DR17-08: Design Review to demolish an existing structure and replace with a new single family house and detached garage at 1056 Falls Road by Scott Gardner Scott Gardner appeared on behalf of the application. Design Review, Demolish Structure and Replace with Single Family House, 1056 Falls Road, Scott Gardner (DR17-08) MOTION by Mary Kehoe, SECOND by Jeff Pauza, to grant Design Review approval of DR17-08 to demolish a structure and replace with a single family house at 1056 Falls Road by Scott Gardner as depicted in the submitted application materials and with the following conditions as recommended by Shelburne Historic Preservation & Design Review Committee: 1. The planned demolition of the primary residential structure located at 1056 Falls Road and the submitted architectural plans and other drawings relating to the construction of a replacement structure including elevation

Pursuant to Section 1540.3.A.l the DRB finds that the structure proposed for demolition has deteriorated to the degree that rehabilitation and reuse of the structure is not feasible. 3. Pursuant to Sections 1540.3.A.3 and 1540.3.A.5 the DRB finds that the demolition and redevelopment proposal mitigates to the greatest extent practicable any impact on historic structures on the subject property or adjacent properties, and all historically and architecturally important design features will be properly documented, and the applicant s redevelopment plan will provide replacement structures that are compatible with the historic integrity and the architectural character of the surrounding area. 4. Approval of the project is conditioned on adherence to the cited plan and preparation of a documentation report prepared using applicable standards of the Historic American Building Survey submitted as part of any building permit application authorizing the project (the report prepared by Scott Newman may be used). Classes and open studio space will also be offered. There is an existing tenant in the upstairs portion of the building. The sign for the building will be changed, but the size will remain the same. Ms. Senior said she would like the option to offer office space to rent at some point in the future. Jeff Pauza asked if there will be metal or glass artwork at the site. Ms. Senior said there will be no machinery to develop artwork. Kate Mitchell noted changing the use back to office space from artist studio will require a separate approval. A zoning permit shall be required prior to any improvements being made. 2. A sign permit shall be required. 3. Metal and glasswork is not approved for this use.

No lighting is being added. All the signs are on Wake Robin property. The proposal is to merge the two lots and locate the carpet and tile cleaning business on the first floor of the building with apartments on the second floor of the building. Mary Kehoe asked about access to the building from Shelburne Road. Kate Mitchell said current access to the lot is from Palmer Court which is a private road so the applicant will need to have an access agreement in place. Ian McCray asked about the trucks and other equipment for the business. Clint West said his cleaning service uses normal sized vans that fit into a normal sized garage. Jeff Hodgson asked if the tandem parking spaces shown on the site plan are part of form based zoning. Kate Mitchell confirmed this. Parking will be part of the conditional use approval. SHELBURNE DEVELOPMENT REVIEW BOARD 7/19/17 PAGE 9 MOTION by Mary Kehoe, SECOND by Jeff Hodgson, to classify the Sketch Plan Application, FBZ17-01, as a Minor Subdivision and to finalize the record for FBZ17-01 to merge two lots at 2916 Shelburne Road by Clint West and authorize the applicant to prepare a Final Plan application with the following recommendations: 1. Obtain written comments from the town department heads as required in Section 600(28) of the Subdivision Regulations. 2. A Site Plan Application should be prepared and submitted with the Final Plan Application. 3. A Conditional Use Application should be prepared and submitted with the Final Plan Application for the proposed tandem parking. SP17-04: Site Plan Amendment for changes to structures, parking, and access from the previously approved site plan for 4188, 4190, 2055, and 4484 Shelburne Road in the Mixed Use District and Stormwater Overlay District by Rice Lumber Corporation Dave Marshall with Civil Engineering Associates appeared on behalf of the application. Mark Sammut recused himself and left the meeting. Cover letter prepared by Civil Engineering Associates, dated 6/13/17 and received 6/15/17 General Information Application, received 6/15/17 Site Plan Review Application, received 6/15/17 Site Plan Set prepared by Civil Engineering Associates, received 6/15/17 Dave Marshall explained the previously approved application had four residential lots, commercial lots along Route 7, and the lumber yard and retail store on lots 1 & 2. The original intent of the development was to have drive-thru service. With the current proposal to save energy and be more efficient the large building will be divided into two buildings, one being essentially a warehouse and the other having the drive-thru service. Storm water management will include catch basins to convey water to the storm water ponds. Trees will be planted to screen the building and a berm will be built.

SHELBURNE DEVELOPMENT REVIEW BOARD 7/19/17 PAGE 10 Ian McCray asked if the paved portions on the lot and the building size are the same. Dave Marshall said the building is essentially the same. There is a bump-out and laydown area in the southwest corner. The warehouse building has a porch for protected storage of materials. Ian McCray asked if the storage building is closed or like a lean-to. Dave Marshall said the storage shed structure is open. Jeff Hodgson asked about access to the residential lots. Dave Marshall said the original plan showed access off Route 7 and a gate to prevent people from going to the lumber yard storage area. The current proposal shows the security fence up by the drive-thru building and access to the residential lots as unimpeded. There are parking spaces shown on the drive to the residential portion of the development. Jeff Hodgson asked about lot coverage being greater than the earlier proposal. Kate Mitchell briefly explained the one-time allowance to exceed 30,000 s.f. of building space if multiple buildings are being condensed into fewer buildings. As a total the buildings meet the lot coverage, but there are certain lots that will exceed coverage if developed as proposed. Dave Marshall added the aggregate of the coverage is less than the allowed amount. Jeff Hodgson asked if the lots fronting Shelburne Road can be developed under form based code or must follow traditional zoning. Kate Mitchell said form based zoning can be followed. Mary Kehoe expressed concern about the lots along Shelburne Road being accessed from Shelburne Road. Mary Kehoe asked if there are lighting changes to the plan. Dave Marshall said the lighting will be the same except the pole lights will have LED products. The lighting for the warehouse has been submitted. Only the northern half of the warehouse will have lights on the doorways and overhead. The southern portion is the open shed.
