WINDMILL CROSSING HOMEOWNERS ASSOCIATION, INC. Architectural Committee Guidelines For Townhomes In accordance with Article VIII Section I of the Declaration of Covenants, Conditions/ and Restrictions for Windmill Crossing Homeowners Association, Inc. (the "Covenants"), the Architectural Committee has the right to adopt rules and regulations regarding the administration, interpretation, and enforcement of the Architectural Review provisions of the Covenants. All applications for proposed improvements must be submitted in writing using the application form authorized by the Architectural Committee. A copy of this form is included in this handbook. Applications must be complete in order to commence the review process. Incomplete applications will be returned to the applicant with a statement of deficiencies which must be remedied in order to be considered for review. NO WORK IS TO BE COMMENCED BEFORE APPROVAL IS GIVEN. The Architectural Committee has adopted the following rules and regulations: ATTIC VENTILATORS: Attic ventilators and turbines are permitted if painted to match the color of the roof (if roof mounted) or the color of the house siding or trim (if mounted on a gable end). Ventilators and turbines should be mounted on the least visible side of the ridgeline so as to minimize their visibility. AWNINGS; In general, exterior awnings will be prohibited unless demonstrated to be clearly compatible with the architectural design and qualities of the home, and

screened from the view of adjoining neighbors due to the proposed location of installation. The Architectural Committee must approve awnings and applications will be considered on an individual basis. CLOTHES LINES: Clothes lines or similar apparatus for the exterior drying of clothes will not be permitted. DECKS: Materials: Must be compatible with the house. Decking: Pressure treated wood with a clear sealer (no stain) or synthetic material must be approved (Trex, Timber Tech, etc.). Rating: Must be pressure treated with clear sealer or white vinyl. Details: Cannot extend in front of the rear building line. Stairs to ground level are permitted. "When requesting approval, size and location must be detailed on the site plan. DOG HOUSES AND DOG RUNS: Doghouses and dog runs are prohibited. EXTERIOR AIR CONDITIONERS: Individual air conditioning units extending from windows are prohibited. Exterior air conditioning units or heat pumps may be relocated or added if there is no adverse impact to adjoining properties. The Architectural Committee must approve such relocation or addition. EXTERIOR PAINTING: An application is not required in order to repaint or restain an object to match the original color. However, all exterior color changes must be approved, including any change in shade or hue for a given color. This requirement applies to siding, doors, shutters, trim, roofing, and other appurtenant structures. FENCES; All plans and specifications submitted to the Architectural Committee for approval will be disapproved unless they meet the following criteria: Design: Fence may be pressure treated wood. Mo vinyl allowed. Height: Maximum six feet (6') including a one foot (!') lattice, with a four foot (4') wide gate. Location: Rear yard only. The fence can not extend further forward than the rear corner of the house.

FLAGPOLES: Permanent, freestanding flagpoles are prohibited. Temporary flagpole staffs, which do not exceed six feet (6'} in length, and are attached at an incline to the wall or pillar of the dwelling unit, do not require approval by the Architectural Committee. HOT TUBS/SPAS: Exterior hot tubs or spas must be located in the rear yard adjacent to the dwelling unit. The incorporation of hot tubs as an architectural feature of decks and/or patios is encouraged. The exterior finish of an elevated hot tub should blend with the exterior finish of the home, deck or patio to which attached or most closely related. GREENHOUSES: An attached greenhouse will be treated as a major alteration to a dwelling unit and subject to the same level of review. 1. They must be attached to the rear of the dwelling unit. 2. The size and design must be architecturally compatible with the home and surrounding homes. 3. There shall be no adverse visual impacts for adjoining properties. GRILLS (Permanent): Permanent grills must be placed in the rear yard of the house and as far as practical from the adjacent property lines. LANDSCAPING: All major landscape installations must be approved in advance. In general, a design review application is not required for minor landscape improvements with the following exceptions: 1. Approval is required for plantings intended to form a hedge or natural screen and which will attain more than two feet in height. 2. An application is required for the installation of railroad ties, garden timbers or similar structures, which will form a wall over 12 inches high and 8 feet long. 3. A proposed improvement which is of such a scale or type as to be inconsistent with the existing design features of the home, adjacent units and the surrounding area will require approval. Examples include the substantial or total removal of turf and replacement with another material, such as mulch or gravel.

4. Vegetable gardens shall be located behind the rear plane of the house. Vegetable gardens in excess of 64 square feet require an application. LAWN ORNAMENTS: Because of the wide variety of lawn ornaments available/ all proposed lawn ornaments visible from the road are subject to review by the Architectural Committee. Only two decorative ornaments/ not more than two feet high/ will be allowed. To provide residents with guidance as to the character of approved lawn ornaments/ please be advised that the Architectural Committee will be more likely to approve ornaments that are similar in style and character to the architectural design of the community than other styles of ornaments. All ornaments/ whether permanently affixed to the property or temporary/ except for holiday decorations/ are subject to submission to and approval by/ the Architectural Committee. Temporary decorative ornaments for specific holiday seasons will be permitted provided such ornaments are removed promptly after the conclusion of the holiday season. PATIOS: All patios require approval. Patios should be located in rear yards. Any adverse drainage/ which might result from the construction of a patio/ should be considered and remedied. The use of a partially porous patio surface or the installation of mulch beds adjacent to the patio are ways to eliminate drainage concerns. REAL ESTATE SIGNS: Only signs advertising a property for sale or rent may be displayed. Such signs must meet applicable city regulations with respect to size/ contents and removal. Signs may only be placed in the front yard or window of available properties. RECREATION AND PLAY EQUIPMENT: Semi-permanent play equipment/ which either constitutes a structure or it's appurtenant to an existing structure/ requires approval. Examples include sandboxes/ playhouses/ swing-sets/ etc... The following factors will govern approval or such equipment. 1. Location. Such equipment shall be placed in rear yards. 2. Scale and Design. The equipment should be compatible with the lot size. The design and any visual screening are additional considerations in evaluating whether or not there will be adverse visual impact. 3. Color and Materials. Equipment constructed of wood must be left in a natural condition. Covers/ awnings/ and other accessories (e.g. slides and/or swings) shall be of a single color.

BASKETBALL BACKBOARDS; Portable basketball equipment is prohibited. SATELLITE RECEIVERS: Details: Satellite dishes do not require an application provided the following guidelines are maintained. Design standards contained herein cover satellite dishes, which cover direct broadcast satellite service. Satellite receivers may be erected in accordance with the following general guidelines. 1) The satellite receiver is 1 meter (39.37 inches) or less at the broadest measurement. 2) The device may not adversely affect the view, lifestyle/ safety, or right of enjoyment of neighboring homeowners in their property. For reasons of safety/ the system shall not emit electromagnetic radiation which is either harmful/ or which interferes with the operation of any appliance/ or biomedical device in proximity of the installation of satellite receiver. 3) The satellite receiver shall be placed in a location/ which/ while providing the homeowner with an "acceptable quality signal"/ minimizes the visual impact to neighbors and roadways. An application is not required in any of the following situations/ unless the installation requires movement of landscaping. a) Ground level in the rear yard of any lot and reasonably screened from common view b) Ground level in the side yard of any lot and reasonably screened from common view c) Rear roof installation below peak of roof d) Rear elevation of any dwelling If a location not listed above is required/ the Architectural Committee will consider an alternative installation location where the homeowner can prove the requirements prohibit him/her from receiving an "acceptable quality signal." The order of preference is shown above. 4) The homeowner shall make a reasonable effort to ensure that the satellite receiver/ once erected/ will not be visible from the street or right-of-way in front of the homeowner's property.

5) The homeowner shall make a reasonable effort to ensure that no existing tree or vegetation will be removed to accommodate the satellite receiver installation or reception. If any of the above locations require the removal of existing trees or vegetation/ the homeowners must submit an application for that removal. 6) In considering the installation of any such receiver, the Architectural Committee may specify such additional reasonable measures it may deem appropriate to minimize the visual impact of such device upon the community and surrounding homeowners/ including but not limited to/ requiring the installation of landscaping or other forms of screening. 7) For example/ such additional measures may include any or all of the following conditions: a) The satellite receiver shall be located entirely within and entirely below the height of approved privacy fencing which fully encloses the rear yard of any unit or located within the boundaries of a deck and above the walking surface of a railed deck/ providing that no portion of the device projects more than six inches above the height of the deck railing. b) The satellite receiver shall be of a color and material/ which are reasonably compatible with the colors and materials of the home to which it is attached/ or painted to match the mounting site. The determination of such will be solely at the discretion of the Architectural Committee. c) Cables must be hidden from view 8) When any satellite receiver is no longer in use as such/ it shall be removed by the owner of the property upon which the device was installed. SCKEEN STORM DOORS: All plans for the addition of screen/storm door submitted to the Architectural Committee for approval will be disapproved unless they are at least 80% glass full-view doors. Doors should be the same color as the entry door or surrounding trim.

SHEDS: Sheds are prohibited without a fence. All plans and specifications submitted to the Architectural Committee for approval will be disapproved unless they meet the following criteria: Size: Not to exceed 5' x 6' X 8' Style: Freestanding, with vinyl siding to match trim or house siding. Color of roof shingles and style of roof to match owner's home. Rubbermaid sheds are prohibited. Location: Must be placed in a corner at rear of property. SECURITY BARS: In general/ the use of security bars or grates on windows and doors will be prohibited. Exceptions may be made where the security apparatus will not be visible from the street and from adjoining properties. Homeowners concerned about the security of their residence are advised to consider alternatives/ including alarms and sophisticated lock systems. SECURITY SIGNS: Two security signs/ each not exceeding a total of sixty-four (64) square inches may be posted on the property. Only one such sign may be posted forward of the front plane of the home. The approved location shall be at the front door or in shrubbery within twelve (12') feet of the front door/ or in the rear yard within six (6') feet of the house or its extensions. SIDEWALKS AND PATHWAYS; Sidewalk and pathways must be set back at least four feet from the property line and installed flush to the ground. Only stone/ brick/ concrete or similar durable construction material is allowed. The scale/ location/ and design should be compatible -with the lot/ home and surroundings. SKYLIGHTS: Skylights must be located such that they are not visible from the front of the dwelling unit. Check with Ryan Homes. SOLAR LIGHTS: Solar lights may only be placed in the landscaped beds. SOLAR PANELS: Solar panels are prohibited. SWIMMING POOLS: Above ground and temporary swimming pools are prohibited/ except for portable wading pools which do no exceed twelve inches (12") deep and eight feet (8') wide and ten feet (10') long.. TRASH COLLECTION: 7

Residents may place trash receptacles by the curb the evening before a trash pick up and such receptacles must be removed by the evening of the day on which trash collection occurs. Trash receptacles must not be visible from the streets.
