LOCATION: The project site is located 6 miles southeast of Wainwright, Alaska, on the Kuk River, within SW ~Section 11, T. 14 N., R. 31 W., Umiat Meridian; at Latitude 70.577 N., Longitude -159.830 IV. SPECIAL AREA DESIGNATION: The project is located within the outside boundaries of the Naval Petroleum Reserve Alaska. PURPOSE: The applicant's stated purpose is to excavate and stockpile gravel to be used for constructing and maintaining Waim 1right' s roads, housing, public facilities, and airport. PROPOSED WORK: Develop a material pit by excavating a 200-foot by 300-foot pit during frozen soil conditions. Side slopes would be graded to 2H:1V. Overburden would be stored 1 1ithin a 60-foot by 60-foot area on the edge of the pit for reclamation. Excavated material t-~ould be loaded directly into trucks for haul over shore-fast ice to an existing storage area 2.1 miles northeast of Wain\ lright. All \ mrk Nould be performed in accordance \<Tith the enclosed plan (sheets 1-4), dated February 2013.

ADDITIONAL INFORMATION: Excavation in the pit would be taken down to -15 feet belov1 the lo\ Iest elevation of original ground. After the required 60,000 cubic yards of material is removed, a channel between the pit and the Kuk River \'lould be excavated to provide potential fish over-\ lintering habitat. The existing stockpile storage pad is located near the Wainv1right landfill within SW V. Section 8, T. 15 N., R. 31 W., at Latitude 70.665 N., Longitude -159.967 w. APPLICANT PROPOSED MITIGATION: The applicant proposes the following mitigation measures to avoid, minimize, and compensate for impacts to waters of the United States from activities involving discharges of dredged or fill material. a. Avoidance: Winter excavation and material haul would avoid erosion and sedimentation into adjacent vmters and v1etlands. b. Minimization: impacts to surface soils stored on site to reduce Gravel pit excavation during frozen conditions minimizes and vegetation. No camp would be constructed or fuel potential for adverse impacts to adjacent to~aters. c. Compensatory Mitigation: Compensatory mitigation '" muld not be required because total fill placed in waters of the U.S. l'iould be limited to the stockpiled overburden; occurring in less than 0.1 acre. WATER QUALITY CERTIFICATION: A permit for the described work 1 1ill not be issued until a certification or waiver of certification, as required under Section 401 of the Clean Water Act (Public La1 1 95-217), has been received from the Alaska Department of Environmental Conservation. CULTURAL RESOURCES: The Alaska Heritage Resources Survey (AHRS) was unavailable to us at the time this Public Notice was prepar8d. V1e v1ill consult the survey as soon as available 1 for the presence or absence of historic properties 1 including those listed in or eligible for inclusion in the National Register of Historic Places. This application is being coordinated \ lith the State Historic Preservation Office (SHPO). Any comments SHPO may have concerning presently unknm'ln archeological or historic data that may be lost or destroyed by work under the requested permit ;lill be considered in our final assessment of the described vmrk. ENDANGERED SPECIES: The project area is l<ithin the known or historic range of the following threatened or endangered species: spectacled eider (Somateria fischeri), Steller 1 s eider (Polysticta stelleri) 1 and polar bear (Ursus maritimus). We have determined the described activity would have no effect on either eider species because work would be limited to t dnter when the birds are not present. Polar bears are commonly seen in the Wainwright area although denning does not occur within five miles of the community. The applicant, 1 has developed a Polar Bear Avoidance Plan for this project. We will follovt the appropriate consultation procedures under section 7 of the Endangered Species Act of 1973 (87 Stat. 844). Any comments the U.S. Fish and Wildlife Service or the National Marine Fisheries Service may have concerning endangered or threatened wildlife or plants or their critical habitat \ lill be considered in our final assessment of the described t-~ork. ESSENTIAL FISH HABITAT: The Magnuson-Stevens Fishery Conservation and Management Act, as amended by the Sustainable Fisheries Act of 1996, requires all Federal -2-

agencies to consult with the NMFS on all actions, or proposed actions, permitted, funded 1 or undertaken by the agency, that may adversely affect Essential Fish Habitat (EFH). The project area is \'lithin the known range of the fresht Tater species: pink salmon (Oncorhynchus gorbuscha) and chum salmon (0. keta), and marine species: arctic cod (Boreogadus saida) and rainbo\ l smelt {Osrnerus mordax). We have determined the described activity would not adversely affect EFH in the project area. Excavation \ lould be on land, separated from Kuk River waters until the Nork is complete, when a connecting channel is excavated. TRIBAL CONSULTATION: The Alaska District fully supports tribal self-governance and government-to-government relations between Federally recognized Tribes and the Federal government. Tribes with protected rights or resources that could be significantly affected by a proposed Federal action {e.g., a permit decision} have the right to consult with the Alaska District on a government-to-government basis. Views of each Tribe regarding protected rights and resources will be accorded due consideration in this process. This Public Notice serves as notification to the Tribes within the area potentially affected by the proposed work and invites their participation in the Federal decision-making process regarding the protected Tribal right or resource. Consultation may be initiated by the affected Tribe upon written request to the District Commander during the public comment period. PUBLIC HEARING: Any person may request, in \Yriting, vlithin the comment period specified in this notice, that a public hearing be held to consider this application. Requests for public hearings shall state, with particularity, reasons for holding a public hearing. EVALUATION: The decision v1hether to issue a permit Nill be based on an evaluation of the probable impacts, including cumulative impacts of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts, ~ 1hich the proposed activity may have on the public interest 1 requires a careful Neighing of all the factors that become relevant in each particular case. The benefits 1 Nhich reasonably may be expected to accrue from the proposal, must be balanced against its reasonably foreseeable detriments. The outcome of the general balancing process \ muld determine whether to authorize a proposal, ahd if so, the conditions under which it \ lill be allowed to occur. The decision should reflect the national concern for both protection and utilization of important resources. All factors, which may be relevant to the proposal, must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values 1 flood hazards, floodplain values, land use, navigation 1 shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property m mership 1 and 1 in general, the needs and welfare of the people. For activities involving 404 discharges, a permit \ dll be denied if the discharge that vmuld be authorized by such permit 1;ould not comply ;lith the Environmental Protection Agency's 404 (b) (l) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria (see Sections 320.2 and 320.3), a permit will be granted unless the District Commander determines that it t 1ould be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State, and local agencies and officials; Indian Tribes; and other interested parties in order -3-

to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine v1hether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species 1 historic properties, water quality, general environmental effects, and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity.
