Temperature: No applications shall be conducted or continued when temperatures reach 85 at the field. 2. Time: Applications shall not start before 8:00 a.m. and must conclude by sunset. 3. Personnel: One trained person must be present at the site continuously during the application and post-application monitoring. 4. NOI: A Notice of Intent must be submitted to the Ag Commissioner s Office at least 48 hours prior to the application. Do not deviate from the approved NOI without receiving express approval from an Ag Commissioner s biologist. 5. Signs: Warning signs shall be posted by the applicator on each block fumigated in a 24 hour period prior to beginning injection in accordance with the California Code of Regulations 6776. After injection, the property operator shall insure the signs remain posted and legible for the duration of the entry-restricted period (ERP) or REI, as referenced in appropriate label. The signs shall be removed after the ERP or REI has elapsed and prior to allowing workers to enter the application block. 6. Buffers: Buffer zones are measured from the application edge to an occupied structure and shall be calculated from Tables 1, 2 or 3 and application options below. a. applications are prohibited within ½ mile of a school property line when school is in session or scheduled to be in session while the buffer zone is in effect b. buffer zones shall not contain occupied structures unless occupants are moved out during the application and for the duration of the buffer zone c. buffer zones shall not extend onto properties of occupied structures or adjoining properties unless advanced written permission is obtained from the property operator and that property operator shall assure that no persons are allowed in the buffer zone except to perform fumigation handling activities or transit as described and approved in item e d. with approval from the commissioner, buffer zones may extend across streets, highways and other similar sites for travel e. buffer zones shall not extend into bystander areas 7. Monitoring: All applications must be monitored and recorded on the Santa Barbara County Metam Monitoring Form. 8. Mandatory Odor Mitigation Requirement: If odors occur during the application, the applicator must immediately stop the application and seal the treated soil by applying a water seal. The applicator must identify the source of the odor and correct the cause before resuming the application. The applicator must record this information on either the fumigant management plan (FMP) or other similar document. Application Options 1. Areas ½ 1 mile of a school or within ¼ mile of an occupied structure or bystander area a. Applications require 3 post application water treatments. The system must be capable of delivering at least.2 -.4 inches of water in 2-3 hours over the entire treatment site at a rate of.15 -.25 inches per hour. The first treatment must start within 30 minutes of completion of the application. The second treatment must start no earlier than 1 hour before sunset and be Rev 03-15-11
completed by midnight. The third treatment must start no earlier than 1 hour before sunset and be completed by midnight on the day after the injection. b. The property operator shall limit the number of treated acres by the capacity of the irrigation system to deliver water to the entire application block at the same time, not to exceed 40 acres in a 24-hour period. c. Odor mitigation water must be available for 48 hours following the injection. 2. Areas greater than 1 mile from a school and ¼ - ½ mile from an occupied structure or bystander area a. Applications require 1 or 2 post application water treatments. The first treatment must start within 30 minutes of completion of the application. The second treatment must start no earlier than 1 hour before sunset and be completed by midnight. b. The buffer zone duration is 24 hours when 2 post application water treatments are performed. When only 1 post application water treatment is performed the buffer zone duration is 48 hours. c. The property operator shall limit the number of treated acres by the capacity of the irrigation system to deliver water to the entire application block at the same time, not to exceed 80 acres in a 24-hour period. d. Odor mitigation water must be available for 48 hours following the injection. 3. Areas greater than 1 mile from a school and greater than ½ mile from an occupied structure or bystander area a. Applications require 1 post application water treatment. The treatment must start within 30 minutes of completion of the application and be completed by midnight. b. The buffer zone duration is 48 hours. c. The property operator shall limit the number of treated acres by the capacity of the irrigation system to deliver water to the entire application block at the same time, not to exceed the number of acres listed on Table 3. Definitions Odor Mitigation Water Source The term occupied structure is defined to include, but is not limited to, a home or other building that may be occupied for any or all parts of a 24-hour period. An occupied structure does not include buildings where people may visit for limited periods of time such as barns, equipment sheds, pump houses and workshops. However, people must not be directed or allowed to work in any structure within the buffer zone if odors are detected in the structure. The term bystander area is defined as an area used or visited by people on a daily basis, including parks, playgrounds, lakes, reservoirs, bus stops, and other similar areas where groups of people visit, or other areas identified by the CAC. The term application block is defined as a field or portion of a field fumigated in a 24-hour period. Rev 03-15-11
The permit applicant shall provide a map of the area to be treated that includes the surrounding area for a radius of 1 mile. The diagram must include the location of schools, occupied structures, bystander areas and the water source used for odor mitigation. Include distances of schools, occupied structures and bystander areas from the treatment site. Indicate application blocks. N Rev 03-15-11
Accident Response Plan What to do in case of accidental spill or release of the fumigant Employees who work with the fumigant must be trained in the procedures to follow in case of an accidental spill or odor problems. If the release or threatened release poses a significant present or potential hazard to human or environmental health and safety call 9-1-1 and County Fire/Hazardous Materials 686-8170 Emergency Contact Information (Fill in names and phone numbers for your company) Evacuate personnel from the leak or spill area. Shut down the application system to stop the leak or spill. If possible, determine wind direction and move personnel and anyone injured upwind an away from the impacted area. Establish control of the area. Immediately administer first aid to anyone who may be injured and contact the appropriate emergency personnel by dialing 9-1-1. Emergency PPE must be readily accessible at all times. Wear emergency PPE and clothing required by the label when assisting with repair of leaks and small spill clean ups. For large spills, see below. For small leaks from application and chemigation equipment, put a container under the leak and catch the leaking material. Turn off any equipment valves that may affect the leak. Repair the leak. Return caught material to tank or dispose of properly. Clean up the contaminated area. For small spills, contain the material. If puddles are present, clean it up with absorbent material and dispose according to appropriate local, state and/or federal requirements. If the soil is contaminated, determine whether removal is necessary. If contaminated soil must be removed, dispose contaminated soil according to appropriate local, state and/or federal requirements. For large spills, notify HazMat or Fire Department personnel immediately. If properly trained in HazMat responses, wear appropriate PPE (chemical resistant suit, gloves and boots, and selfcontained breathing apparatus). Dike the area to prevent spreading and further environmental contamination. If metam sodium or metam potassium has pooled within the dike area, then use a tank truck with vacuum hoses to remove it. Remove and dispose the contaminated soil according to appropriate local, state and/or federal requirements. The plan may include the assistance of an environmental service company that could provide support in large spill emergencies. Notify the appropriate personnel. Buffer zone tables Buffer zones are determined by the application time, pounds of active ingredient per acre, the number of acres, and the number of post application water treatments. When fumigating multiple blocks, the buffer zone is calculated by adding the acreage of blocks fumigated within any 2 day period when they are within ¼ or less apart.
