Environmental Public Health ORDER OF AN EXECUTIVE OFFICER CLOSED FOR TENANT ACCOMMODATION PURPOSES ORDER TO VACATE To: Amy Shun Foon Wong The Owner Albert Wong The manager And To: All Occupant(s) of the following Housing premises: 4516 75 Street NW Common, Unit 1, Unit 3, Unit 4, Unit 5. RE: Those housing premises located in Calgary, Alberta and municipally described as: 4516 75 Street NW Common, Unit 1, Unit 3, Unit 4, Unit 5. WHEREAS I, an Executive Officer of Alberta Health Services, have inspected the above noted premises pursuant to the provisions of the Public Health Act, RSA 2000, c. P-37, as amended; AND WHEREAS such inspection disclosed that the following conditions exist in and about the above noted premises which are or may become injurious or dangerous to the public health or which might hinder in any manner the prevention or suppression of disease, namely: Common: a. The bottom two risers of the back staircase leading to the upper level were loose. b. The rubber finish on the bottom two treads of the front staircase leading to the lower level were lifting, creating a tripping hazard. c. The glass in the laundry room window panes was shattered, leaving behind a significant amount of jagged glass. d. The entire window frame from the laundry room window had been pulled out from the wall and was placed on the floor, propped up against the wall. The window opening from which the frame was removed was partially covered with plywood, but there were many gaps directly to the outdoors. e. The window on the left side of the back exterior entry door was cracked across the pane. The window on the right side of the back exterior entry door was shattered, leaving behind a significant amount of jagged glass. f. The cover on the hallway electrical light timer was missing, exposing wiring. g. The baseboard heating pipes in the laundry room were uncovered, exposing the sharp heating fins. h. There were gaps directly to the outdoors at the base of both the front and back exterior entry doors. i. The laundry room wall beneath the window frame was moisture stained, and the paint was peeling. j. Window trim along the bottom of the laundry room window frame was missing. k. The boiler room door frame was bowed inwards, the wood was splintered, and the door could not be closed or secured.

Page 2 of 21 l. There was no insect screen on the laundry room window. m. There were holes in the wall behind the washer and dryer. n. There were holes throughout common area walls. o. Patched holes in the common hallway were unfinished. Unit 1 - Common: a. There were houseflies throughout the unit, especially in the bathroom and kitchen areas. b. The bathtub surround tile wall was cracked under the faucet. Moisture meter measurements between 737 and 754 (relative moisture level) were obtained in the drywall behind the tile wall. c. Bathroom baseboards were badly water stained. d. Caulking around the perimeter of the bathroom sink and along the joint between the bathroom counter top and the wall was worn, allowing water to infiltrate these areas. e. The cover for the toilet tank was missing. f. The surface of the bathroom cupboard base shelf was water stained in multiple areas. g. The bathroom handsink faucet was leaking continuously, though the taps were completely shut off. h. The kitchen faucet was leaking continuously, though the taps were completely shut off. Unit 1-2: a. The bedroom window lock was missing. b. Holes in the wall below the window have been haphazardly patched but not finished. Unit 3 - Common: a. There was no main door for the unit. The unit was wide opened and could not be secured. b. The temperature in the unit was measured to be between 12 and 16 degrees Celsius. c. The balcony door was frozen shut. d. Six bathtub surround tiles as well as the drywall behind these tiles were removed from around the faucet and taps, exposing dirty and mould contaminated wood frame. e. The bathtub faucet cold water knob was missing. f. The bottom section of trim on the bathroom door frame was water damaged and mouldy. g. The bottom section of trim on the storage room door frame was water damaged and mouldy. h. There were holes in the bathroom door. i. There was a hole in the joint between the edge of the bathtub tile surround and the adjacent drywall. j. The base shelf of the bathroom cupboard was water stained and the front edge of the shelf was worn, exposing bare wood. k. Bathtub enamel was worn around the drain. l. The front edge of the kitchen cupboard base shelf under the sink was worn, exposing bare wood. m. The edge trim of the kitchen countertop next to the stove was missing, exposing bare wood. n. The kitchen cupboard door in front of the sink was missing. The kitchen cupboard top drawer front panel to the right of the sink was missing.

Page 3 of 21 Unit 3-1: o. Caulking along the joint between the kitchen counter top and the backsplash wall was worn, allowing water to infiltrate this area. p. Caulking along the joint between the bathroom countertop and the backsplash wall was worn, allowing water to infiltrate this area. q. An insect screen was not installed on the kitchen window. a. There was no lock on the bedroom window. b. A unit door was not installed; it was leaning up against the bedroom wall. c. The door frame was damaged; there was no strike plate installed and the recessed holes in the frame were too shallow to accommodate a locking mechanism. d. An electrical outlet cover was missing. Unit 3-2: a. The baseboard heat covers were loosely installed exposing heating pipes and sharp metal fins. b. A part of the door frame finish was chipped and worn, nails were used to hold the interior section of the door frame in place, and the strike plate was falling forward. Unit 4 - Common: a. A smoke alarm was not installed. b. The temperature in the unit was measured to be 18 degrees Celsius. c. The temperature of hot water at the bathtub faucet was measured at 65.4 degrees Celsius which is over the allowable maximum of 60 degrees Celsius, thus posing a scalding risk. d. The left pane of the dining room/kitchen window was shattered. The resulting hole and remaining pieces of glass were haphazardly secured with clear packing tape. e. The lock on the dining room/kitchen window was broken. f. A section of the dining room ceiling next to the fan was haphazardly plastered and painted over in an attempt to cover up water damaged drywall. g. The cover on the hallway outlet electrical outlet next to the bathroom door was missing, exposing electrical wires. h. The wall surrounding the electrical outlet was patched but left unfinished. i. Laminate finish was adhered to the bathroom vanity countertop with plaster. The wet plaster caused the laminate to bubble at the edges, exposing bare countertop wood. j. A significant section of bathroom countertop edge trim was missing, exposing bare wood. k. The bathtub finish was worn and chipped around the drain. l. A piece of raw unfinished drywall was affixed to the bathroom wall. m. The cover for the baseboard heater in the living room was missing exposing heating piping and sharp metal fins. n. The far left lower kitchen cupboard door was missing. o. There was a hole in the kitchen wall to the right of the sink. There was another poorly patched hole in the in the kitchen wall closer to the main door. p. There was a hole in the living room hallway wall. q. There were multiple holes in the bathroom door.

Page 4 of 21 Unit 4-1: Unit 4-2: a. The interior door frame trim was missing. b. An insect screen was not installed on the window. a. The lock on the window did not work. b. The bedroom door knob containing the locking mechanism was missing. There was a hole in the door where the knob used to be installed. The door could not be secured. c. The bottom half of the bedroom door was split in two. d. There were multiple fist-sized holes in the bedroom wall. Unit 5 Common: a. Temperatures obtained in the unit were between 15 and 19 degrees Celsius. b. Bathtub surround tiles were loose around the faucet. The grout between bathtub tiles was worn and missing. There were gaps around the metal plate between the hot and cold water taps. Moisture meter measurements obtained throughout various sections of the bathtub tile surround were between 761-763 REL (relative moisture level). c. Caulking along the interior joints of the bathtub was worn and mouldy. d. On November 23, 2017 the waterline for the toilet was leaking. A bucket was placed under the water line to collect dripping water. On January 10, 2017 water was pooling around the base of the toilet and a trail of water was forming on the floor towards the bathroom counter. e. The shelf under the bathroom sink was water stained. f. Caulking was worn along the joint between the bathroom counter and the wall allowing water to infiltrate this area. g. Several edges of the kitchen counter tops were unfinished exposing bare wood. h. There were several small holes and knife cuts in the kitchen counter top, rendering it not easily cleanable. i. The cupboard shelf under the kitchen sink was badly worn, exposing bare wood. j. Caulking was worn along the joint between the kitchen counter top and the wall, allowing water to infiltrate the area. k. The baseboard along the wall in the kitchen next to the oven was missing. l. The living room baseboard heat cover was loose. m. There was a hole in the wall next to the main entry door. Unit 5 1: a. Covers were missing on the baseboard heating pipes, exposing plumbing and electrical connections as well as sharp metal fins. b. A metal covering was installed on the bedroom door around the lock. The metal covering was protruding outwards rendering the door difficult to close. c. There was no lock on the bedroom window. d. The bedroom window was cracked the entire way across the pane. Unit 5 2: a. Bedroom baseboards were badly warped. b. The baseboard heat cover did not extend to the end of the pipe, exposing the hot water pipe.

Page 5 of 21 c. There was a poorly patched and unfinished hole in the wall near the window. d. There was a gap in the door where the bedroom dead bolt lock used to be. e. The bedroom window lock was broken rendering the unit unsecure. f. There was no screen on the bedroom window. Unit 5 3: a. The patio door was frozen shut due to heavy ice buildup on the perimeter of the patio door frame, impacting egress and ventilation. b. The bedroom door was cracked in multiple places. c. The door frame holding the strike plate was splintered in multiple areas. d. A hole in the wall by the door was partially patched and unfinished. e. The patio screen door was torn. AND WHEREAS such inspection disclosed that the following breaches of the Public Health Act and the Housing Regulation, Alberta Regulation 173/99, and the Minimum Housing and Health Standards exist in and about the above noted premises, namely: Common: a. The bottom two risers of the back staircase leading to the upper level were loose. This contravenes section III(3)(c)(i) of the Minimum Housing and Health Standards which states that: Inside or outside stairs or porches including all treads, risers, supporting structural members, handrails, guards and balconies, shall be maintained in good repair and shall comply with the requirements of the Alberta Building Code or a Professional Engineer design. b. The rubber finish on the bottom two treads of the front staircase leading to the lower level were lifting, creating a tripping hazard. This contravenes section III(3)(c)(i) of the Minimum Housing and Health Standards which states that: Inside or outside stairs or porches including all treads, risers, supporting structural members, handrails, guards and balconies, shall be maintained in good repair and shall comply with the requirements of the Alberta Building Code or a Professional Engineer design. c. The glass in the laundry room window panes was shattered, leaving behind a significant amount of jagged glass. This contravenes section III(5) of the Minimum Housing and Health Standards which states that: All walls, windows, ceilings, floors, and floor coverings shall be maintained in good repair, free of cracks, holes, loose or lifting coverings and in a condition that renders it easy to clean. And section 5(2) of the Housing Regulation, 2001 which states that: No person shall cause or permit any condition in housing premises that is or may become injurious or dangerous to the public health, including any condition that may hinder in any way the prevention or suppression of disease. d. The entire window frame from the laundry room window had been pulled out from the wall and was placed on the floor, propped up against the wall. The window opening from which the frame was removed was partially covered with plywood, but there were many gaps directly to the outdoors. This contravenes section III(5) of the Minimum Housing and Health Standards which states that: All walls, windows,

Page 6 of 21 ceilings, floors, and floor coverings shall be maintained in good repair, free of cracks, holes, loose or lifting coverings and in a condition that renders it easy to clean. And section III(2)(a) of the Minimum Housing and Health Standards which states that: The roof and exterior cladding of walls shall be maintained in a waterproof, windproof and weatherproof condition. e. The window on the left side of the back exterior entry door was cracked across the pane. The window on the right side of the back exterior entry door was shattered, leaving behind a significant amount of jagged glass. This contravenes section III(2)(b)(i) of the Minimum Housing and Health Standards which states that: All windows and exterior doors shall be; maintained in good repair, free of cracks and weatherproof. f. The cover on the hallway electrical light timer was missing, exposing wiring. This contravenes section IV(11) of the Minimum Housing and Health Standards which states that: Every housing premises shall be supplied with electrical service. Outlets, switches and fixtures shall be properly installed and shall be maintained in a good and safe working condition. g. The baseboard heating pipes in the laundry room were uncovered, exposing the sharp heating fins. This contravenes section III(5) of the Minimum Housing and Health Standards which states that: All walls, windows, ceilings, floors, and floor coverings shall be maintained in good repair, free of cracks, holes, loose or lifting coverings and in a condition that renders it easy to clean. h. This contravenes section IV(7) of the Minimum Housing and Health Standards which states that: Except where exempt by regulation, every housing premises shall be provided with plumbing fixtures of an approved type consisting of at least a flush toilet, a wash basin, and a bathtub or shower. f. The surface of the bathroom cupboard base shelf was water stained in multiple areas. This contravenes section III(1)(c) of the Minimum Housing and Health Standards which states that: Building materials that have been damaged or show evidence of rot or other deterioration shall be repaired or replaced. g. The bathroom handsink faucet was leaking continuously, though the taps were completely shut off. This contravenes section IV(6)(c) of the Minimum Housing and Health Standards which states that: All plumbing fixtures shall be serviceable, free from leaks, trapped and vented to the outside. h. The kitchen faucet was leaking continuously, though the taps were completely shut off. This contravenes section III(5) of the Minimum Housing and Health Standards which states that: All walls, windows, ceilings, floors, and floor coverings shall be maintained in good repair, free of cracks, holes, loose or lifting coverings and in a condition that renders it easy to clean. Unit 3 - Common: a. There was no main door for the unit. The unit was wide opened and could not be secured. This contravenes section III(3)(a) of the Minimum Housing and Health Standards which states that: Exterior windows and doors shall be capable of being secured. b. The temperature in the unit was measured to be between 12 and 16 degrees Celsius. This contravenes section IV(8)(a)(i) of the Minimum Housing and Health Standards which states that: All heating facilities within a housing premises are to be properly installed and maintained in good working condition, and be capable of safely and adequately heating all habitable rooms, bathrooms, and toilet rooms within the building to a temperature of at least 22 degrees Celsius(710F), or maintained at a temperature of at least 22 degrees Celsius(710F) when the control of the supplied heat in a dwelling is the responsibility of a person other than the occupant. c. The balcony door was frozen shut. This contravenes section III(2)(b)(i) of the Minimum Housing and Health Standards which states that: All windows and exterior doors shall be; maintained in good repair, free of cracks and weatherproof. d. Six bathtub surround tiles as well as the drywall behind these tiles were removed from around the faucet and taps, exposing dirty and mould contaminated wood frame. This contravenes section III(1)(c) of the Minimum Housing and Health Standards which states that: Building materials that have been damaged or show evidence of rot or other deterioration shall be repaired or replaced. e. The bathtub faucet cold water knob was missing. This contravenes section IV(7)(a) of the Minimum Housing and Health Standards which states that: The washbasins and bathtub or shower shall be supplied with potable hot and cold running water. And section IV(6)(a) of the Minimum Housing and Health Standards which states that: The plumbing system and the sanitary drainage system or private sewage disposal system, as the case may be, including drains, fixtures, traps, vents, stacks, waste disposal facilities, pumpout sewage holding tanks, septic tanks and the disposal system shall be maintained in a proper operating condition. f. The bottom section of trim on the bathroom door frame was water damaged and mouldy. This contravenes section III(1)(c) of the Minimum Housing and Health Standards which states that: Building materials that have been damaged or show evidence of rot or other deterioration shall be repaired or replaced. And section 5(2) of the Housing Regulation, 2001 which states that: No person shall cause or permit any condition in housing premises that is or may become injurious or dangerous to the public health, including any condition that may hinder in any way the prevention or suppression of disease.

Page 9 of 21 g. The bottom section of trim on the storage room door frame was water damaged and mouldy. This contravenes section III(1)(c) of the Minimum Housing and Health Standards which states that: Building materials that have been damaged or show evidence of rot or other deterioration shall be repaired or replaced. And section 5(2) of the Housing Regulation, 2001 which states that: No person shall cause or permit any condition in housing premises that is or may become injurious or dangerous to the public health, including any condition that may hinder in any way the prevention or suppression of disease. h. There were holes in the bathroom door. This contravenes section III(1)(c) of the Minimum Housing and Health Standards which states that: Building materials that have been damaged or show evidence of rot or other deterioration shall be repaired or replaced. i. There was a hole in the joint between the edge of the bathtub tile surround and the adjacent drywall. This contravenes section III(5)(a) of the Minimum Housing and Health Standards which states that: Rooms containing a flush toilet and/or a bathtub or shower shall have walls and floors that are smooth, non-absorbent to moisture and easy to clean. All walls shall form a watertight joint with each other, the floor, the ceiling and where applicable with the bathtub or shower. j. The base shelf of the bathroom cupboard was water stained and the front edge of the shelf was worn, exposing bare wood. This contravenes section III(1)(c) of the Minimum Housing and Health Standards which states that: Building materials that have been damaged or show evidence of rot or other deterioration shall be repaired or replaced. k. Bathtub enamel was worn around the drain. This contravenes section 5(2) of the Housing Regulation, 2001 which states that: No person shall cause or permit any condition in housing premises that is or may become injurious or dangerous to the public health, including any condition that may hinder in any way the prevention or suppression of disease. l. The front edge of the kitchen cupboard base shelf under the sink was worn, exposing bare wood. This contravenes section IV(14)(a)(ii) of the Minimum Housing and Health Standards which states that: Every housing premises shall be provided with a food preparation area, which includes: cupboards or other facilities suitable for the storage of food. m. The edge trim of the kitchen countertop next to the stove was missing, exposing bare wood. This contravenes section III(5)(b) of the Minimum Housing and Health Standards which states that: Rooms and sections of rooms that are used for food preparation and cooking shall have walls and floors constructed of materials which do not provide harbourage to dirt, grease, vermin and bacteria and that are easily kept clean. n. The kitchen cupboard door in front of the sink was missing. The kitchen cupboard top drawer front panel to the right of the sink was missing. This contravenes section IV(14)(a)(ii) of the Minimum Housing and Health Standards which states that: Every housing premises shall be provided with a food preparation area, which includes: cupboards or other facilities suitable for the storage of food. o. Caulking along the joint between the kitchen counter top and the backsplash wall was worn, allowing water to infiltrate this area. This contravenes section IV(14)(a)(iii) of the Minimum Housing and Health Standards which states that: Every housing premises shall be provided with a food preparation area, which includes: a counter or

Page 10 of 21 table used for food preparation which shall be of sound construction and furnished with surfaces that are easily cleaned. p. Caulking along the joint between the bathroom countertop and the backsplash wall was worn, allowing water to infiltrate this area. This contravenes section III(5)(a) of the Minimum Housing and Health Standards which states that: Rooms containing a flush toilet and/or a bathtub or shower shall have walls and floors that are smooth, non-absorbent to moisture and easy to clean. All walls shall form a watertight joint with each other, the floor, the ceiling and where applicable with the bathtub or shower. q. An insect screen was not installed on the kitchen window. This contravenes section III(2)(b)(iii) of the Minimum Housing and Health Standards which states that: During the portion of the year when there is a need for protection against flies and other flying insects, every window or other device intended for ventilation shall be supplied with effective screens. Unit 3-1: a. There was no lock on the bedroom window. This contravenes section III(3)(a) of the Minimum Housing and Health Standards which states that: Exterior windows and doors shall be capable of being secured. b. A unit door was not installed; it was leaning up against the bedroom wall. This contravenes section III(3)(a) of the Minimum Housing and Health Standards which states that: Exterior windows and doors shall be capable of being secured. c. The door frame was damaged; there was no strike plate installed and the recessed holes in the frame were too shallow to accommodate a locking mechanism. This contravenes section III(1)(c) of the Minimum Housing and Health Standards which states that: Building materials that have been damaged or show evidence of rot or other deterioration shall be repaired or replaced. d. An electrical outlet cover was missing. This contravenes section IV(11) of the Minimum Housing and Health Standards which states that: Every housing premises shall be supplied with electrical service. Outlets, switches and fixtures shall be properly installed and shall be maintained in a good and safe working condition. Unit 3-2: a. The baseboard heat covers were loosely installed exposing heating pipes and sharp metal fins. This contravenes section III(5) of the Minimum Housing and Health Standards which states that: All walls, windows, ceilings, floors, and floor coverings shall be maintained in good repair, free of cracks, holes, loose or lifting coverings and in a condition that renders it easy to clean. b. A part of the door frame finish was chipped and worn, nails were used to hold the interior section of the door frame in place, and the strike plate was falling forward. This contravenes section III(1)(c) of the Minimum Housing and Health Standards which states that: Building materials that have been damaged or show evidence of rot or other deterioration shall be repaired or replaced.

Page 11 of 21 Unit 4 - Common: a. A smoke alarm was not installed. This contravenes section IV(12) of the Minimum Housing and Health Standards which states that: Smoke alarms within dwellings shall be installed between each sleeping area and the remainder of the suite and, where hallways serve the sleeping areas; the smoke alarms shall be installed within the hallway. b. The temperature in the unit was measured to be 18 degrees Celsius. This contravenes section IV(8)(a)(i) of the Minimum Housing and Health Standards which states that: All heating facilities within a housing premises are to be properly installed and maintained in good working condition, and be capable of safely and adequately heating all habitable rooms, bathrooms, and toilet rooms within the building to a temperature of at least 22 degrees Celsius(710F), or maintained at a temperature of at least 22 degrees Celsius(710F) when the control of the supplied heat in a dwelling is the responsibility of a person other than the occupant. c. The temperature of hot water at the bathtub faucet was measured at 65.4 degrees Celsius which is over the allowable maximum of 60 degrees Celsius, thus posing a scalding risk. This contravenes section IV(9)(a) of the Minimum Housing and Health Standards which states that: All hot running water shall be maintained at a temperature of not less than 46 degrees C (114F), and not more than 60 degrees C (140F) measured at the plumbing fixture. d. The left pane of the dining room/kitchen window was shattered. The resulting hole and remaining pieces of glass were haphazardly secured with clear packing tape. This contravenes section III(5) of the Minimum Housing and Health Standards which states that: All walls, windows, ceilings, floors, and floor coverings shall be maintained in good repair, free of cracks, holes, loose or lifting coverings and in a condition that renders it easy to clean. e. The lock on the dining room/kitchen window was broken. This contravenes section III(3)(a) of the Minimum Housing and Health Standards which states that: Exterior windows and doors shall be capable of being secured. f. A section of the dining room ceiling next to the fan was haphazardly plastered and painted over in an attempt to cover up water damaged drywall. This contravenes section III(1)(c) of the Minimum Housing and Health Standards which states that: Building materials that have been damaged or show evidence of rot or other deterioration shall be repaired or replaced. g. The cover on the hallway outlet electrical outlet next to the bathroom door was missing, exposing electrical wires. This contravenes section IV(11) of the Minimum Housing and Health Standards which states that: Every housing premises shall be supplied with electrical service. Outlets, switches and fixtures shall be properly installed and shall be maintained in a good and safe working condition. h. The wall surrounding the electrical outlet was patched but left unfinished. This contravenes section III(5) of the Minimum Housing and Health Standards which states that: All walls, windows, ceilings, floors, and floor coverings shall be maintained in good repair, free of cracks, holes, loose or lifting coverings and in a condition that renders it easy to clean. i. Laminate finish was adhered to the bathroom vanity countertop with plaster. The wet plaster caused the laminate to bubble at the edges, exposing bare countertop wood. This contravenes section III(1)(c) of the Minimum Housing and Health Standards which states that: Building materials that have been damaged or show evidence of rot or other deterioration shall be repaired or replaced.

Page 12 of 21 Unit 4-1: j. A significant section of bathroom countertop edge trim was missing, exposing bare wood. This contravenes section III(1)(c) of the Minimum Housing and Health Standards which states that: Building materials that have been damaged or show evidence of rot or other deterioration shall be repaired or replaced. k. The bathtub finish was worn and chipped around the drain. This contravenes section 5(2) of the Housing Regulation, 2001 which states that: No person shall cause or permit any condition in housing premises that is or may become injurious or dangerous to the public health, including any condition that may hinder in any way the prevention or suppression of disease. l. A piece of raw unfinished drywall was affixed to the bathroom wall. This contravenes section III(5)(a) of the Minimum Housing and Health Standards which states that: Rooms containing a flush toilet and/or a bathtub or shower shall have walls and floors that are smooth, non-absorbent to moisture and easy to clean. All walls shall form a watertight joint with each other, the floor, the ceiling and where applicable with the bathtub or shower. m. The cover for the baseboard heater in the living room was missing exposing heating piping and sharp metal fins. This contravenes section III(5) of the Minimum Housing and Health Standards which states that: All walls, windows, ceilings, floors, and floor coverings shall be maintained in good repair, free of cracks, holes, loose or lifting coverings and in a condition that renders it easy to clean. n. The far left lower kitchen cupboard door was missing. This contravenes section IV(14)(a)(ii) of the Minimum Housing and Health Standards which states that: Every housing premises shall be provided with a food preparation area, which includes: cupboards or other facilities suitable for the storage of food. o. There was a hole in the kitchen wall to the right of the sink. There was another poorly patched hole in the in the kitchen wall closer to the main door. This contravenes section III(5) of the Minimum Housing and Health Standards which states that: All walls, windows, ceilings, floors, and floor coverings shall be maintained in good repair, free of cracks, holes, loose or lifting coverings and in a condition that renders it easy to clean. p. There was a hole in the living room hallway wall. This contravenes section III(5) of the Minimum Housing and Health Standards which states that: All walls, windows, ceilings, floors, and floor coverings shall be maintained in good repair, free of cracks, holes, loose or lifting coverings and in a condition that renders it easy to clean. q. There were multiple holes in the bathroom door. This contravenes section III(1)(c) of the Minimum Housing and Health Standards which states that: Building materials that have been damaged or show evidence of rot or other deterioration shall be repaired or replaced. a. The interior door frame trim was missing. This contravenes section III(5) of the Minimum Housing and Health Standards which states that: All walls, windows, ceilings, floors, and floor coverings shall be maintained in good repair, free of cracks, holes, loose or lifting coverings and in a condition that renders it easy to clean. b. An insect screen was not installed on the window. This contravenes section III(2)(b)(iii) of the Minimum Housing and Health Standards which states that: During the portion of the year when there is a need for protection against flies and other flying insects, every window or other device intended for ventilation shall be supplied with effective screens.

This contravenes section III(3)(a) of the Minimum Housing and Health Standards which states that: Exterior windows and doors shall be capable of being secured. b. The bedroom door knob containing the locking mechanism was missing. There was a hole in the door where the knob used to be installed. The door could not be secured. This contravenes section III(3)(a) of the Minimum Housing and Health Standards which states that: Exterior windows and doors shall be capable of being secured. c. The bottom half of the bedroom door was split in two. This contravenes section III(1)(c) of the Minimum Housing and Health Standards which states that: Building materials that have been damaged or show evidence of rot or other deterioration shall be repaired or replaced. d. There were multiple fist-sized holes in the bedroom wall. This contravenes section III(5) of the Minimum Housing and Health Standards which states that: All walls, windows, ceilings, floors, and floor coverings shall be maintained in good repair, free of cracks, holes, loose or lifting coverings and in a condition that renders it easy to clean Unit 5 Common: a. Temperatures obtained in the unit were between 15 and 19 degrees Celsius. This contravenes section IV(8)(a)(i) of the Minimum Housing and Health Standards which states that: All heating facilities within a housing premises are to be properly installed and maintained in good working condition, and be capable of safely and adequately heating all habitable rooms, bathrooms, and toilet rooms within the building to a temperature of at least 22 degrees Celsius(710F), or maintained at a temperature of at least 22 degrees Celsius(710F) when the control of the supplied heat in a dwelling is the responsibility of a person other than the occupant b. Bathtub surround tiles were loose around the faucet. The grout between bathtub tiles was worn and missing. There were gaps around the metal plate between the hot and cold water taps. Moisture meter measurements obtained throughout various sections of the bathtub tile surround were between 761-763 REL (relative moisture level). section III(1)(c) of the Minimum Housing and Health Standards which states that: Building materials that have been damaged or show evidence of rot or other deterioration shall be repaired or replaced. c. Caulking along the interior joints of the bathtub was worn and mouldy. This contravenes section III(5)(a) of the Minimum Housing and Health Standards which states that: Rooms containing a flush toilet and/or a bathtub or shower shall have walls and floors that are smooth, non-absorbent to moisture and easy to clean. All walls shall form a watertight joint with each other, the floor, the ceiling and where applicable with the bathtub or shower. d. On November 23, 2017 the waterline for the toilet was leaking. A bucket was placed under the water line to collect dripping water. On January 10, 2017 water was pooling around the base of the toilet and a trail of water was forming on the floor towards the bathroom counter. This contravenes section IV(6)(c) of the Minimum Housing and Health Standards which states that: All plumbing fixtures shall be serviceable, free from leaks, trapped and vented to the outside. e. The shelf under the bathroom sink was water stained. This contravenes section III(1)(c) of the Minimum Housing and Health Standards which states that: Building

Page 14 of 21 materials that have been damaged or show evidence of rot or other deterioration shall be repaired or replaced. f. Caulking was worn along the joint between the bathroom counter and the wall allowing water to infiltrate this area. This contravenes section III(5)(a) of the Minimum Housing and Health Standards which states that: Rooms containing a flush toilet and/or a bathtub or shower shall have walls and floors that are smooth, nonabsorbent to moisture and easy to clean. All walls shall form a watertight joint with each other, the floor, the ceiling and where applicable with the bathtub or shower. g. Several edges of the kitchen counter tops were unfinished exposing bare wood. This contravenes section IV(14)(a)(iii) of the Minimum Housing and Health Standards which states that: Every housing premises shall be provided with a food preparation area, which includes: a counter or table used for food preparation which shall be of sound construction and furnished with surfaces that are easily cleaned. h. There were several small holes and knife cuts in the kitchen counter top, rendering it not easily cleanable. This contravenes section IV(14)(a)(iii) of the Minimum Housing and Health Standards which states that: Every housing premises shall be provided with a food preparation area, which includes: a counter or table used for food preparation which shall be of sound construction and furnished with surfaces that are easily cleaned. i. The cupboard shelf under the kitchen sink was badly worn, exposing bare wood. This contravenes section IV(14)(a)(ii) of the Minimum Housing and Health Standards which states that: Every housing premises shall be provided with a food preparation area, which includes: cupboards or other facilities suitable for the storage of food. j. Caulking was worn along the joint between the kitchen counter top and the wall, allowing water to infiltrate the area. This contravenes section IV(14)(a)(iii) of the Minimum Housing and Health Standards which states that: Every housing premises shall be provided with a food preparation area, which includes: a counter or table used for food preparation which shall be of sound construction and furnished with surfaces that are easily cleaned. k. The baseboard along the wall in the kitchen next to the oven was missing. This contravenes section III(5)(b) of the Minimum Housing and Health Standards which states that: Rooms and sections of rooms that are used for food preparation and cooking shall have walls and floors constructed of materials which do not provide harbourage to dirt, grease, vermin and bacteria and that are easily kept clean. l. The living room baseboard heat cover was loose. This contravenes section III(5) of the Minimum Housing and Health Standards which states that: All walls, windows, ceilings, floors, and floor coverings shall be maintained in good repair, free of cracks, holes, loose or lifting coverings and in a condition that renders it easy to clean. m. There was a hole in the wall next to the main entry door. This contravenes section III(5) of the Minimum Housing and Health Standards which states that: All walls, windows, ceilings, floors, and floor coverings shall be maintained in good repair, free of cracks, holes, loose or lifting coverings and in a condition that renders it easy to clean. Unit 5 1: a. Covers were missing on the baseboard heating pipes, exposing plumbing and electrical connections as well as sharp metal fins. This contravenes section III(5) of the Minimum Housing and Health Standards which states that: All walls, windows,

Page 15 of 21 ceilings, floors, and floor coverings shall be maintained in good repair, free of cracks, holes, loose or lifting coverings and in a condition that renders it easy to clean. b. A metal covering was installed on the bedroom door around the lock. The metal covering was protruding outwards rendering the door difficult to close. This contravenes section III(1)(c) of the Minimum Housing and Health Standards which states that: Building materials that have been damaged or show evidence of rot or other deterioration shall be repaired or replaced. c. There was no lock on the bedroom window. This contravenes section III(3)(a) of the Minimum Housing and Health Standards which states that: Exterior windows and doors shall be capable of being secured. d. The bedroom window was cracked the entire way across the pane. This contravenes section III(5) of the Minimum Housing and Health Standards which states that: All walls, windows, ceilings, floors, and floor coverings shall be maintained in good repair, free of cracks, holes, loose or lifting coverings and in a condition that renders it easy to clean. Unit 5 2: a. Bedroom baseboards were badly warped. This contravenes section III(1)(c) of the Minimum Housing and Health Standards which states that: Building materials that have been damaged or show evidence of rot or other deterioration shall be repaired or replaced. b. The baseboard heat cover did not extend to the end of the pipe, exposing the hot water pipe. This contravenes section III(5) of the Minimum Housing and Health Standards which states that: All walls, windows, ceilings, floors, and floor coverings shall be maintained in good repair, free of cracks, holes, loose or lifting coverings and in a condition that renders it easy to clean. c. There was a poorly patched and unfinished hole in the wall near the window. This contravenes section III(5) of the Minimum Housing and Health Standards which states that: All walls, windows, ceilings, floors, and floor coverings shall be maintained in good repair, free of cracks, holes, loose or lifting coverings and in a condition that renders it easy to clean. d. There was a gap in the door where the bedroom dead bolt lock used to be. This contravenes section III(5) of the Minimum Housing and Health Standards which states that: All walls, windows, ceilings, floors, and floor coverings shall be maintained in good repair, free of cracks, holes, loose or lifting coverings and in a condition that renders it easy to clean. e. The bedroom window lock was broken rendering the unit unsecure. This contravenes section III(3)(a) of the Minimum Housing and Health Standards which states that: Exterior windows and doors shall be capable of being secured. f. There was no screen on the bedroom window. This contravenes section III(2)(b)(iii) of the Minimum Housing and Health Standards which states that: During the portion of the year when there is a need for protection against flies and other flying insects, every window or other device intended for ventilation shall be supplied with effective screens. Unit 5 3:

Page 16 of 21 f. The patio door was frozen shut due to heavy ice buildup on the perimeter of the patio door frame, impacting egress and ventilation. This contravenes section III(3)(b)(i) of the Minimum Housing and Health Standards which states that: For buildings of 3 storeys or less and except where a bedroom door provides access directly to the exterior or the suite is sprinklered, each bedroom shall have at least one outside window which may be opened from the inside without the use of tools or special knowledge. And section III(4)(a,b) of the Minimum Housing and Health Standards which states that: All rooms used for sleeping shall be provided with: (a) openable window area of 0.28m2 (3.0ft2); or (b) mechanical ventilation in conformance with the requirements of the Alberta Building Code. And section III(2)(b)(i) of the Minimum Housing and Health Standards which states that: All windows and exterior doors shall be; maintained in good repair, free of cracks and weatherproof. g. The bedroom door was cracked in multiple places. This contravenes section III(1)(c) of the Minimum Housing and Health Standards which states that: Building materials that have been damaged or show evidence of rot or other deterioration shall be repaired or replaced. h. The door frame holding the strike plate was splintered in multiple areas. This contravenes section III(1)(c) of the Minimum Housing and Health Standards which states that: Building materials that have been damaged or show evidence of rot or other deterioration shall be repaired or replaced. i. A hole in the wall by the door was partially patched and unfinished. This contravenes section III(5) of the Minimum Housing and Health Standards which states that: All walls, windows, ceilings, floors, and floor coverings shall be maintained in good repair, free of cracks, holes, loose or lifting coverings and in a condition that renders it easy to clean. j. The patio screen door was torn. This contravenes section III(2)(b)(iii) of the Minimum Housing and Health Standards which states that: During the portion of the year when there is a need for protection against flies and other flying insects, every window or other device intended for ventilation shall be supplied with effective screens. AND WHEREAS, by virtue of the foregoing, the above noted premises are hereby declared to be Closed for Tenant Accommodation Purposes. NOW THEREFORE, I hereby ORDER and DIRECT: 1. That the occupants vacate the above noted premises on or before February 1, 2018. 2. That the Owner immediately undertake and diligently pursue the completion of the following work in and about the above noted premises, namely: Common: a. Repair the staircase, to ensure it is sturdy and the treads well-maintained. b. Replace the laundry room window or properly seal the opened area. c. Replace the windows on either side of the back exterior entry door. d. Install a cover over the hallway electrical light timer.
