8. All rates are subject to the Goods and Services Tax (GST) and to Sales Tax if applicable. 9. All rates quoted are subject to a fuel surcharge. 10. All back-up documents are available on-line on our web-site and only scanned copies will be provided with invoices. An administration fee will apply for request of original copies. 11. Terms of payment are net 30 days from the date of shipment. Finance charges of 2% per month will be applied to outstanding balances after 30 days.
