Invitation to Bid Bid 17-45 NOTICE IS HEREBY GIVEN that sealed bids will be received by Purchasing at their office in the Administrative Services Finance Department on the fifth floor of the Whatcom County Courthouse, 311 Grand Avenue, Suite 503, Bellingham WA 98225, for purchase of the following: ANNUAL SUPPLY OF ROCK, GRAVEL, AND SOIL UNTIL: 2:30 PM, Tuesday, June 13, 2017 At which time and place the bids will be publicly opened and read aloud. All bidders and any other interested people are invited to be present. This bid is to establish a list of suppliers and firm prices for the annual supply of rock, gravel, and soil for Whatcom County Public Works and Whatcom County Parks & Recreation Department. Award will be made to the lowest and/or best bidder. In the absence of special circumstances, the County will select the supplier submitting the lowest bid price for the specific material item needed. However, under special circumstances, the County may select the supplier or suppliers not submitting the lowest bid, but in consideration of the special circumstances, meeting the County s requirements for the specified material needed. Special circumstances that may be considered include: differences in ability to deliver, delivery time, availability of material, special loading or unloading conditions, total cost including transport if not included with bid item, performance of the delivered material, location of the source, and proximity to the delivery point. MINIMUM SPECIFICATIONS Sealed bid proposals are solicited and will be received only at the office of Whatcom County Administrative Services Finance/Purchasing on the fifth floor of the Whatcom County Courthouse, 311 Grand Avenue, Suite 503, Bellingham WA 98225. Deliver responses between the hours of 8:00 AM and 4:30 PM Monday through Friday to Whatcom County Administrative Services Finance/Purchasing, located at 311 Grand Avenue, Suite 503, Bellingham WA 98225. The deadline is 2:30 PM, Tuesday, June 13, 2017. All bids, received on time, will be opened in public at the above stated time and place. All interested people are invited to be present. Whatcom County does not consider: Late bids. E-mailed bids. Faxed bids. Bid award and subsequent contract will be made to the lowest responsive and responsible bidder that meets all of the minimum specifications to the satisfaction of the County. This includes, but is not limited to: The quality of the articles to be provided. Their conformity with the specifications. The warranty clause, if any, will be taken into consideration. The purpose of this bid is to obtain a convenient, continuous, and readily available source for the supply of rock, gravel and soil at the lowest cost in quantities and for jobs needed by Whatcom County Public Works and Whatcom County Parks & Recreation. The County intends to make agreements with all responsible and responsive bidders. Whatcom County reserves the right to accept any bid that, in their opinion, serves the best interest of the County and to reject any bid or all bids. Generally the County will select the supplier submitting the lowest bid price for the specific material needed. However, under special circumstances, the County may select the supplier or suppliers that best meet the requirements for that particular job based on criteria other than lowest bid price. Special circumstances which may be considered include: Differences in ability to deliver. Delivery time. Availability of material. Special loading or unloading conditions. Total cost including transport and or labor, if not included with bid item. Performance of the delivered material. Location of the source. Proximity to the delivery point. PERIOD Any agreement made as a result of this bid will be for the period from the date of the award through June 30, 2018. Prices quoted will be considered firm during this period. SALES TAX Whatcom County will pay applicable Washington State sales tax upon receipt of a valid invoice. Washington State sales tax is payable as use tax by the County, and paid directly to the State of Washington at the rate of 8.5% on purchases made from out-of-state vendors who do not have a Washington State sales tax number. With the exception of Washington State sales tax, all other applicable taxes, permits, fees, or custom levies required to be in compliance with federal, state, provincial, or local rules or regulations, must be included in the bid prices offered. PAYMENT TERMS Whatcom County intends to take advantage of prompt payment terms offered. Prompt payment discounts of 20 calendar days or more after receipt of correct material and invoice will be considered in evaluating bids as a constant percentage of dollar reduction to unit bid price. SUBMISSION OF BIDS Bids must be submitted bids on these forms, using ink or computer, and supplying all the information requested. To be considered, bids must be signed and original documents submitted. CANADIAN BIDDERS Canadian bidders must quote prices in U.S. tons and U.S. dollars. Canadian suppliers will be expected to invoice the County in U.S. tons and U.S. dollars. Canadian bidders must include in their bid price all U.S. and/or Canadian customs charges to be levied against delivered rock, gravel and soil entering the United States. Whatcom County will not pay any additional entry charges. INTERLOCAL COOPERATIVE ACT (WASHINGTON STATE RCW 39.34) Bidders are requested to indicate if other municipalities or political subdivisions may purchase the same material from the vendor over the subsequent time period for which the vendor is willing to honor the bid price. GENERAL INSTRUCTIONS Bids are solicited for furnishing quarry rock, gravel and soil in the specific dimensions listed in further detail below under Material Specifications. ORDER QUANTITY There are no guarantees regarding minimum or maximum order quantities. Orders will be issued on an as needed basis. Bidders must indicate minimum order quantities and any other special terms and conditions on the Bid Response Form. REQUIRED INFORMATION For a bid to be considered, all information requested on the Bid Response Form is required to be listed in its entirety. Any reference to the State of Washington or to an officer thereof will be construed to mean Whatcom County or the appropriate equivalent official of Whatcom County. All material supplied must conform to the appropriate specifications required by the Standard Specifications with the following supplemental specifications. Page 5 of 12 Whatcom County

TOP SOIL Topsoil must be natural loam, sandy loam, silt loam, or clay loam humus-bearing soil containing a limited amount of organic material and not a mixture of contrasting textured subsoil. It must be free of foreign material such as hard pan, stones larger than 1/4-inch diameter, concrete, cinders, brick, asphalt, or other undesirable materials. Topsoil shall be reasonably free of weeds and other objectionable plant material. All topsoil shall be tested for correct nutrients (nitrogen, phosphate, and potassium) and proper ph level, neither excessively acidic or alkalinity and must be amended as per the soil test recommendation. Topsoil must be free of contaminants that may be harmful to the environment. LEVEE CLAY FILL Material shall be a clay based material with a 20% to 40% fines passing the US Standard No. 200 sieve with no organic material and limited oversize particles (i.e., 75 mm minus). RIGHT OF REFUSAL Whatcom County reserves the right to refuse any item that is defective, substandard, or does not meet the stated specifications. All items purchased as a result of this bid are subject to the approval of the Whatcom County Public Works Department. Any item rejected, because of nonconformance with the terms and conditions of this bid, whether held by the County or returned, will be at the vendor s own risk and expense.
