Conditions of Section 401 Certification for Nationwide Permits and General Conditions General Condition 12 (Soil Erosion and Sediment Controls) Erosion control and sediment control BMPs described in Attachment 1 are required with the use of this general condition. If the applicant does not choose one of the BMPs listed in Attachment 1, an individual 401 certification is required. General Condition 21 (Water Quality) Post-construction total suspended solids (TSS) BMPs described in Attachment 1 are required with the use of this general condition. If the applicant does not choose one of the BMP s listed in Attachment 1, an individual 401 certification is required. Bridge deck runoff is exempt from this requirement. General Condition 20 (Mitigation) Mitigation will be required for streams and special aquatic sites, such as pools/riffles, seagrass, and mudflats, that will adequately compensate for their functions and values unless the Corps provides a project-specific waiver of this requirement. The U.S. Army Corps of Engineers will copy the TCEQ on all mitigation waivers sent to applicants. NWPs 13, 29, 39, 40, 41, 42, 43 The U.S. Army Corps of Engineers will copy the TCEQ on all written approvals of waivers for impacts to ephemeral, intermittent or perennial streams.
