C-2 Article XIII Section 1308A (preface to consider before reading C-2 Use Provisions) According to the zoning map for the city of Lilburn, the plot whereon the building located at 5005 Lawrenceville Hwy (29) in Lilburn is zoned C-2 and surrounded by residential zones on all sides with the exception of three properties touching Lawrenceville Hwy which are zoned C-1. Allowable Uses for this zoning ordinance are found in the Municode.com online library Please note: There are NO provisions FOR or AGAINST Crematories. Crematoriums get no mention whatsoever in the Municode Library for Lilburn. Below you will notice allowable uses can include similar in nature business applications. Because of the omission of crematory in the zoning code, it falls to interpretation of building officials as to what comparable businesses there are, whether or not to require a special use permit. Therefore, if one thinks a stand-alone crematory is similar enough to a funeral home or mausoleum, it ought be considered the same. Looking at what a more appropriate similar comparison might be to consider, take the contrast below: Section 1308A. M1 Light Industry District. There shall be no Solid Waste Incinerator and/or Microwave Facility in the City of Lilburn. Why compare to a solid waste incinerator? The answer is that a crematory is in fact an incinerator. Unlike a mausoleum, funeral home, or even a cemetery, a crematory emits pollution into the air. There is no way around it. What kind of pollution may be subject to debate. Data supplied by the industry is not always reliable when they fail to report or even test for specified pollution. Independent sources conflict with their data points on how much and what specific toxins are being released. Third party scientific studies conclude that crematories do indeed emit toxic pollutants. Appendix A Zoning Article XIII Use Provisions Section 1306. C-2 General Business District. The C-2 General Business District is intended to provide adequate space in appropriate locations along major streets, thoroughfares and at intersections for various types of business use. These uses should include the retailing of major goods and services, general office facilities and public functions that would serve a community area of several neighborhoods. Development of uses in the District characteristically occupies a larger area than in the C-1 Neighborhood Business District because it is intended to serve a greater population and to offer a wider range of services. Orientation and expansion of this District should occur as an increase in depth at major intersections rather than as a strip-like extension along the street or thoroughfare.

Permitted Uses. Only the following permitted uses shall be allowed in the C-2 General Business District and no structure shall be erected, structurally altered or enlarged for any use other than a use permitted herein with the exception of: a) uses lawfully established prior to the effective date of this amendment; b) Special Uses as permitted herein; c) accessory uses as defined in Article III, Definitions; d) other uses which are clearly similar to and consistent with the purpose of this District; or e) C-1 Neighborhood Business District Uses, Special Uses and Temporary Uses. A. Retail and Service Uses: 1. Antique Shops. 2. Animal Hospitals or Veterinary Clinics. 3. Art and School Supply Stores. 4. Art Galleries. 5. Automotive Car Wash (full service or self service). 6. Automotive Parts Stores (No on-premises installation). 7. Bakeries. 8. Banks or Financial Institutions. Automatic Tellers as accessory or free-standing use. 9. Barber and Beauty Shops. 10. Bicycle Shops. 11. Blueprinting Establishments. 12. Book or Stationery Stores. 13. Building, Electrical or Plumbing Contractors (provided no equipment or materials are stored outside). 14. Business College or Business Schools operated as a business enterprise. 15. Clothing Sales or Rental Stores. 16. (b) Each hotel/motel site shall be a minimum of two acres; (c) Each hotel/motel must provide management on duty 24 hours a day; (d) Each guest room shall have a minimum of 300 square feet and shall be accessed with a magnetic keycard entry/locking device; (e) For buildings three stories or less or containing no more than 130 rooms, each hotel/motel building shall have a minimum roof pitch of four in 12; (f) Outside storage of commercial equipment is prohibited; (g) No business license shall be issued for any business operating from any guest room of the facility; (h) Provide a 75-foot natural buffer, enhanced with an additional 24-foot landscaped buffer (total 100 feet) adjacent to residentially zoned property. (i) Any outdoor recreational areas provided shall be located to the rear of the site. (j) These items shall apply to all hotels/motels and are in addition to and not in lieu of any existing development regulations contained in this zoning classification or other ordinances and regulations of the City of Lilburn. 37. Within the C-2 General Business District, the following uses may be permitted provided the applicant for such a development is granted a Special Use Permit by the Mayor and Council after receiving a recommendation from the Planning Commission and after a public hearing. 1. Automotive Body Repair Shops, provided damaged vehicles and/or vehicles undergoing repair are screened with a six-foot high, 100 percent opaque fence. 2. Automotive Repair Shops, Automotive Paint Shops, Automotive Glass Repair Shops, Van Conversion Shops, Motorcycle Repair Shops, or Tire Stores including Lubrication or Tune-up Centers (full service and self service). 3. Automotive and Motorcycle Sales Lots and Associated Service Facilities (new or used) provided that the property proposed for said use shall be not less than 1.5 acres in size and have a minimum road frontage of 200 feet. 4. Automotive Service Stations, with or without fuel pumps. 5. Building Materials Sales with Outdoor Storage. 6. Cabinet Shops. 7. Check cashing businesses.

The exterior wall of the said building shall neither be attached to nor connected with any other building of any nature whatsoever. For purposes of these requirements, a "fire wall" shall not constitute an exterior wall and shall not detach the required premise from any adjacent building. e) No other structure shall be constructed within ten feet of any of the exterior walls of the said building. This requirement cannot be waived by application for a variance. f) Any building in which distilled liquor is sold shall be one-story only and shall contain a minimum of 2,500 square feet of gross floor space. g) The front face of the building shall have a minimum of 150 square feet of plate glass in addition to any glass on entrance or exit doors. h) Comply with other City Ordinances pertaining to business license requirements for a retail package store. 16. Pawnshops, Title Pawn Shops, and Check Cashing Businesses provided the following: No pawnshop, title pawn shop or check cashing business shall be licensed or operated within 1,000 feet of any residential zoning district, school, public or private college, church or other place of worship, library, daycare facility, any park or playground, massage establishment, tattoo studio, existing pawnshop, title pawnshop, check cashing or adult entertainment establishment. The distances required by this section shall be measured from the closest property line occupied, or to be occupied, by the pawnshop, title pawnshop, or check cashing business to the closest property line occupied by the foregoing protected uses. 19. Adult Entertainment Establishments. 20. Cemetery Associated with Funeral Home or Mausoleum. Other Provisions: A. Automobile parking is permitted within the front yard setback. B. A ten-foot landscaped strip shall be provided adjacent to the right-of-way. C. Fuel pumps and canopies covering fuel pumps are permitted within the front yard setback provided the fuel pumps are located at least 15 feet from the right-of-way and the canopies are located at least ten feet from the right-of-way. D. No outdoor storage is permitted except as otherwise provided herein.

E. All exterior building materials and colors contribute significantly to the visual impact of a building. The exterior building skin shall be composed of one dominant facing material and not more than two additional materials. The dominant material shall comprise 60 percent or greater of each building elevation. (a) Dominant exterior materials may include: (1) Brick. (2) Decorative Stone. (3) Glass: Warm and cool tones. (4) Cementatious Lap Board Siding (Residential Only). (b) Dominant exterior building materials may not include: (1) Aluminum, metal, or steel siding. (2) Vinyl siding (applies to new construction only). (3) Glass, if highly reflective material. (4) Or other exterior architectural treatment deemed not acceptable by the Building Official or his designee. (c) Dominant facade colors shall be chosen from a city approved color palette of acceptable colors. The use of high intensity colors, metallic colors and black is prohibited. Building trim and accents may feature brighter colors. Neon tube lighting may not be used for building trim or accent.
