City of Needles, California Employee Report ======================================================================== Meeting Date: March 2, 2016 PLANNING COMMISSION Regular Special Title: Planning Commission Resolution No. 03-02-2016 PC A Resolution of the Planning Commission of the City of Needles Recommending Approval of a Conditional Use Permit For A Steel Building Storage Business, Vehicle Paint Facility At 1200 E. Broadway, Also Known as APN 0650-282-15 and 16 Background: Applicant Billy Berkenheger, as representative for Billy B s Arrive and Drive Boats and RV Storage recently purchased the property at 1200 E. Broadway, previously used as a warehouse facility for Colorado River Distributors. The applicant is proposing to use the existing building as a vehicle paint facility, and install two new steel buildings behind the existing facility to function as a concierge storage facility. Building A has a dimension of 165 x 200, or 33,000 square feet, and can house up to 70 boats; building B has a dimension of 165 x 350, or 57,750 square feet, and can house up to 100 boats. Installation of the new buildings is planned to be a phased approach, with installation of Bldg. A anticipated to be completed by end of 2016; installation of building B will begin as soon as occupancy of bldg. A reaches 50%. The concierge service will provide staffing who will travel to the vehicle owner s site to pick up and drop off vehicles, minimizing the traffic flow into and out of the project site. Because of this unique service offering, a traffic study is being delayed pending determination on whether traffic flow is expected to increase significantly enough to warrant the study and possible street modifications. Staffing for the vehicle paint facility is expected to be no more than 3 employees; staffing for the boat concierge service will be seasonally adjusted, anticipating 5-6 employees during the boating season and 2 employees during off-season. The applicant will be enhancing the steel buildings with 48 high cultured stone veneer along the south and a portion of the east facades, see attached exhibits. Conditional Use Permit Findings. In accordance with Section 94.07, the Planning Commission must make the following findings for a Conditional Use Permit: 1. That the requested permit is within its jurisdiction according to the table of permissible uses 2. The application is complete. 3. The use is consistent with the General Plan. 4. The use will be in harmony with the area in which it is to be located. 5. The use will not materially endanger the public health or safety 6. PC RESOLUTION 03-02-2016 PC A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF NEEDLES RECOMMENDING APPROVAL OF A CONDITIONAL USE PERMIT FOR A STEEL BUILDING STORAGE BUSINESS, VEHICLE PAINT FACILITY AT 1200 E. BROADWAY, ALSO KNOWN AS APN 0650-282-15 AND 16 WHEREAS, the Planning Commission wishes to assist property owners in their efforts to build in the City in a reasonable manner that does not create a hazard to heath, safety and welfare or degrade property values or create incompatibility with surrounding uses; and WHEREAS, metal buildings are not permitted in the City of Needles without a conditional use permit to mitigate any negative impacts. WHEREAS, a public hearing notice for the Needles Planning Commission meeting was published in the Needles Desert Star on February 17, 2016, 10 days prior to said meeting, and notices were sent to property owners within a 300-foot radius of the subject property specifying the date, time and location of the public hearing; and WHEREAS, on March 2, 2016, the Needles Planning Commission held a duly noticed and advertised public hearing to receive oral and written testimony relative to RESOLUTION 03-02-2016 PC; and WHEREAS, Section 94.07(d) of the Needles City Code describes the findings required to approve a Conditional Use Permit; and WHEREAS, the Needles Planning Commission has sufficiently considered all testimony and any documentary evidence presented to them in order to make the following determination. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Needles as follows: SECTION 1. The Planning Commission HEREBY FINDS AND DETERMINES that this project is categorically exempt under the California Environmental Quality Act (CEQA) under Section 15301 existing facilities as no expansion to the existing building is proposed for the vehicle paint facility; and under Section 15332 small infill project for the storage project. SECTION 2. The Planning Commission HEREBY FINDS AND DETERMINES, with reports and findings, that facts do exist to approve a Conditional Use Permit, according to the criteria specified in Section 94.07(d) of the Needles City Code: 1 2/26/2016 12:54 PM

A. The development will not materially endanger the public health or safety. FINDING: Fencing, lighting, and traffic control along E. Broadway are included as conditions of approval to ensure appropriate health and safety measures are part of the project. B. The development will not substantially injure the value of adjoining or abutting properties. FINDING: The project is proposed in the C-3 Highway Commercial Zone, with fencing and landscaping to enhance the project site. Enhancements to the existing building façade include 48 high cultured stone veneer C. The development is in harmony with the area in which it is located. FINDING: Similar businesses including vehicle storage, vehicle repair, and gas stations are in the vicinity of the proposed project site. D. The development is in general conformity with the Needles General Plan. FINDING: The proposed project comprised of vehicle storage and paint facility are uses common to the General Plan Highway Commercial designation and are found to be in conformance with the Needles General Plan. SECTION 3. The Planning Commission HEREBY FINDS AND DETERMINES that facts do exist to approve RESOLUTION 03-02-2016 PC. SECTION 4. The Planning Commission HEREBY APPROVES Resolution 03-02-2016, recommending approval of a steel building storage and paint facility, at 1200 E. Broadway, Needles, CA, also known as APN 0650-282-15 and 0650-282-16, with the following conditions: 1. Project shall be built in conformance to the site plan drawing dated 2-25-2016. Any deviation from the approved plan shall require Planning Commission approval. 2. Project to be done in phases, creating a total of 170 enclosed storage spaces, Phase I includes area A with 100 enclosed storage spaces and phase II includes area B with 70 enclosed storage spaces. 3. No outdoor storage of any type is allowed 4. Applicant must comply with the recommendations of the San Bernardino County Fire Department prior to issuance of any building permits. All development pursuant to this permit must be kept in full compliance with the County Fire Code to the satisfaction of the County Fire Dept. 2 2/26/2016 12:54 PM

5. Access roads must be paved or all weather surface with a width of 26 ft. for twoway traffic or 20 ft. for one way traffic with a clearance height of 14 6. 6. Applicant must use asphalt or concrete for driving and parking surfaces per City standards. 7. Lighting on property must be a maximum 30 down lighting, not shine on the highway or adjoining property in a manner that interferes with visibility or the enjoyment of their property, and motion sensors should be used wherever practical, to lessen interference with the enjoyment of the night sky. 8. Dumpsters shall be in an enclosed area; not to be seen by public view, and they should be located in several areas of the project. 9. The project is required to be handicap accessible, with ADA compliant restrooms. 10. Exposed metal building to be masked with architectural treatment. At all times the building shall be maintained with appropriate paint or exterior treatment. 11. Hydrology study shall be generated and submitted to the City of Needles by a licensed and qualified engineer prior to building permit issuance. Said report shall be completed to the satisfaction of the City Engineer. On-site detention is required to mitigate the increase in on-site storm flows due to the increase in impervious area. 12. If more than 50 cubic yards of dirt is moved, a grading plan will be required. 13. Geotechnical Report shall be generated and submitted to the City of Needles by a licensed and qualified engineer. Said report shall be completed to the satisfaction of the City Engineer and recommendations within the report shall be incorporated into the grading and building plan(s) prior to issuance of a grading or construction permit. 14. A lot merge is required to be processed and recorded prior to receiving a Certificate of Completion. 15. Electric meter and main disconnect to be installed on exterior of building. 16. The landscape plan shall consider that the City of Needles, as well as the State of California are under water reduction orders as a result of the current drought 17. A traffic study/analysis may be required to determine if lane reconfiguration is required for traffic relief or health and safety of motorists. 18. Applicant shall comply with the provisions of the permits required from any State or Regional Agencies, including, but not limited to the Mohave Air Quality Management District (MAQMD). 19. Improvements to E. Broadway Street shall include the installation of 6-inch curb and gutter along the property frontage and commercial driveway approaches per the City of Needles Standards. 20. Applicant shall submit to city staff for approval a sign permit application and detailed plans for construction and placement of any and all signage. 21. Applicant shall submit to city staff for approval a business license application before the opening and initial start of business. 22. Any violation of these conditions can automatically result in cancellation of this Conditional Use Permit. SECTION 5. This action shall become final and effective fifteen (15) days after this decision by the Planning Commission, unless within such period, a written appeal is PC Resolution No. 3-2-2016 PC filed with the City Clerk for consideration by the City Council as provided by the Needles City Code.
