The object of the by-law is to exert control over demolition projects within the municipal territory. Given in North Hatley, July 3, 2017.

2017-07-03.10 PERMIT SUBJECT TO PIIA GUIDELINES 35-41, RUE MAIN WHEREAS the CCUP held a regular meeting on June 14, 2017; WHEREAS a request was submitted for the installation of two signs, one sign perpendicular to the balcony post leading to the main floor of the building to identify the business located on the 2 nd floor at 35-41, rue Main and one sign on the post in the front yard. WHEREAS the new signs will be the same size as the existing ones; WHEREAS the CCUP recommends that the project be approved; UPON PROPOSAL DULY MOVED BY GUY VEILLETTE THAT Council accept the recommendation of the CCUP. 2017-07-03.11 REQUEST FOR MINOR DEROGATION FRONT YARD HEIGHT OF FENCE 455, RUE HOVEY, ZONE RA-3 WHEREAS a request was submitted for the installation of a fence; WHEREAS the proposed model of fence for installation at the limit of the property is 2 meters in height; WHEREAS the installation of the said fence in the front yard would also be 2 meters in height; WHEREAS provisions under the zoning by-law (article 10.1 clôtures et haies) stipulate that a front yard fence can only be a maximum of 1 meter in height; WHEREAS the CCUP does not recommend that the project be approved; UPON PROPOSAL DULY MOVED BY GUY VEILLETTE THAT Council accept the recommendation of the CCUP and not approve the request. 2017-07-03.12 NHRS PROTOCOL AGREEMENT SIGNING AUTHORIZATION WHEREAS the North Hatley Recreational Society (NHRS) is a not for profit organization whose mission is to offer sporting activities to the community as a whole, and particularly to youth and families, at affordable rates; WHEREAS the Municipality of the Village of North Hatley is the owner of the sites designated for recreational activities; WHEREAS the NHRS makes use of sites of which the MUNICIPALITY is the owner and hosts activities on them; WHEREAS the Municipality recognizes the role of the NHRS and supports it in its mission; WHEREAS the Municipality and the NHRS both recognize the positive impact of sports activities on the quality of life of citizens and are in agreement to work together to provide a variety of high-quality activities; WHEREAS the MUNICIPALITY and the NHRS want to promote access to activities by families; WHEREAS the MUNICIPALITY and the NHRS have agreed to conclude a protocol agreement with the goal of establishing a collaborative framework and a commitment by both parties on beach, tennis court, baseball park and outdoor rink usage and the promotion of related activities.

UPON PROPOSAL DULY MOVED BY MARCELLA DAVIS GERRISH THAT Municipal Council approve the protocol agreement with the NHRS; THAT the Mayor, Michael Page, and the Director-General and Secretary-Treasurer, Daniel Décary, be designated to sign the protocol agreement with the NHRS. 2017-07-03.13 PLEASANT VIEW BEACH BEACH SAFETY MEASURES WHEREAS the numbers of drownings in Quebec are alarming and there is a need and opportunity to ensure increased safety measures; WHEREAS the Municipal Council is concerned for the safety of all citizens, and in particular for young children; WHEREAS Pleasant View Beach is located in close proximity to a residential area; WHEREAS the beach is widely used by families in North Hatley and the surrounding areas; WHEREAS there is a need to increase safety measures outside regular beach hours that are under qualified supervision; WHEREAS the protocol agreement between the Municipality of the Village of North Hatley and the NHRS, that oversees beach activities, stipulates regular operating hours under qualified supervision; UPON PROPOSAL DULY MOVED BY NORMAND JOLICOEUR THAT access to the beach be prohibited outside regular hours of operation under qualified supervision; THAT the NHRS, mandated to oversee beach activities, ensure that the beach area is made secure by locking all access to the beach house and the access gate to the site and that beach closed no supervision signs are clearly visible outside regular hours as outlined in the protocol agreement between the said parties or in the absence of qualified personnel in charge of the supervision of beach goers. THAT the NHRS ensure that all beach goers have left the site when the beach closes for the day. 2017-07-03.14 VARIA 2017-07-03.14.1 DRAFT DECREE FOR THE DECLARATION OF A SPECIAL INTERVENTION ZONE IN THE TERRITORY OF LOCAL MUNICIPALITIES AFFECTED BY SPRING FLOODING IN APRIL AND MAY 2017- REQUEST FOR EXCLUSION BY THE MUNICIPALITY OF THE WHEREAS there is a draft decree by the Quebec government to declare a special intervention zone in the territory of some local municipalities affected by flooding in April and May 2017; WHEREAS the Municipality of the Village of North Hatley was included in the list of municipalities affected by spring flooding in April and May 2017 for prevention purposes and at the suggestion of the Direction régionale de la sécurité civile et sécurité incendie de la Montérégie et de l Estrie du Ministère de la Sécurité publique, and in order to be admissible, if needed, to the Programme général d'aide financière lors de sinistre; WHEREAS the Municipality of the Village of North Hatley was not affected by spring flooding in April and May 2017 and that, as such, no repair or reconstruction work due to damages is required on its territory; WHEREAS on May 5, 2017, the Municipality of the Village of North Hatley notified the Direction régionale de la sécurité civile et sécurité incendie de la Montérégie et de l Estrie du Ministère de la Sécurité publique that no claim for damages was foreseen within the framework of the Programme général d'aide financière lors de sinistre;

WHEREAS a study and a mapping of the flood zone in North Hatley were completed in 2013 and, with additional information, in May 2017, and highlighted the high-velocity zones and low-velocity zones; WHEREAS a Management Plan was put into place over the course of the last two years under the coordination of the MRC de Memphrémagog for a section of the territory of the Municipality of the Village of North Hatley located in a flood zone, in order to complete and consolidate the urban planning of a urban sector that is already developed and connected to a water and sewer network, to bring about a renewal of economic activity with the revival of the village centre of the municipality, by allowing the inclusion of new or redeveloped projects of quality and establishing specific protective norms and measures for this territory; WHEREAS the Management Plan was put into place in accordance with the strictest of guidelines of the Ministère du Développement durable, de l Environnement et de la Lutte contre les changements climatiques, the Ministère des Affaires municipales et de l Occupation du territoire, the Ministère des Forêts, de la Faune et des Parcs, the Ministère de la Sécurité publique and the Direction de Santé Publique du CIUSSS de l Estrie CHUS, to ensure compliance with government policy; WHEREAS one of the requirements under the Management Plan is the channelization and reestablishment of the Kezar brook that is partially located in the area under review, for which the Ministère des Affaires municipales et de l Occupation du territoire required that the Municipality submit a request for a certificate of authorization prior to the adoption of the by-law modifying the land-use plan, for incorporation into the management plan, the said request having been submitted on May 15, 2017; WHEREAS By-law 21-16 modifying the revised land-use plan (adopted under By-law 8-98), in order to incorporate the Plan de gestion de la zone inondable de la rivière Massawippi pour le Village de North Hatley was adopted by the MRC de Memphrémagog on June 21, 2017; WHEREAS a Programme particulier d urbanisme (PPU) was established, in over the course of the last two years, for the sector under review of the territory and the municipality is to present the plan, as well as the related modified regulations, to the citizens; WHEREAS the said Programme particulier d urbanisme (PPU) outlines the sustainable development criteria for all eventual construction projects, notably the requirement for LEED (Leadership in Energy and Environmental Design) certification that includes optimal performance in terms of water management; WHEREAS a study was conducted to determine the foreseeable impact of climate change on water levels in the Massawippi River to allow the Municipality to set an increased level of protection for buildings and other eventual structures and work projects in the targeted zone; WHEREAS the study on climate change took into consideration the recommendations made by various organizations including the Centre d expertise hydrique du Québec, the Ministère des Transports du Québec (MTQ), the Ministère du Développement durable, de l Environnement et de la Lutte aux changement climatiques and the organization Ouranos, which resulted in an increase of 32 centimeters that will be applied to the 100- year flood elevation; WHEREAS the safety of persons is the priority for the municipality, in the targeted sector of the territory, garages only will be permitted below ground level and access will be limited to the level of the 100-year flood elevation, with the additional 32 centimeters; WHEREAS the sector of the territory under review will have improved security standards with the application of the Management Plan and the Programme particulier d urbanisme (PPU); WHEREAS the removal of the Municipality of the Village of North Hatley from the list of municipalities affected by flooding in April and May 2017 will allow the MRC de Memphrémagog to conclude the process for the adoption of the Management Plan; WHEREAS the removal of the Municipality of the Village of North Hatley from the list of municipalities affected by flooding in April and May 2017 will allow it to proceed with the presentation and adoption of its Programme particulier d urbanisme (PPU); UPON PROPOSAL DULY MOVED BY MICHAEL PAGE
