The Planning Commission of the City of La Habra does hereby resolve as follows: Section 1. The Planning Commission does hereby find and determine that: a. Mi Soo Pak, on behalf of Urban Village Development Company, filed an application requesting certification of Mitigated Negative Declaration of Environmental Impact (MND) 14-02 for a 32 unit multi-family residential development at 1220 & 1240 West La Habra Boulevard. b. An Initial Study resulting in Mitigated Negative Declaration of Environmental Impact MND 14-02 was prepared for this project pursuant to Sections 15170 and 15071 of the California Environmental Quality Act (CEQA) Guidelines. A Notice of Intent to Adopt a Mitigated Negative Declaration was circulated for public review and comment pursuant to Section 15072 of the CEQA Guidelines. The Initial Study identified environmental impacts resulting from the project and proposed mitigation measures to reduce those impacts to a level of insignificance. A Mitigation Monitoring Program is attached to this resolution as Exhibit "A". The Mitigation Monitoring Program lists the mitigation measures, agencies monitoring their implementation, and when the measures are to be implemented. c. The proposal has been reviewed pursuant to the requirements of the City s National Pollutant Discharge Elimination System (NPDES) Municipal Permit, the Local Implementation Plan (LIP), and the Model Water Quality Management Plan (WQMP), Section 7.2. Since the proposal will constitute the disturbance of more than 5,000 square feet of soil, a Priority Water Quality Management Plan (WQMP) is required. A Preliminary WQMP has been approved and included as Appendix D of the Initial Study. d. The Planning Commission held a duly noticed public hearing on April 13, 2015 to consider the Initial Study and Mitigated Negative Declaration of Environmental Impact MND 14-02.
