Ticketing Terms and Conditions These Terms explain how you can purchase Tickets from our Site. Please read these Terms carefully before purchasing Tickets from us. When purchasing any Tickets you agree to accept and be bound by these Terms and our Site Terms, if you do not agree to them you should not purchase Tickets or use the Site. By clicking the accept button you acknowledge that you have read, understood and agree to be bound by these Terms. Definitions Box Office means the box office at the Theatre where the Performance you purchase a Ticket for is to take place. Performance means the show on the set day and time for which you purchase a Ticket. Site means this website www.nimaxtheatres.com and its ticketing website tickets.nimaxtheatres.com. Site Terms means the Site terms and conditions of use which govern how you use this Site. http://nimaxtheatres.com/terms-and-conditions/ Terms means these Ticketing Terms and Conditions. Tickets means a ticket or tickets you purchase from us for a Performance at one of our Theatres. Theatre means a theatre owned or operated by us. we/us/our means Nimax Theatres Limited which is a company incorporated in England and Wales with registered number 05493237 and whose registered office is at 11 Maiden Lane, London WC2E 7NA. you/your means you the purchaser of a Ticket. 1. Contract 1.1 Your contract for purchase of Tickets starts as soon as we have confirmed your purchase order by confirmation email and ends immediately after the Performance ends. All Ticket purchases are subject to payment card verification and other security checks and your transaction may be cancelled if it has not passed our verification process. 1.2 We reserve the right not to accept any order, or to cancel any transaction or booking, which we reasonably suspect to have been made fraudulently. 1.3 You consent to the data you have supplied to us to be shared with third party marketing and data companies engaged by us for the sending of customer visit emails on our behalf and for the creation of statistical reports.2. Tickets 2.1 All Tickets are sold subject to availability and as set out expressly in these Terms. 2.2 Where a concession is claimed, proof of identity and concession entitlement may be required.
2.3 Every member of the audience, including children, must be in the possession of a valid Ticket to gain entry to the Theatre. 2.4 Tickets are sold subject to our right to make alterations to the advertised time, programme or cast. 2.5 When purchasing Tickets from us there may be a restriction as to the maximum number you can purchase. Any such restriction will be notified to you at the time you place your order with us. We reserve the right to cancel Tickets purchased in excess of this number without prior notice unless the purchase of excess was due to our error. 2.6 Tickets may be sold subject to certain restrictions on use or entry such as a restricted, obstructed or side view, or a minimum age. Any such known restrictions shall be displayed on our Site or otherwise notified to you before or at the time that you book a Ticket. 2.7 You only have a right to a seat of the value corresponding to that stated on your Ticket. We reserve the right to provide alternative seats to those stated on your Ticket (whether before or during the Performance). 2.8 Please check your Tickets carefully upon receipt as it is your responsibility and mistakes cannot always be rectified after purchase. Contact us immediately if there is a mistake. 2.9 If Tickets are resold or transferred for profit or commercial gain by anyone other than a person authorised by the Theatre, then the Tickets will become void and the Ticket holder may be refused entry or ejected from the Theatre. 3. Price/Payment 3.1 The price of the Ticket shall be the price set at the time we accept your order, except in the case of obvious error. If we discover the price of a Ticket is obviously wrong we will inform you as soon as possible and give you the option of confirming your order at the correct price, or cancelling your order. 3.2 All prices set are inclusive of VAT and include a booking fee (where applicable) and a restoration levy. 3.3 We accept payment by the following credit/debit cards: Visa, Master Card, American Express, Maestro, Visa Electron and JCB. No order will be accepted until we receive full payment. 4. Delivery 4.1 Tickets will only be delivered to the UK billing address of the credit/debit card holder, unless we specifically offer you the facility for Tickets to be sent to an alternative UK address. Tickets will be delivered within 7 working days unless otherwise specified at the time of booking 4.2 If your Tickets are not being held at the Theatre s Box Office and you have not received your Tickets from us 72 hours before the Performance, please contact us. 4.3 If you are collecting your Tickets from the Theatre s Box Office, you must have your order acknowledgment email and the credit/debit card used to make payment.
4.4 We reserve the right to make Tickets available for collection at the Theatre s Box Office. You will be notified by email of the arrangements for collection (using the details provided at the time of ordering) if this becomes necessary. Where there is not enough time to deliver Tickets, you will be told at the point of purchase the arrangements for collection. 5. Cancellation/Refunds/Exchanges 5.1 For all performances with the exception of Harry Potter and the Cursed Child, tickets cannot be exchanged or refunded. In the event of a performance being cancelled, where possible and subject to availability, you will be offered alternative performances up to the seat value on their ticket. If we are unable to offer a you an alternative performance, a refund will be offered. 5.2 For performances of Harry Potter and the Cursed Child, all tickets purchased at least 28 days prior to the performance may be returned for a refund at any time up to 48 hours prior to the start of the performance if properly returned in accordance with conditions set out on https://www.harrypottertheplay.com/questions/ including payment of the refund fee. If tickets are purchased within 28 days of the performance refunds are not guaranteed however if you are unable to attend a performance and contact us we will try to assist if and where possible. All returns at any time are at our discretion. 5.3 If there is a material change to the Performance, you may exchange your Ticket for an alternative Performance (subject to availability) up to the value of the Ticket you purchased or receive a refund of your Ticket price. 5.4 A material change is a change which in our reasonable opinion makes the Performance materially different to the Performance that purchasers of the Ticket, taken generally, could reasonably expect. The use of understudies shall not be a material change. 5.5 It is your responsibility to ascertain whether a Performance has been cancelled or rescheduled. We will use reasonable endeavours to notify you using the details you provided to us at the time of ordering. We do not guarantee that you will be informed of such a cancellation before the date of the Performance. 5.6 Where such a refund is sought you must bring it to our attention as soon as possible of becoming aware of such change, cancellation or reschedule, prior to the rescheduled Performance. 5.7 Refunds shall only be made to the person who purchased the Tickets using the same means of payment, except at our discretion where payment was made by cash. 6. Resale of Tickets 6.1 Tickets may be returned to the Theatre s Box Office for resale up to 24 hours before the Performance. We only place returns on sale after all other Tickets for that Performance have been sold. 7. Liability
7.1 Liability for the cancellation or rescheduling of the Performance, or for material changes to a Performance, will be limited to the price paid by you to us for the Ticket including any booking fee and restoration levy, but excluding any postage fee. Personal arrangements including travel, accommodation or hospitality relating to the Performance which have been arranged by you are entirely at your own risk. 7.2 We do not accept responsibility for the loss, theft or damage of any personal property. 7.3 Nothing in these Terms seeks to exclude or limit our liability for death or personal injury caused by our negligence, fraud or other type of liability which cannot be excluded by law. 8. Admission and Attendance 8.1 We reserve the right to refuse admission to Ticket holders in reasonable circumstances including for health and safety, licensing reasons or where a Ticket is void. 8.2 We reserve the right to refuse admission to and to remove audience members displaying aggressive behaviour and to remove Ticket holders behaving in a violent or unreasonable manner. 8.3 Security searches may be conducted to ensure the safety of all audience members and your cooperation in conducting these is appreciated. 8.2 Latecomers may be admitted into the auditorium when a suitable break in the performance occurs but admission cannot always be guaranteed.8.3 By attending a Performance, Ticket holders consent to the filming and sound recording of themselves as members of the audience. 8.4 Ticket holders must comply with all relevant statutes, safety regulations and Theatre announcements whilst attending the Performance. 8.5 Ticket holders may only leave and re-enter the Theatre at the discretion of the Theatre manager, otherwise there will be no re-admissions of any kind. 9. Restrictions 9.1 The use of equipment for recording or transmitting (by digital or other means) any audio, visual or audio-visual material or any information or data inside any Theatre is strictly forbidden. Unauthorised photographs, videos, recordings, or similar items may be destroyed or deleted. Any recording made of a Performance in breach of these conditions shall belong to the producer of the Performance. 9.2 Mobile phones, tablets, messaging equipment, laser pens or any other electronic equipment should be disabled when Ticket holders are inside the Theatre auditorium. 9.3 Smoking and the use of e-cigarettes is prohibited in the Theatre. 9.4 Audience members are not permitted to consume their own food and drink in the Theatre. 10. Queries/Complaints
10.1 If you have any comments or complaints regarding your purchase from us, contact us on 0330 333 4815 Monday to Friday 10am 6pm (closed bank holidays) or via email: boxoffice@nimaxtheatres.com. 10.2 If you have any comments or complaints during the Performance, including the ability to view or hear the Performance, you should speak to the Theatre manager before or during the Performance. 11. General 11.1 No one other than a person who is a party to these Terms has any rights to enforce these Terms. 11.2 If any part of these Terms cannot be enforced for any reason, the other provisions will continue to apply. 11.3 If we delay or fail to enforce any of these Terms it does not mean that we have waived our right to do so. 11.4 We will try to resolve any disputes quickly and efficiently. If you are unhappy with the way we deal with any dispute and you want to take court proceedings, the relevant courts of England will have exclusive jurisdiction in relation to the Terms. Relevant English law will apply to these Terms. 11.5 We may change these Terms from time to time by amending this page. By continuing to use this Site you accept the current version of the Terms at the time of your use.
