Tender Specifications Office Cleaning Services - Ref. DELSGPS-02-2014 1. Introduction A call for tender for office cleaning services is open to companies specialized in cleaning services. The Delegation of the European Union to Singapore ("EU Delegation") is launching a call for tender to ensure continuity of the services with the successful bidder based on a signed contract starting 01 March 2014. The contract is for providing cleaning services at the offices of the EU Delegation at: 250 North Bridge Road #37-01 and #38-03/04 Raffles City Tower Singapore 179101 Working hours of the EU Delegation: Mondays to Fridays from 9am to 5.30pm Excluding Public Holidays and other off-days declared by the EU Delegation Lunch hour from 1pm to 2pm The premises comprise offices, meeting rooms, pantry, storage space, restrooms and corridors. The space is carpeted (excluding pantry and restrooms). Approximate area of level 37 office is 216 m 2 and level 38 is 529 m 2. 2. Technical specifications 2.1. Tasks to be executed a) Daily General cleaning of the office space: cleaning offices (meeting rooms, glass doors), sweeping and mopping at pantry and restrooms, spot vacuuming, clearing rubbish, refill pantry items (e.g. coffee, tea, drinking water, etc.) and consumables in pantry and restrooms (e.g. hand soap, hand towel paper, toilet paper, etc.), collecting and washing dishes by dishwashing machine, spot cleaning on the marks on walls/tables/doors, wiping dust, etc.; Ensure that good order and cleanliness of the offices are maintained. b) Weekly Vacuum offices (including corridors, meeting rooms, doors, etc.); Wiping of telephones, desks, chairs, cabinets, shelves, etc. at offices; Cleaning of front signage. 1

c) Fortnightly Provision of 2 sanitary bins with fortnightly replacement by the company. e) Quarterly Dusting of air-conditioning ducts, light diffusers and roof panels. As and when requested Clean Ambassador's office; Prepare drinks and snacks for the meetings; Clean meeting room after the meetings; Accompany external service providers (e.g. pest control, air-con maintenance, water delivery, etc.) at EU Delegation premises; Cleaning of internal windows/glass panels. Execution of the above mentioned tasks must be performed by qualified, physically fit staff that understands and speaks basic English. EU Delegation provides the cleaning equipment and products. 2.2. Quotation The quotation is divided into 3 parts: 1) Fee per month for part-time cleaner from 9am to 1pm from Mondays to Fridays 2) Fee per month for part-time cleaner from 9am to 3pm from Mondays to Fridays, including one hour lunch break from 1pm to 2pm 3) Cleaning per hour on ad hoc basis (if required to work outside the hours listed above) Staff must be approved by the EU Delegation before taking up duties. Back-up cleaner must be trained and familiarized with the duties to be performed at the EU Delegation, and follow same working hours and duties. Staff selected to work at the EU Delegation must have valid work permits/residential status and have existing contract with the service provider before taking up the duties at the EU Delegation. Service provider shall inform the EU Delegation without delay of cleaner's absences (leave, medical leave, urgent leave, etc.) and any other possible changes of staff working at the office premises (resignation, etc.). The service provider must ensure a sufficient number of staff to execute the duties effectively, including back-up situations without delay. 2.3. Dress code Staff shall be wearing uniform provided by the service provider. The uniform is to be kept neat and clean. The service provider is to supply sufficient quantity of the uniforms to the staff. 2

3. Specific contract implementation procedures 3.1. Price revision Price is fixed for the first year of contract, price revision during initial period is not allowed. Price may be revised on the renewal of the contract. 3.2. Payment Monthly payment shall be executed by cheque or GIRO in SGD after the delivery of the services. Payment shall be made within 30 days upon receipt of an invoice. 3.3. Contract period The contract will be for an initial period of 1 year, renewable on annual basis up to 4 years. 3.4. Termination The contract may be terminated by either party by giving 1 months' notice in writing. Contract may be terminated with immediate effect by the contracting authority if the tenderer has not respected the clauses under points 4.1., 4.2. and 4.3. 3.5. Language All forms of communications shall be in English. 4. Presentation of tenders Tenders shall be presented on Quotation form (included in the documents). Site visit may be arranged. Documents to be submitted: Thursday 06 February 2014 by 12pm All costs incurred during the preparation and submissions of tenders are to be borne by the tenderers and will not be reimbursed. Contacts between the contracting authority and tenderers are prohibited throughout the procedure, save in exceptional circumstances and under the following conditions only: - Before the final date for submission of tenders: * At the request of the tenderer, the contracting authority may provide additional information solely for the purpose of clarifying the nature of the contract. Any requests for additional information must be made in writing only to delegationsingapore-administration@eeas.europa.eu. 3

* The contracting authority may, on its own initiative, inform interested parties of any error, inaccuracy, omission or any other clerical error in the text of the call for tenders. * Any additional information including that referred to above will be sent simultaneously to all candidates invited to tender. - After the opening of tenders * If clarification is required or if obvious clerical errors in the tender need to be corrected, the contracting authority may contact the tenderer provided the terms of the tender are not modified as a result. * The contracting authority may negotiate with tenderers the tenders they have submitted, in order to adapt them to the requirements set out in the contract notice, tender specifications or any additional document and in order to find the tender offering best value for money. During negotiations equal treatment of all tenderers will be ensured. This invitation to tender is in no way binding on the contracting authority. The contracting authority's contractual obligation commences only upon signature of the contract with the successful tenderer. Up to the point of signature, the contracting authority may either abandon the procurement or cancel the award procedure, without the candidates or tenderers being entitled to claim any compensation. This decision must be substantiated and the candidates or tenderers notified. Once the contracting authority has opened the tender, the document shall become its property and it shall be treated confidentially. Submission of a tender implies that the tenderer: Accepts all the terms and conditions governing the contract to this specification (draft contract and call for tender letter); Waives its own terms and conditions. If processing the reply to the invitation to tender involves the recording and processing of personal data (such as name, address and CV), such data will be processed pursuant to Regulation (EC) No 45/2001 on the protection of individuals with regard to the processing of personal data by the Community institutions and bodies and on the free movement of such data. Unless indicated otherwise, replies to the questions and any personal data requested are required to evaluate the tender in accordance with the specifications of the invitation to tender and will be processed solely for that purpose by the Head of EU Delegation to Singapore. Personal data may be registered in the Early Warning System (EWS) only or both in the EWS and Central Exclusion Database (CED) by the Accounting Officer of the EEAS, should the tenderer be in one of the situations mentioned in: - the Commission Decision 2008/969 of 16.12.2008 on the Early Warning System (for more information see the Privacy Statement on http://ec.europa.eu/budget/contracts_grants/info_contracts/legal_entities/legal_entities_en.cfm ), 4

or - the Commission Regulation 1302/2008 of 17.12.2008 on the Central Exclusion Database (for more information see the Privacy Statement on http://ec.europa.eu/budget/explained/management/protecting/protect_en.cfm#bdce ). 5. Criteria 5.1. Declaration that there are no conflicts of interest Tenderers should declare: That they do not have any conflict of interest in connection with the contract. A conflict of interest could arise in particular as a result of economic interests, political or national affinities, family or emotional ties, or any other relevant connection or shared interest; That they will inform the contracting authority, without delay, of any situation constituting a conflict of interest or which could give rise to a conflict of interest; That they have not made and will not make any offer of any type whatsoever from which an advantage can be derived under the contract; That they have not granted and will not grant, have not sought and will not seek, have not attempted and will not attempt to obtain, and have not accepted and will not accept, any advantage, financial or in kind, to or from any party whatsoever, constituting an illegal practice or involving corruption, either directly or indirectly, as an incentive or reward relating to the award of the contract. 5.2. Exclusion criteria Tenderers shall be excluded from participation in a procurement procedure if: They are bankrupt or being wound up, are having their affairs administered by the courts, have entered into an arrangement with creditors, have suspended business activities or are in any analogous situation arising from a similar procedure provided for in national legislation or regulations; They have been convicted of an offence concerning their professional conduct by a judgment which has the force of res judicata; They have been guilty of grave professional misconduct proven by any means which the contracting authority can justify; They have not fulfilled obligations relating to the payment of social security contributions or the payment of taxes in accordance with the legal provisions of the country in which they are established or with those of the country of the contracting authority or those of the country where the contract is to be performed; 5

They have been the subject of a judgment which has the force of res judicata for fraud, corruption, involvement in a criminal organisation or any other illegal activity detrimental to the Communities' financial interests; Following another procurement procedure or grant award procedure financed by the Community budget, they have been declared to be in serious breach of contract for failure to comply with their contractual obligations. 5.3. Selection Criteria Tenderers should have the necessary financial, economic, technical and professional capacity to perform its obligations under the contract. In particular, the tenderer must: Be a company duly established and existing under the laws of the country of its incorporation and be registered with all relevant registration bodies in the Republic of Singapore; Have the right and power to possess, use and dispose of its assets, conduct its business as presently conducted and to enter into the proposed contract and perform any obligations that may arise from or in connection with the contract; Make sure that the decision to enter into the contract was duly made by the company (including any necessary corporate approvals) and does not conflict with any provisions of the company foundation documents or the applicable legislation; Make sure that it does not need any permit, licence or other authorisation (other than those already obtained) to enter into and comply with the contract and to perform any obligations thereunder; Be not engaged in nor, to the best of its knowledge, threatened by any litigation, or administrative proceedings the outcome of which might have a material adverse effect on performance of contractor s obligations; To the best of its knowledge and belief after due enquiry, be not in violation of any legislative requirement relevant for the performance of contractor's obligations. 5.4. Award criteria Contract will be awarded to the tenderer whose tender is complete, has a good understanding of the needs of the EU Delegation and offers best value for the money. 6
