OBJEKTIF PROGRAM (1) Menyediakan peluang kepada staf untuk menjalankan tugas ilmiah dan kerja- kerja kreatif yang dapat meningkatkan sumbangan ke arah mencapai visi dan misi Universiti. (2) Meningkatkan kemahiran dalam disiplin dan profesion staf (3) Memberikan peluang untuk memperolehi kemahiran baru yang dapat meningkatkan kemajuan dan pembangunan dalam kerjaya staf. 2. SYARAT & KELAYAKAN PERMOHONAN (1) Staf Akademik yang berstatus Penduduk Tetap (PR) hendaklah memenuhi syarat dan kelayakan berikut: a) Bertaraf kontrak dan telah berkhidmat di Universiti Malaya sekurangkurangnya selama 3 sebelum permohonan. b) Mempunyai baki tempoh kontrak yang mencukupi bagi tempoh ikatan perkhidmatan yang ditetapkan di bawah Cuti Sabatikal yang dipohon. c) Mempunyai kelayakan Ijazah Doktor Falsafah (PhD) dan memegang jawatan sebagai Pensyarah Kanan, Profesor Madya atau Profesor; d) Menghasilkan penerbitan seperti yang ditetapkan dalam KEY PERFORMANCE INDICATOR (KPI) tahunan masing-masing. e) Staf perlu mengajar selama sekurang-kurangnya 7 minggu dalam sesuatu tahun akademik sebelum atau selepas mengikuti cuti sabatikalnya. f) Penyelidikan yang dijalankan mestilah berkaitan dengan bidang kepakaran staf. g) Mencapai tahap prestasi yang ditetapkan oleh Pihak Universiti bagi tempoh 3 tahun berturut-turut; h) Bebas daripada pertuduhan dan tindakan tatatertib; dan i) Telah mendapat kelulusan daripada Ketua Jabatan dan Ketua PTj masing- masing: (2) Staf berikut tidak layak untuk memohon:- a) Bertaraf pelawat b) Memegang jawatan sebagai Felo Penyelidik, Felo Penyelidik Kanan, Pakar Perunding, Pakar, Profesor Adjung, Karyawan Tamu dan Penyandang Kursi. 1 2
3. TEMPOH/TEMPAT PROGRAM (1) Tempoh Program adalah 5 bulan dan boleh dilaksanakan secara tempatan atau luar negara. Sekiranya dijalankan di luar negara tempoh penyelidikan hendaklah minimum 4 bulan dan dijalankan di Institusi Pendidikan yang ternama atau dibawah seliaan Profesor yang tersohor. (2) Kemudahan ini boleh diambil sekali sepanjang tempoh perkhidmatan. 4. PROSEDUR PERMOHONAN (1) Staf perlu mengemukakan permohonan berserta rancangan cuti sabatikal untuk pertimbangan pihak Universiti. (2) Permohonan hendaklah dikemukakan kepada Bahagian Sumber Manusia (BSM) melalui Ketua Jabatan dan Ketua PTj untuk pertimbangan dan kelulusan Pihak Universiti dalam tempoh tiga bulan sebelum mengikuti Program. (3) Ketua Jabatan/Ketua PTj bertanggungjawab memastikan staf yang memohon untuk menjalani Program ini memenuhi syarat yang ditetapkan. 5. PELANJUTAN Sebarang pelanjutan tempoh adalah tidak dibenarkan. Staf juga tidak dibenarkan untuk mengambil cuti penyelidikan sebelum atau selepas cuti sabatikal secara berterusan. 6. IKATAN PERKHIDMATAN DAN TUNTUTAN GANTIRUGI (1) Kelulusan Program ini kepada staf adalah tertakluk kepada syarat bahawa staf itu hendaklah melaksanakan suatu perjanjian, mengaku janji akan berkhidmat di Universiti selama tempoh yang ditetapkan atau membayar gantirugi sekiranya melanggar syarat perjanjian. (2) Staf hendaklah melengkapkan dan mengembalikan borang-borang yang berkaitan dan dokumen perjanjian yang telah dimatisetemkan selewat- lewatnya satu (1) bulan sebelum memulakan Program. (3) Tempoh ikatan perkhidmatan yang akan dikenakan kepada staf adalah seperti berikut: TAHUN PERKHIDMATAN TEMPOH IKATAN PERKHIDMATAN 3 tahun perkhidmatan atau lebih 5 bulan 1 tahun 2 2
(4) Staf dikehendaki untuk membayar balik jumlah gantirugi yang dinyatakan beserta kos sebenar emolumen (gaji dan elaun tetap) yang telah dibayar kepada staf sepanjang tempoh mengikuti Program, sekiranya staf:- a) Melanggar perjanjian b) Tidak mengemukakan bukti artikel penyelidikannya telah dihantar untuk diterbitkan dalam jurnal bertaraf ISI atau setaraf dengannya 7. ELAUN DAN KEMUDAHAN (1) Gaji Staf akan dibayar emolumen (gaji dan elaun tetap) seperti biasa sepanjang tempoh mengikuti Program. (2) Elaun Staf yang diluluskan cuti sabatikal di luar negara (satu negara sahaja) bagi tempoh minimum 4 bulan secara berterusan dan secara tempatan akan diberi: Secara Tempatan Elaun sarahidup berjumlah RM 900.00 sebulan Elaun Buku berjumlah RM750.00 (sekali sahaja) Secara Luar Negara Elaun Sarahidup mengikut kadar negara seperti diluluskan oleh JPA (sebulan) bagi tempoh di luar negara dan kadar elaun RM900.00 sebulan bagi tempoh di dalam negeri Elaun Buku berjumlah RM750.00 (sekali sahaja) Elaun Pakaian Panas RM1,500.00 untuk cuti sabatikal di negara yang beriklim sederhana dengan syarat tidak menerimanya dalam tempoh 3 tahun yang lepas. Insurans Kesihatan/Skim Kesihatan Pelajar Tambang kapal terbang kadar ekonomi pergi dan balik dari KL ke lapangan terbang antarabangsa tempat sabatikal dijalankan mengikut kelayakan dan tambang kereta api kelas kedua dari lapangan terbang ke tempat cuti sabatikal (jika dikehendaki berbuat demikian). (3) Cuti Rehat a) Kelayakan cuti rehat bagi tahun semasa adalah berdasarkan kiraan pro- rata. b) Staf tidak layak mendapat cuti rehat semasa dalam tempoh cuti sabatikal. c) Cuti rehat yang dikumpulkan sebelum memulakan cuti sabatikal adalah dianggap luput mulai dari tarikh staf memulakan cuti sabatikal d) Staf yang diluluskan cuti sabatikal hendaklah: i. menghabiskan baki cuti rehat tersebut sebelum memulakan cuti sabatikal, dan/atau ii. memohon menukarkan baki cuti rehat tahunan kepada gantian cuti rehat (GCR)* tertakluk kepada syarat yang ditetapkan dalam Garis Panduan Mengenai Permohonan Membawa Ke Hadapan Baki Cuti Rehat Tahunan Dan Menukar Baki Cuti Rehat Tahunan Kepada Gantian Cuti Rehat (GCR) e) Semua permohonan berkaitan cuti rehat hendaklah dikemukakan ke Unit Perkhidmatan, Bahagian Sumber Manusia sebelum staf memulakan cuti sabatikal. Staf akan diberi pengecualian mengajar sepanjang tempoh menjalani Program tersebut. Walau bagaimanapun, staf masih perlu meneruskan tugas penyeliaan sekiranya ada. 8. ELAUN-ELAUN YANG DIBERHENTIKAN SEPANJANG TEMPOH CUTI SABATIKAL (1) Elaun Insentif Perkhidmatan Kritikal (2) Bayaran Insentif Akademik (BIA) 9. TINDAKAN SELEPAS TAMAT PROGRAM (1) Staf yang telah menjalani program ini hendaklah mengemukakan laporan dalam tempoh 30 hari sekembalinya daripada menjalani cuti sabatikal. (2) Staf dikehendaki menghasilkan 1 jurnal ISI atau 2 artikel yang setaraf dengannya. (3) Mengemukakan bukti bahawa artikel penyelidikannya telah dihantar untuk diterbitkan dalam jurnal bertaraf ISI atau setaraf dengannya. (4) Staf perlu mengemukakan justifikasi secara bertulis sekiranya tidak dapat mencapai hasil seperti yang disyaratkan. (5) Pihak Universiti boleh mengambil tindakan sewajarnya sekiranya staf gagal mengemukakan laporan berkenaan dalam tempoh yang ditetapkan dan staf akan dikehendaki membayar ganti rugi sekiranya tidak memenuhi hasil seperti yang dikehendaki. 10. PEMBATALAN (1) Pembatalan adalah dibenarkan sebelum memulakan program. Staf akan dikecualikan dari tempoh ikatan perkhidmatan dan gantirugi. (2) Pembatalan dari program hendaklah dikemukakan ke BSM melalui Ketua 4 2
Jabatan dan Ketua PTj. 11. KEY PERFORMANCE INDICATOR (KPI) Staf perlu mencapai tahap KPI dari aspek penyelidikan, penerbitan dan penyeliaan yang ditetapkan oleh pihak Universiti sepanjang tempoh Program. 12. PEMATUHAN PERATURAN DAN TATATERTIB Staf sentiasa tertakluk kepada undang-undang, peraturan tatatertib, peraturan perkhidmatan awam, peraturan kewangan, pekeliling/surat pekeliling dan surat arahan yang dikeluarkan oleh Kerajaan dan pihak Universiti dari semasa ke semasa. 13. HAK UNIVERSITI Pihak Universiti berhak meminda atau menamatkan Program ini mengikut had-had perjanjian, atau kepentingan perkhidmatan atau kepentingan Universiti dari masa ke semasa tanpa memberi notis dan apa-apa keputusan Universiti adalah muktamad. 14. LAIN-LAIN (1) Staf tidak dibenarkan menjalankan pengajaran sambilan sepanjang tempoh mengikuti Program sekiranya staf didapati berbuat sedemikian staf akan dikenakan tindakan tatatertib. (2) Staf perlu mengisytiharkan sebarang penajaan yang diterima daripada institusi dalam/luar sepanjang tempoh cuti sabatikal. (jika ada) 5 2
1. OBJECTIVES OF THE SABBATICAL LEAVE (1) To provide opportunities for staff to perform their scholarly duties and creative work enabling them to increase their contribution towards achieving the vision and mission of the University. (2) To enhance the staff in their discipline and professional skills. (3) To provide opportunities for acquiring new skills that will enhance staff s career advancement and development. 2. REQUIREMENTS AND ELIGIBILITY (1) Academic staff with a Permanent Residency (PR) status who meets the following requirements are eligible to apply: a) A staff on contract and who has been in service with the University of b) Malaya for at least 3 years before applying. c) Have sufficient duration of time as the service bond for the contract of service upon return from the Sabbatical Leave. d) Possess a Doctor of Philosophy degree/s (PhD) and is currently the incumbent Senior Lecturer, Associate Professor or Professor; e) Produced publications as determined by their established KEY PERFORMANCE INDICATOR (KPI). f) Staff are to teach for at least 7 weeks in an academic year before/after the g) Sabbactical Leave. h) To carry out research which is relevant to the staff s area of expertise. i) Has achieved the performance level as determined by the University for three (3) consecutive years. j) Must be free of any charges and disciplinary action/s; and k) Have obtained approval from the respective Head of Department and the l) Head of the Responsibility Centre. (2) The following staff are not eligible to apply: - a) Visiting Scholars/Academicians b) Research Fellows, Senior Research Fellows, Consultants, Specialists, Adjunct Professors, Resident Artists and Chairholders 3. DURATION AND LOCATION OF THE SABBATICAL LEAVE (1) The Sabbatical Leave is for a duration of five (5) months and can be carried out locally or abroad. If the Sabbatical Leave is to be carried out abroad, it must be at least for a minimum period of four (4) months at a world-renowned university or under the supervision of an eminent Professor. (2) This privilege is extended to staff only once throughout their entire service. 6 2
4. APPLICATION PROCEDURE (1) Applicants must complete the Sabbatical Leave Application form and together with the itinerary for their Sabbatical Leave submit to the University for consideration. (2) The completed form must be submitted to the Human Resource Division through the respective Head of Department and the Head of the Responsibility Centre for the University s consideration and approval three (3) months before the commencement of the Sabbatical Leave. (3) The Head of Department/Head of the Responsibility Centre is responsible in ensuring that the applicant fulfills the requirements of the Sabbatical Leave. 5. EXTENSION OF THE SABBATICAL LEAVE The University will not entertain any request for the extension of the Sabbatical Leave. In addition, Research Leave is not allowed to be taken continuously before and after the Sabbatical Leave. 6. SERVICE BOND AND COMPENSATION (1) The approval of the Sabbatical Leave is on the condition that the applicant signs an agreement to serve the University for a duration of time as determined by the University, upon return from the Sabbatical Leave. Failure to comply to this condition may result in the staff having to pay a compensation to the University as stipulated in the agreement. (2) The applicant is required to complete and submit the relevant forms and the stamped agreement no later than one (1) month prior to the commencement of the Sabbatical Leave. (3) The duration of time determined for the service bond is as follows : YEARS OF SERVICE SABBATICAL PERIOD SERVICE BOND 3 years and above 5 months 1 year (4) Staff are required to reimburse the actual cost of emoluments (salary and fixed allowances) disbursed while on Sabbatical Leave as determined by the University if: a) there is a breach of agreement. b) the staff fail to produce evidence for the submission of research article/s to be published in the ISI-indexed journal or its equivalent. 7. ALLOWANCES AND BENEFITS (1) Salary Staff will be paid an emolument (salary and fixed allowances) based on the current substantive appointment for the entire duration of the Sabbatical Leave. 7 2
(2) Allowances a) Staff on Sabactical Leave locally and abroad (subject to only one country) for a minimum period of four (4) months continuously will be entitled to the following allowances: Local Monthly subsistence allowance of RM 900.00 Book allowance of RM750.00 (To be claimed only once) Not applicable Abroad Monthly subsistence allowance (As approved by the JPA (Jabatan Perkhidmatan Awam/ Public Service Department). Book allowance of RM750.00 (To be claimed only once) Winter clothing allowance of RM1,500.00 for Sabbatical Leave in temperate countries on the condition that no such claims have been made over the past three (3) years. Not applicable Health Insurance/ Students Health Scheme Not applicable Return air tickets from Kuala Lumpur to the respective countries and a return second class train tickets from the airport to the destination (if required) will be paid accordingly based on the staff s qualification. (3) Annual Leave a) The entitlement for the current year is based on a pro-rated basis. b) Staff are not eligible for annual leave during the Sabbatical Leave. c) Any annual leave accumulated before the commencement of the Sabbatical Leave will be deemed to have lapsed from the date of the commencement of the Sabbatical Leave. d) Staff granted the Sabbatical Leave are required to: i. take the remaining annual leave before the commencement of the ii. Sabbatical Leave, and/or iii. apply to convert the remaining annual leave for Golden Handshake iv. (GCR)*. terms and conditions applied in accordance to the Guidelines on the application for GCR. e) Application for annual leave are to be submitted to the Service Unit, Human Resource Division before the commencement of the Sabbatical Leave. Staff will be exempted from teaching duties for the entire duration of the Sabbatical Leave. However, he/she is required to continue his/her duty to supervise his/her student/s (if any) while on Sabbatical Leave. 8. ALLOWANCES THAT WILL NOT BE PAID DURING THE SABBATICAL LEAVE (1) Critical Service Incentive Allowance (2) Academic Incentive Payment 9. REQUIREMENTS ON THE COMPLETION OF THE SABBATICAL LEAVE Staff are required to: (1) submit a report on the scholarly/research activities undertaken, no later than thirty (30) days on the completion of the Sabbatical Leave. (2) publish 1 article in an ISI-indexed journal or 2 articles in an equivalent journal. (3) provide evidence on the submission of research article/s for publication in the ISI-indexed journal or its equivalent. (4) submit a written justification for failure to achieve the outcome of a Sabbatical Leave as required. (5) The University may take the appropriate action/s against the staff for failure to submit the relevant report within the stipulated period granted. In addition, the staff will be required to reimburse the University for the amount (in full) disbursed for the Sabbatical Leave. 9 2
10. CANCELLATION OF LEAVE (1) Cancellation is allowed before the commencement of the Sabbatical Leave and staff will be exempted from the service bond agreement and compensation. (2) Any request for cancellation of the Sabbatical Leave must be submitted to the Human Resource Division through the respective Head of Department and the Head of the Responsibility Centre. 11. KEY PERFORMANCE INDICATOR (KPI) Staff are required to fulfill their KPI with respect to research, publication and supervision as determined by the University throughout the Sabbatical Leave. 12. GOVERNING ACTS (INCLUDING DISCIPLINARY ACT/RULES AND REGULATIONS/CIRCULARS/DIRECTIVES Staff are at all times governed by the existing Acts (including Disciplinary Act)/Rules and Regulations/Circulars/Directives and those issued from time to time by the University and the Government of Malaysia. 13. THE RIGHTS OF THE UNIVERSITY The University of Malaya reserves the right from time to time to amend or to terminate the Sabbatical Leave based on the terms and conditions of the agreement and the University s interest without giving any prior notice. Any decision made shall be deemed as final. 14. OTHER TERMS AND CONDITIONS (1) Staff are not allowed to conduct part-time teaching during the entire duration of their Sabbatical Leave. In breach of this condition, disciplinary action will be taken against the staff. (2) Staff must declare for any sponsorship/s received from local/international institutions during the Sabbatical Leave. 10 2
