Polcy Regardng Renewable Energy Generaton Devces and Energy Effcency Measures Adopted //,20\5 ' The followng procedures have been adopted by the Crystal Crossng Homeowners_Assocaton, nc. (the "Assocaton") at a regular meetng of the Board of Drectors (the "Board"). Purpose: To adopt a standard polcy for owners, resdents, guests, and vstors to follow wth regard to the nstallaton or use of renewable energy generaton devces and energy effcency measures. N O W T H E R E F O R E, B E T R E S O L V E D T H A T the followng polces and procedures are establshed regardng renewable energy generaton devces and energy effcency measures: A. Background. n complance wth the Colorado Common nterest Ownershp Act ("CCOA") and the Declaraton of Covenants, Condtons and Restrctons for the Crystal Crossng Homeowners Assocaton ("CC&Rs"), the Board and the Desgn Revew Commttee ("DRC") desre to adopt a unform and systematc polcy regardng the nstallaton of "Energy Generaton Devces" and "Energy Effcency Measures" as defned n Colorado Revsed Statutes (C.R.S) 38-33.3-106.7. B. The Board for the Assocaton hereby adopts the follovdng polces and procedures provdng reasonable provsons that wll govern the dmensons, placement, and external appearance of a solar energy devce, a wnd-electrc generator and varous devces defned as "energy effcency measures". All devces dscussed heren requre a D R C approved applcaton except as noted. C. Polces. L Defntons: ' a. Solar Energy Devce (Energy Generaton Devce). A solar collector or other devce or a structural desgn feature of a structure whch provdes for the collecton of sunlght and whch comprses part of a system for the converson of the sun's radant energy nto thermal, chemcal, mechancal, or electrcal energy C.R.S. 38-32.5-100.3. Examples of a Solar Energy Devce are: photovoltac (PV) solar electrc panel, solar thermal systems (solar water heaters), and solar lghtng systems. b. Wnd-electrc Generator (Energy Generaton Devce). A wndelectrc generator that meets the nterconnecton standards establshed n rules promulgated by the publc utltes commsson pursuant to secton C.R.S 40-2-124. Ths wnd energy converson system shall consst of a wnd turbne, tower, and assocated control or converson electroncs, whch has a rated capacty of not more than 10 kw, and whch s ntended to prmarly reduce onste consumpton of utlty power.

c. Reasonable restrctons.. Gudelnes to reduce nterference wth the use and enjoyment by resdents of property stuated near wnd-electrc generators as a result of the sound assocated wth the wnd-electrc generators.. Bona fde safety requrements requred by an applcable buldng code or recognzed electrcal safety standard, for the protecton of persons and property. ^. Aesthetc provsons that do not sgnfcantly ncrease the cost of the devce, or sgnfcantly decrease ts performance or effcency. ' ' v. nterference wth the use and enjoyment of property by resdents for the purpose of determnng whether a restrcton s reasonable shall be determned as a part of the archtectural revew process as requred by the governng documents and shall nclude consderaton of nput by the ndvduals requestng approval. ' V. The D R C shall consder how the mprovements are archtecturally ntegrated wth the exstng structures and landscapng of the property to be mproved. Ths ncludes, but s not lmted to, a scale, color, reflectve value, materals, massng, and qualty of product and archtectural character. There s specal concern and consderaton for the preservaton of vews from neghborng propertes. d. Energy Effcency Measure - A devce or structure that reduces the amount of energy derved f"om fossl fels. "Energy Effcency Measure" s lmted to nclude only the followng devces as stated n C.R.S 38-33.3-106.7:. A n awnng, shutter, trells, or other shade structure that s marketed for the purpose of reducng energy consumpton.. A garage or attc fan and any assocated vents or louvers,. A n evaporatve cooler. j v. A n energy-effcent outdoor lghtng devce, ncludng wthout lmtaton a lght fxture contanng a coled or straght fluorescent lght bulb, and any solar rechargng panel, moton detector, or other equpment connected to the lghtng devce. v. A retractable clotheslne.! e. Tower. The vertcal component of a wnd energy converson system that elevates the wnd turbne generator and attached blades above the ground. ' ' f. Nose dsturbance. A nose dsturbance s any sound whch s (a) harmful or njurous to the health, safety, or welfare of any ndvdual; (b) of a volume, frequency, or ntensty that t unreasonably nterferes wth the quet enjoyment of lfe of an ndvdual of 2

ordnary senstvty and habts; or (c) unreasonably nterferes wth the value of real property or any busness conducted thereon. j 2. Assocaton DRC Gudelnes for Wnd Energy Converson Systems: Complance wth applcable buldng code, safety codes. Natonal Unform Buldng Code, Natonal Electrc Code when applcable and utlty company and electrc requrements: Resdental Wnd Turbnes must be approved by the applcable governmental enttes (Buldng and Plannng Department). b. Submsson of Documents to the DRC: A n applcaton for approval to the D R C must nclude a plot or ste plan of the Lot, drawn to scale, showng the boundares, dwellng and other structures, drveway, no buld zones, easements (such as the dranage, water or gas easements), the locaton and heght of the proposed wnd turbne, to nclude sze of foundaton and placement of all guy wres. The applcaton shall nclude the manufacturer's nformaton to nclude standard drawngs of the wnd turbne structure, ncludng the tower, base, footngs, and guy wres (f any), anchors, and other external components of the system. A n engneerng analyss of the Tower, guy wres, and anchors showng complance wth the applcable Buldng Code and certfed by a lcensed professonal engneer shall also be submtted. Ths nformaton s typcally suppled by the manufacturer and/or the nstallaton engneerng company. Adjonng neghbors wll be notfed of the submsson, and although ther approval s not necessary, ther nput wll be taken nto consderaton. c. Approved Wnd Turbnes: Resdental wnd turbnes must be approved under an Emergng Technology program such as the Calforna Energy Commsson, lec or any other small wnd certfcaton program recognzed by the Amercan Wnd Energy Assocaton ( A W E A ) or the U.S. Department of Energy. Non-certfed wnd turbnes must submt a descrpton of the safety features of the turbne prepared by a lcensed professonal engneer. d. Nose Dsturbance: Resdental wnd energy systems shall not exceed 50dba, as measured at the closest neghborng nhabted dwellng. The level, however, may be exceeded durng short-term events such as utlty outages and/or severe wnd storms. t s hghly recommended that pror to constructon a potental owner conduct extensve research as well as vst stes of nstalled smlar generators to ascertan the mpact on neghbors. e. Generator heght: 3

The heght of the generator, ncludng blades/turbne, shall not exceed 75% of the dstance from the base of the generator to any property lne, or 35 feet, or the heght lmt mposed by applcable buldng code, whchever s less. f. Set-backs: Mnmum set-backs for the system tower shall be 50 feet from adjonng propertes or 100 feet from any property lne adjacent to a street. Guy wre anchor ponts may extend to 10 feet from the property lne. Buldng mounted systems may be affxed to an D R C approved unattached garage, or other approved structure. n no case shall the Tower be nstalled closer to an adjonng man dwellng than to the Tower owner's nhabted dwellng. j g. Utlty Notfcaton: l No resdental wnd energy system shall be nstalled untl evdence has been gven that the applcable utlty company has been nformed of the customer's ntent to nstall an nterconnected, net metered customer-owned generator. Off-grd systems shall be exempt from ths requrement. The proposed area must have been marked for utlty locatons pror to the DRC ste nspecton and applcaton approval. h. Aesthetc/safety consderatons: The Assocaton and DRC encourage aesthetcally acceptable n the Communty. the Owner to select equpment that s ' '. Approval of placement and Tower style shall take nto consderaton the vew mpact of neghborng property owners.. All pant or fnsh shall be matte and be neutral n color. The Tower and as many parts as possble shall be treated for rust and/or corroson.. f mantenance of the turbne requres clmbng of the Tower, there shall be no clmbng rungs or clmbng devces closer than 12 feet off the ground. v. No sgns or added accessores (lke solar panels) shall be affxed to the Tower. "Warnng", "Danger" or "No Trespassng" sgns may be consdered, but must be ncluded as part of the applcaton. V. Plantng of shrubs or small evergreen trees may be requred to mask or draw attenton away from the Tower or wres, as long as the plantngs do not nterfere wth the mantenance or safety features of the Tower. 3. D R C Gudelnes for Solar Energy Svstem(s): 4

a. Complance wth applcable buldng code, safety codes. Natonal Unform Buldng Code, Natonal Electrc Code and utlty company requrements when applcable: ' nstallaton of a solar energy system must be approved by the applcable Buldng Department and the Plannng Department. 1 b. Submsson of Documents to the DRC: A n applcaton for approval to the D R C must nclude a plot or ste plan of the Lot, drawn to scale, showng the boundares, dwellng and other structures, drveway, no buld zones, easements (such as the dranage, water or gas easements), to nclude drawn to show locaton, number of collectors, attachment to roof structure or ground attachment, and locaton of any other exteror system components. Submt a sample or llustrated brochure of the proposed solar unt, whch clearly depcts the unt, and defnes the materals used. Calculatons should also be provded showng the number and area of the collectors requested. A n engneerng analyss showng complance wth the applcable Buldng Code and certfed by a lcensed professonal engneer shall also be submtted. Ths nformaton s typcally suppled by the manufacturer and/or the nstallaton engneerng company. Adjonng neghbors wll be notfed of the submsson, and although ther approval s not necessary, ther nput wll be taken nto consderaton. c. nstallaton/aesthetcs:. To the maxmum extent possble, a roof-mounted devce or solar devce shall be nstalled so as to mnmze ts exposure when vewed from any other prvately owned ste, common area, street and/or from the surroundng communty unless to do so wll have the effect of substantally nterferng wth the use of the devce or sgnfcantly ncreasng the cost of the devce.. The preferred locaton of the devce shall be on the back roof of the resdence and below the peak of the roof Alternatvely, the devce may be pole-mounted n the rear area of a prvate yard below the fence lne and, to the maxmum extent possble, shall be screened from the vew of others by landscapng materals.. All devces shall be nstalled flush wth the roof, unless to do so shall have the effect of prohbtng the collecton of solar energy. v. The total number of solar panels and other apparatus nstalled shall not cover more than 75% of any gven roof secton, unless to do so wall have the effect of prohbtng the collecton of solar energy. V. The D R C encourages the Ovmer to select equpment that s aesthetcally acceptable n the Communty and ntegrates wth the resdence and surroundng landscape to the maxmum extent possble, keepng n mnd the desgn and rooflne of the resdence on whch the devce s to be nstalled. The color of the devce and exposed ppes, panels and other apparatus must be approved by the DRC. f applcable, the devce shall have flashng colored or panted to closely match the adjacent roof color. Poles shall be panted a matte color to 5

j blend wth surroundng landscape. f possble, all glazng shall be solar bronze or black, wth no whte or clear glazng allowed. v. Ground mounted solar unts shall have set-back requrements of 50 feet from adjonng property lnes, easements and street boundares. v. To the extent that landscapng does not nhbt solar collecton. Owner shall nstall a mnmum amount of trees/shrubs, etc. to help create an aesthetcally pleasng screenng. Ths may also apply to other exteror components. v. A l l exteror plumbng lnes and conduts should be panted n a color scheme consstent wth the structure and materals adjacent to the ppes,.e., ppes on walls should be panted the color of the walls whle roof plumbng/conduts should be the color of the roof j x. Alumnum trm, f used and vsble, should be anodzed or other color treated, f necessary. X. A n Owner shall take nto consderaton the fture heght of neghbors' trees/shrubs when plannng placement. Under no crcumstances shall a neghbor be requred to remove or prune establshed plantngs. However, once a solar system s approved, adjonng neghbors may not buld or plant structures that wll obstruct solar collecton, wthout pror approval from the neghbor ownng the solar collectors. x. All panels shall be secured so that they do not jeopardze the safety of resdents or cause damage to adjacent propertes. x. The DRC shall revew other suggested locatons/nstallatons f the above are not feasble, provded, however, the D R C may requre the applcant to provde the D R C wth a vmtten statement by a solar energy expert that the restrctons mposed by the D R C wll have the effect of () substantally nterferng wth the collecton of solar energy, and/or () sgnfcantly ncreasng the cost of the devce. n that case, the D R C wll permt varances to these requrements to the mnmum amount as s reasonably requred to allow the devce to functon properly and to mnmze any ncrease n the cost of the devce to the Owner. ' x. A l l nstallatons must comply wth all applcable buldng codes and other governmental regulatons, and must be secured so that they do not jeopardze the safety of resdents or cause damage to adjacent propertes. 4. f the Energy Generaton Devce s approved: a. Adherence to Approved Detals and Plans: The Owner must nstall and operate the Energy Generaton Devce n accordance wth the approved detal plans and specfcatons, all of the requrements set forth n ths polcy, and any other requrements mposed by the CC&Rs and/or the DRC. j 6

b. Contnued Mantenance: The Owner must mantan the Energy Generaton Devce(s) n good operatonal condton and n a manner that does not cause an annoyance or nconvenence to other resdents. c. Damage and Lablty nsurance: The Owner who nstalls Solar Collecton Devces and/or a Wnd-electrc Generator must be aware of the unque dangers and hs or her lablty from such events caused by hgh wnds, ce slngng from wnd-turbne blades, etc. Addng these devces to the Owner's property nsurance s hghly recommended. 5. Assocaton Gudelnes for Energy Effcency Measures: a. The followng do not requre D R C approval:. Replacement of exstng lght fxtures wth an energy effcent outdoor lghtng devce. The Owner must, however, reasonably mantan archtectural matchng to the exstng lghtng and structure and not drected or reflected on any other property. ^ '. The use of a retractable clotheslne or of removable clothes dryng devces whch are not affxed to the ground or permanently to a structure are encouraged. Owners must store any clothes dryng devces out of vew when not n use.. nteror garage or attc fans and nteror louvers. b. Exteror operable or motorzed solar shades, shutters and awnngs:. Pror approval for permanently nstalled solar shades, shutters and awnngs s requred. They should be compatble n color scheme wth the colors of the house and kept n good condton. Every effort should be made to nstall a low slhouette unt panted the same color as the resdence. Owner shall submt an applcaton to the D R C wth a concept sketch wth locaton, dmensons and relaton to other key features. Owner shall also submt a desgn sketch of the skrt (f roof mounted). Photos may be necessary to convey ntent and compatblty wth exstng features. Accompany your submsson wth manufacturer's nformaton and recommended nstructons for nstallaton. d. Other Energy Effcency Measures: Owners must submt a request to the D R C for any external Energy Effcency Measure not specfcally addressed n these gudelnes. ' ' 6. Abandonment. n the event that a wnd turbne or solar devce or Energy Effcency Measure s allowed to be n dsrepar, or not be used for a mnmum of sx months, the current Owner of the property wll be requred to remove the structure or put the devce back nto servce wthn three months of notce. f devce s removed, all components shall be removed and the property (mprovements and/or land) shall be repared and restored to orgnal condton. n the event of a sale of the Lot, the new owner shall be made aware of the abandonment restrcton pror to sale. ' 7. D R C approval for modfcatons. Owners shall submt applcaton for approval wth detaled plans for any subsequent modfcatons made to the Energy Generaton Devce(s) and/or external Energy Effcency Measures.! 8. Wavers/Varances. The DRC wll requre the applcant to provde a wrtten statement by a solar, wnd, or other energy expert that the restrctons mposed by the DRC wll have the effect of (1) substantally nterferng wth the collecton of solar/wnd energy or sgnfcantly mpactng the performance of the devce or measure, and/or (2) sgnfcantly ncreasng the cost of the devce or measure. n such cases, the DRC may recommend the Board permt varances to these nstallaton crtera to the mnmum amount as s reasonably requred to allow the devce or measure to functon properly and to mnmze any ncrease n the cost of the devce. 9. Approval. D R C approval n no way should be construed as a representaton, guarantee or warranty, etc. by the D R C or the Assocaton that collecton of solar or wnd energy shall be adequate for the Owner's needs or that roof-mounted or other solar devces wll reman undsturbed by vegetaton or mprovements located on surroundng propertes. 8

10. Amendment. Ths Renewable Energy Generaton Devce and Energy Effcency Measures Polcy may be amended from tme to tme as requred. 11. Supplement to Law.
